55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the offense involving the carrying of handguns by
88 license holders on the premises of state hospitals.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 411.204, Government Code, is amended by
1111 amending Subsection (b) and adding Subsection (f) to read as
1212 follows:
1313 (b) A hospital licensed under Chapter 241, Health and Safety
1414 Code, [or] a nursing facility [home] licensed under Chapter 242,
1515 Health and Safety Code, or a state hospital shall prominently
1616 display at each entrance to the hospital or facility [nursing
1717 home], as appropriate, a sign that complies with the requirements
1818 of Subsection (c) other than the requirement that the sign include
1919 on its face the number "51".
2020 (f) In this section, "state hospital" means the following
2121 facilities:
2222 (1) the Austin State Hospital;
2323 (2) the Big Spring State Hospital;
2424 (3) the El Paso Psychiatric Center;
2525 (4) the Kerrville State Hospital;
2626 (5) the North Texas State Hospital;
2727 (6) the Rio Grande State Center;
2828 (7) the Rusk State Hospital;
2929 (8) the San Antonio State Hospital;
3030 (9) the Terrell State Hospital; and
3131 (10) the Waco Center for Youth.
3232 SECTION 2. Section 46.035, Penal Code, is amended by
3333 amending Subsections (b) and (i) and adding Subsection (i-1) to
3434 read as follows:
3535 (b) A license holder commits an offense if the license
3636 holder intentionally, knowingly, or recklessly carries a handgun
3737 under the authority of Subchapter H, Chapter 411, Government Code,
3838 regardless of whether the handgun is concealed or carried in a
3939 shoulder or belt holster, on or about the license holder's person:
4040 (1) on the premises of a business that has a permit or
4141 license issued under Chapter 25, 28, 32, 69, or 74, Alcoholic
4242 Beverage Code, if the business derives 51 percent or more of its
4343 income from the sale or service of alcoholic beverages for
4444 on-premises consumption, as determined by the Texas Alcoholic
4545 Beverage Commission under Section 104.06, Alcoholic Beverage Code;
4646 (2) on the premises where a high school, collegiate,
4747 or professional sporting event or interscholastic event is taking
4848 place, unless the license holder is a participant in the event and a
4949 handgun is used in the event;
5050 (3) on the premises of a correctional facility;
5151 (4) on the premises of a hospital licensed under
5252 Chapter 241, Health and Safety Code, [or on the premises of] a
5353 nursing facility licensed under Chapter 242, Health and Safety
5454 Code, or a state hospital unless the license holder has written
5555 authorization of the administration of the hospital or [nursing]
5656 facility [administration], as appropriate;
5757 (5) in an amusement park; or
5858 (6) on the premises of a church, synagogue, or other
5959 established place of religious worship.
6060 (i) Subsections [(b)(4),] (b)(5), (b)(6), and (c) do not
6161 apply if the actor was not given effective notice under Section
6262 30.06 or 30.07.
6363 (i-1) Subsection (b)(4) does not apply if the actor was not
6464 given effective notice under Section 30.06 or 30.07 or under
6565 Section 411.204, Government Code.
6666 SECTION 3. Section 46.035(f), Penal Code, is amended by
6767 adding Subdivision (4) to read as follows:
6868 (4) "State hospital" means the following facilities:
6969 (A) the Austin State Hospital;
7070 (B) the Big Spring State Hospital;
7171 (C) the El Paso Psychiatric Center;
7272 (D) the Kerrville State Hospital;
7373 (E) the North Texas State Hospital;
7474 (F) the Rio Grande State Center;
7575 (G) the Rusk State Hospital;
7676 (H) the San Antonio State Hospital;
7777 (I) the Terrell State Hospital; and
7878 (J) the Waco Center for Youth.
7979 SECTION 4. The change in law made by this Act applies only
8080 to an offense committed on or after the effective date of this Act.
8181 An offense committed before the effective date of this Act is
8282 governed by the law in effect on the date the offense was committed,
8383 and the former law is continued in effect for that purpose. For
8484 purposes of this section, an offense was committed before the
8585 effective date of this Act if any element of the offense occurred
8686 before that date.
8787 SECTION 5. This Act takes effect September 1, 2017.
