13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Subchapter D, Chapter 708, Transportation Code, |
---|
15 | 15 | | is amended by adding Section 708.160 to read as follows: |

16 | 16 | | Sec. 708.160. DEFERRAL AND REDUCTION OR WAIVER OF CERTAIN |
---|
17 | 17 | | SURCHARGES. A court may defer surcharges assessed under this |
---|
18 | 18 | | chapter against a person who is participating in a drug court |
---|
19 | 19 | | program under Chapter 123, Government Code, for the underlying |
---|
20 | 20 | | offense giving rise to the surcharge. If a person successfully |
---|
21 | 21 | | completes the drug court program, the court may reduce or waive the |
---|
22 | 22 | | surcharges assessed against the person. |
---|
23 | 23 | | SECTION 2. The change in law made by this Act applies to a |
---|
24 | 24 | | surcharge pending on the effective date of this Act, regardless of |
---|
25 | 25 | | when the surcharge was assessed. |
---|
26 | 26 | | SECTION 3. This Act takes effect September 1, 2017. |
