75 relating to the governance of certain housing authorities.
86 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
97 SECTION 1. Section 392.031(b), Local Government Code, is
108 amended to read as follows:
119 (b) A commissioner may not be an officer or employee of the
1210 municipality. A commissioner may be:
1311 (1) a tenant of a public project over which the housing
1412 authority has jurisdiction; or
1513 (2) a [person who is a] recipient of housing
1614 assistance administered through the authority's housing choice
1715 voucher program or project-based rental assistance program.
1816 SECTION 2. Section 392.0331, Local Government Code, is
1917 amended by amending Subsections (b), (b-2), (g), and (h-1) and
2018 adding Subsection (b-3) to read as follows:
2119 (b) Except as provided by Subsections [Subsection] (b-1)
2220 and (b-2), in appointing commissioners under Section 392.031, a
2321 municipality with a municipal housing authority composed of five
2422 commissioners shall appoint at least one commissioner to the
2523 authority who is a tenant of a public housing project over which the
2624 authority has jurisdiction. Except as provided by Subsection
2725 (b-3) [(b-2)], in appointing commissioners under Section 392.031, a
2826 municipality with a municipal housing authority composed of seven
2927 or more commissioners shall appoint at least two commissioners to
3028 the authority who are tenants of a public housing project over which
3129 the authority has jurisdiction.
3230 (b-2) This subsection applies only to a municipality that
3331 has a population over 600,000 and is located adjacent to the
3432 international border of this state. In appointing commissioners
3533 under Section 392.031, a municipality described by this subsection
3634 that has a municipal housing authority composed of five
3735 commissioners shall appoint at least one commissioner to the
3836 authority who is:
3937 (1) a tenant of a public housing project over which the
4038 authority has jurisdiction; or
4139 (2) a recipient of housing assistance administered
4240 through the authority's housing choice voucher program or
4341 project-based rental assistance program.
4442 (b-3) In appointing commissioners under Section 392.031, a
4543 municipality that has a population over two million and a municipal
4644 housing authority composed of seven or more commissioners shall
4745 appoint at least two commissioners to the authority who are:
4846 (1) tenants of a public housing project over which the
4947 authority has jurisdiction; or
5048 (2) recipients of housing assistance administered
5149 through the authority's housing choice voucher program.
5250 (g) A commissioner appointed under this section may not
5351 participate:
5452 (1) in any vote or discussion concerning the
5553 termination of:
5654 (A) the commissioner's occupancy rights in
5755 public housing;
5856 (B) the commissioner's rights to housing
5957 assistance administered through a housing choice voucher program or
6058 a project-based rental assistance program; or
6159 (C) the rights of any person related in the first
6260 degree by consanguinity to the commissioner with respect to the
6361 person's occupancy rights in public housing or right to receive
6462 housing assistance administered through a housing choice voucher
6563 program or a project-based rental assistance program; or
6664 (2) in a grievance or administrative hearing in which
6765 the commissioner or a person related in the first degree by
6866 consanguinity to the commissioner is a party.
6967 (h-1) If a commissioner appointed under this section as a
7068 recipient of housing assistance administered through the
7169 authority's housing choice voucher program or project-based rental
7270 assistance program ceases to receive that assistance, a majority of
7371 the other commissioners shall decide whether to request that a new
7472 commissioner be appointed. A majority of the commissioners may
7573 decide to allow the commissioner to serve the remaining portion of
7674 the commissioner's term.
7775 SECTION 3. This Act takes effect September 1, 2017.
