7	5		relating to energy and water management planning and reporting
8	6		requirements for state agencies and institutions of higher
9	7		education.
10	8		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	9		SECTION 1. Section 447.009, Government Code, is amended to
12	10		read as follows:
13	11		Sec. 447.009. ENERGY AND WATER MANAGEMENT PLANNING;
14	12		REPORTING. (a) The state energy conservation office shall provide
15	13		energy and water management planning assistance to a state agency
16	14		or an institution of higher education, including assistance to:
17	15		(1) [preparation by the agency or institution of a
18	16		long-range plan for the delivery of reliable, cost-effective
19	17		utility services for the state agency or institution;
20	18		[(2) assistance to] the Department of Public Safety
21	19		for energy emergency contingency planning, using state or federal
22	20		funds when available; and
23	21		(2) [(3) assistance to] each state agency or
24	22		institution of higher education in preparing comprehensive energy
25	23		and water management plans[; and
26	24		[(4) assistance to state agencies other than
27	25		institutions of higher education in meeting the requirements of
28	26		Section 447.002, including assistance in scheduling and assigning
29	27		priorities to implementation plans to ensure that state agencies
30	28		adopt qualified cost-effective efficiency measures and programs
31	29		for all state facilities not later than September 1, 2006].
32	30		(b) [A state agency or an institution of higher education
33	31		shall develop the plan described in Subsection (a)(1) and submit
34	32		the plan to the state energy conservation office upon request. The
35	33		agency or institution shall use the plan in preparing its five-year
36	34		construction and major renovation plans. After other energy-saving
37	35		or water-saving alternatives are considered, district heating and
38	36		cooling or on-site generation of electricity may be considered in
39	37		planning for reliable, efficient, and cost-effective utility
40	38		services.
41	39		[(c)] The state energy conservation office shall prepare
42	40		guidelines for preparation of the plan described in Subsection
43	41		(a)(2) [(a)(3)] and develop a template for state agencies and
44	42		institutions of higher education to use in creating the plan. Each
45	43		state agency and institution of higher education shall set
46	44		percentage goals for reducing the agency's or institution's use of
47	45		water, electricity, transportation fuel [gasoline], and natural
48	46		gas and include those goals in the agency's or institution's
49	47		comprehensive energy and water management plan. [A state agency or
50	48		an institution of higher education that occupies a state-owned
51	49		building shall prepare and implement a five-year energy and water
52	50		management plan and shall submit that plan to the office upon
53	51		request. The agency or institution shall update its plan annually.
54	52		A state agency or an institution of higher education that occupies a
55	53		building not owned by the state shall cooperate with the office in
56	54		addressing the energy or water management of that building.]
57	55		(c) [(d)] The comprehensive energy and water management
58	56		plan described in Subsection (a)(2) [(a)(3)] shall be included in
59	57		the five-year construction and major repair and rehabilitation
60	58		plans for institutions of higher education as required by Section
61	59		61.0651, Education Code.
62	60		(d) [(e)] Not later than January 15 [December 1] of each
63	61		odd-numbered [even-numbered] year, the state energy conservation
64	62		office shall submit a report to the governor and the Legislative
65	63		Budget Board on the status and effectiveness of the utility
66	64		management and conservation efforts of state agencies and
67	65		institutions of higher education. The report must include
68	66		information submitted to the office from each state agency and
69	67		institution of higher education. The office shall post the report
70	68		on the office's Internet website.
71	69		SECTION 2. This Act takes effect September 1, 2017.
