|---|
| 7 | 7 | | relating to the offense involving the carrying of handguns by |
|---|
| 8 | 8 | | license holders on the premises of state hospitals. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 411.204, Government Code, is amended by |
|---|
| 11 | 11 | | amending Subsection (b) and adding Subsection (f) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (b) A hospital licensed under Chapter 241, Health and Safety |
|---|
| 14 | 14 | | Code, [or] a nursing facility [home] licensed under Chapter 242, |
|---|
| 15 | 15 | | Health and Safety Code, or a state hospital shall prominently |
|---|
| 16 | 16 | | display at each entrance to the hospital or facility [nursing |
|---|
| 17 | 17 | | home], as appropriate, a sign that complies with the requirements |
|---|
| 18 | 18 | | of Subsection (c) other than the requirement that the sign include |
|---|
| 19 | 19 | | on its face the number "51". |
|---|
| 20 | 20 | | (f) In this section, "state hospital" means the following |
|---|
| 21 | 21 | | facilities: |
|---|
| 22 | 22 | | (1) the Austin State Hospital; |
|---|
| 23 | 23 | | (2) the Big Spring State Hospital; |
|---|
| 24 | 24 | | (3) the El Paso Psychiatric Center; |
|---|
| 25 | 25 | | (4) the Kerrville State Hospital; |
|---|
| 26 | 26 | | (5) the North Texas State Hospital; |
|---|
| 27 | 27 | | (6) the Rio Grande State Center; |
|---|
| 28 | 28 | | (7) the Rusk State Hospital; |
|---|
| 29 | 29 | | (8) the San Antonio State Hospital; |
|---|
| 30 | 30 | | (9) the Terrell State Hospital; and |
|---|
| 31 | 31 | | (10) the Waco Center for Youth. |
|---|
| 32 | 32 | | SECTION 2. Section 46.035, Penal Code, is amended by |
|---|
| 33 | 33 | | amending Subsections (b) and (i) and adding Subsection (i-1) to |
|---|
| 34 | 34 | | read as follows: |
|---|
| 35 | 35 | | (b) A license holder commits an offense if the license |
|---|
| 36 | 36 | | holder intentionally, knowingly, or recklessly carries a handgun |
|---|
| 37 | 37 | | under the authority of Subchapter H, Chapter 411, Government Code, |
|---|
| 38 | 38 | | regardless of whether the handgun is concealed or carried in a |
|---|
| 39 | 39 | | shoulder or belt holster, on or about the license holder's person: |
|---|
| 40 | 40 | | (1) on the premises of a business that has a permit or |
|---|
| 41 | 41 | | license issued under Chapter 25, 28, 32, 69, or 74, Alcoholic |
|---|
| 42 | 42 | | Beverage Code, if the business derives 51 percent or more of its |
|---|
| 43 | 43 | | income from the sale or service of alcoholic beverages for |
|---|
| 44 | 44 | | on-premises consumption, as determined by the Texas Alcoholic |
|---|
| 45 | 45 | | Beverage Commission under Section 104.06, Alcoholic Beverage Code; |
|---|
| 46 | 46 | | (2) on the premises where a high school, collegiate, |
|---|
| 47 | 47 | | or professional sporting event or interscholastic event is taking |
|---|
| 48 | 48 | | place, unless the license holder is a participant in the event and a |
|---|
| 49 | 49 | | handgun is used in the event; |
|---|
| 50 | 50 | | (3) on the premises of a correctional facility; |
|---|
| 51 | 51 | | (4) on the premises of a hospital licensed under |
|---|
| 52 | 52 | | Chapter 241, Health and Safety Code, [or on the premises of] a |
|---|
| 53 | 53 | | nursing facility licensed under Chapter 242, Health and Safety |
|---|
| 54 | 54 | | Code, or a state hospital unless the license holder has written |
|---|
| 55 | 55 | | authorization of the administration of the hospital or [nursing] |
|---|
| 56 | 56 | | facility [administration], as appropriate; |
|---|
| 57 | 57 | | (5) in an amusement park; or |
|---|
| 58 | 58 | | (6) on the premises of a church, synagogue, or other |
|---|
| 59 | 59 | | established place of religious worship. |
|---|
| 60 | 60 | | (i) Subsections [(b)(4),] (b)(5), (b)(6), and (c) do not |
|---|
| 61 | 61 | | apply if the actor was not given effective notice under Section |
|---|
| 62 | 62 | | 30.06 or 30.07. |
|---|
| 63 | 63 | | (i-1) Subsection (b)(4) does not apply if the actor was not |
|---|
| 64 | 64 | | given effective notice under Section 30.06 or 30.07 or under |
|---|
| 65 | 65 | | Section 411.204, Government Code. |
|---|
| 66 | 66 | | SECTION 3. Section 46.035(f), Penal Code, is amended by |
|---|
| 67 | 67 | | adding Subdivision (4) to read as follows: |
|---|
| 68 | 68 | | (4) "State hospital" means the following facilities: |
|---|
| 69 | 69 | | (A) the Austin State Hospital; |
|---|
| 70 | 70 | | (B) the Big Spring State Hospital; |
|---|
| 71 | 71 | | (C) the El Paso Psychiatric Center; |
|---|
| 72 | 72 | | (D) the Kerrville State Hospital; |
|---|
| 73 | 73 | | (E) the North Texas State Hospital; |

| 79 | 79 | | SECTION 4. The change in law made by this Act applies only |
|---|
| 80 | 80 | | to an offense committed on or after the effective date of this Act. |
|---|
| 81 | 81 | | An offense committed before the effective date of this Act is |
|---|
| 82 | 82 | | governed by the law in effect on the date the offense was committed, |
|---|
| 83 | 83 | | and the former law is continued in effect for that purpose. For |
|---|
| 84 | 84 | | purposes of this section, an offense was committed before the |
|---|
| 85 | 85 | | effective date of this Act if any element of the offense occurred |
|---|
| 86 | 86 | | before that date. |
|---|
| 87 | 87 | | SECTION 5. This Act takes effect September 1, 2017. |
