| 7 | 7 | | relating to notification requirements applicable to certain state |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 2166.2551, Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | Sec. 2166.2551. CONTRACT NOTIFICATION. The commission or |
|---|
| 13 | 13 | | an agency whose project is exempted from all or part of this chapter |
|---|
| 14 | 14 | | under Section 2166.003 shall provide written notice to the |
|---|
| 15 | 15 | | Legislative Budget Board of a contract for a construction project |
|---|
| 16 | 16 | | if the amount of the contract, including an amendment, |
|---|
| 17 | 17 | | modification, renewal, or extension of the contract, exceeds $1 |
|---|
| 18 | 18 | | million [$14,000]. The notice must be on a form prescribed by the |
|---|
| 19 | 19 | | Legislative Budget Board and filed not later than the 10th day after |
|---|
| 20 | 20 | | the date the agency enters into the contract. |
|---|
| 21 | 21 | | SECTION 2. Section 2254.006, Government Code, is amended to |
|---|
| 22 | 22 | | read as follows: |
|---|
| 23 | 23 | | Sec. 2254.006. CONTRACT NOTIFICATION. A state agency, |
|---|
| 24 | 24 | | including an institution of higher education as defined by Section |
|---|
| 25 | 25 | | 61.003, Education Code, shall provide written notice to the |
|---|
| 26 | 26 | | Legislative Budget Board of a contract for professional services, |
|---|
| 27 | 27 | | other than a contract for physician or optometric services, if the |
|---|
| 28 | 28 | | amount of the contract, including an amendment, modification, |
|---|
| 29 | 29 | | renewal, or extension of the contract, exceeds $100,000 [$14,000]. |

| 30 | 30 | | The notice must be on a form prescribed by the Legislative Budget |
|---|
| 31 | 31 | | Board and filed not later than the 10th day after the date the |
|---|
| 32 | 32 | | agency enters into the contract. |
|---|
| 33 | 33 | | SECTION 3. Section 2254.0301(a), Government Code, is |
|---|
| 34 | 34 | | amended to read as follows: |
|---|
| 35 | 35 | | (a) A state agency shall provide written notice to the |
|---|
| 36 | 36 | | Legislative Budget Board of a contract for consulting services if |
|---|
| 37 | 37 | | the amount of the contract, including an amendment, modification, |
|---|
| 38 | 38 | | renewal, or extension of the contract, exceeds $50,000 [$14,000]. |

| 39 | 39 | | The notice must be on a form prescribed by the Legislative Budget |
|---|
| 40 | 40 | | Board and filed not later than the 10th day after the date the |
|---|
| 41 | 41 | | entity enters into the contract. |
|---|
| 42 | 42 | | SECTION 4. Sections 2166.2551, 2254.006, and 2254.0301(a), |
|---|
| 43 | 43 | | Government Code, as amended by this Act, apply only to a state |
|---|
| 44 | 44 | | agency contract for which the agency is required to provide notice |
|---|
| 45 | 45 | | to the Legislative Budget Board that is entered into on or after the |
|---|
| 46 | 46 | | effective date of this Act. |
|---|
| 47 | 47 | | SECTION 5. To the extent of any conflict, this Act prevails |
|---|
| 48 | 48 | | over another Act of the 85th Legislature, Regular Session, 2017, |
|---|
| 49 | 49 | | relating to state agency contracting and oversight. |
|---|
| 50 | 50 | | SECTION 6. This Act takes effect September 1, 2017. |
