75 relating to energy and water management planning and reporting
86 requirements for state agencies and institutions of higher

108 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
119 SECTION 1. Section 447.009, Government Code, is amended to
1210 read as follows:
1311 Sec. 447.009. ENERGY AND WATER MANAGEMENT PLANNING;
1412 REPORTING. (a) The state energy conservation office shall provide
1513 energy and water management planning assistance to a state agency
1614 or an institution of higher education, including assistance to:
1715 (1) [preparation by the agency or institution of a
1816 long-range plan for the delivery of reliable, cost-effective
1917 utility services for the state agency or institution;
2018 [(2) assistance to] the Department of Public Safety
2119 for energy emergency contingency planning, using state or federal
2220 funds when available; and
2321 (2) [(3) assistance to] each state agency or
2422 institution of higher education in preparing comprehensive energy
2523 and water management plans[; and
2624 [(4) assistance to state agencies other than
2725 institutions of higher education in meeting the requirements of
2826 Section 447.002, including assistance in scheduling and assigning
2927 priorities to implementation plans to ensure that state agencies
3028 adopt qualified cost-effective efficiency measures and programs
3129 for all state facilities not later than September 1, 2006].
3230 (b) [A state agency or an institution of higher education
3331 shall develop the plan described in Subsection (a)(1) and submit
3432 the plan to the state energy conservation office upon request. The
3533 agency or institution shall use the plan in preparing its five-year
3634 construction and major renovation plans. After other energy-saving
3735 or water-saving alternatives are considered, district heating and
3836 cooling or on-site generation of electricity may be considered in
3937 planning for reliable, efficient, and cost-effective utility
4038 services.
4139 [(c)] The state energy conservation office shall prepare
4240 guidelines for preparation of the plan described in Subsection
4341 (a)(2) [(a)(3)] and develop a template for state agencies and
4442 institutions of higher education to use in creating the plan. Each
4543 state agency and institution of higher education shall set
4644 percentage goals for reducing the agency's or institution's use of
4745 water, electricity, transportation fuel [gasoline], and natural
4846 gas and include those goals in the agency's or institution's
4947 comprehensive energy and water management plan. [A state agency or
5048 an institution of higher education that occupies a state-owned
5149 building shall prepare and implement a five-year energy and water
5250 management plan and shall submit that plan to the office upon
5351 request. The agency or institution shall update its plan annually.
5452 A state agency or an institution of higher education that occupies a
5553 building not owned by the state shall cooperate with the office in
5654 addressing the energy or water management of that building.]
5755 (c) [(d)] The comprehensive energy and water management
5856 plan described in Subsection (a)(2) [(a)(3)] shall be included in
5957 the five-year construction and major repair and rehabilitation
6058 plans for institutions of higher education as required by Section
6159 61.0651, Education Code.
6260 (d) [(e)] Not later than January 15 [December 1] of each
6361 odd-numbered [even-numbered] year, the state energy conservation
6462 office shall submit a report to the governor and the Legislative
6563 Budget Board on the status and effectiveness of the utility
6664 management and conservation efforts of state agencies and
6765 institutions of higher education. The report must include
6866 information submitted to the office from each state agency and
6967 institution of higher education. The office shall post the report
7068 on the office's Internet website.
7169 SECTION 2. This Act takes effect September 1, 2017.
