| 8 | 8 | | instructional materials by public school districts and |
|---|
| 9 | 9 | | open-enrollment charter schools. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 31, Education Code, is |
|---|
| 12 | 12 | | amended by adding Sections 31.1011 and 31.1012 to read as follows: |
|---|
| 13 | 13 | | Sec. 31.1011. LOCAL REVIEW AND SELECTION. (a) Each board |
|---|
| 14 | 14 | | of trustees of a school district and governing body of an |
|---|
| 15 | 15 | | open-enrollment charter school shall adopt procedures for |
|---|
| 16 | 16 | | selecting instructional materials. |
|---|
| 17 | 17 | | (b) The procedures adopted under Subsection (a) must |
|---|
| 18 | 18 | | include procedures for: |
|---|
| 19 | 19 | | (1) providing public notice of any instructional |
|---|
| 20 | 20 | | material scheduled for review and selection; |
|---|
| 21 | 21 | | (2) providing public access, including electronic |
|---|
| 22 | 22 | | access if available, to the instructional material scheduled for |
|---|
| 23 | 23 | | review and selection; and |
|---|
| 24 | 24 | | (3) conducting a public meeting and allowing public |
|---|
| 25 | 25 | | comment regarding any instructional material scheduled for review |
|---|
| 26 | 26 | | and selection. |
|---|
| 27 | 27 | | (c) For purposes of Subsection (b)(2), the procedures |
|---|
| 28 | 28 | | adopted must grant public access to the instructional material for |
|---|
| 29 | 29 | | at least 30 days before the date the district or school officially |
|---|
| 30 | 30 | | selects the instructional material. |
|---|
| 31 | 31 | | Sec. 31.1012. ADDITIONAL LOCAL PUBLIC MEETING FOR |
|---|
| 32 | 32 | | INSTRUCTIONAL MATERIAL THAT INCLUDES COMMON CORE STATE STANDARDS |
|---|
| 33 | 33 | | MATERIAL. (a) In this section: |
|---|
| 34 | 34 | | (1) "Common core state standards" has the meaning |
|---|
| 35 | 35 | | assigned by Section 28.002(b-1). |
|---|
| 36 | 36 | | (2) "Parent" includes a person standing in parental |
|---|
| 37 | 37 | | relation. |
|---|
| 38 | 38 | | (b) If any instructional material selected by a school |
|---|
| 39 | 39 | | district or open-enrollment charter school includes common core |
|---|
| 40 | 40 | | state standards material, a parent of a student enrolled in the |
|---|
| 41 | 41 | | district or school may request that the district or school conduct a |
|---|
| 42 | 42 | | public meeting specifically addressing the selection of that |
|---|
| 43 | 43 | | instructional material in addition to the public meeting required |
|---|
| 44 | 44 | | under Section 31.1011. |
|---|
| 45 | 45 | | (c) The board of trustees of a school district or the |
|---|
| 46 | 46 | | governing body of an open-enrollment charter school shall schedule |
|---|
| 47 | 47 | | the additional public meeting under this section not later than the |
|---|
| 48 | 48 | | 10th day after the date a parent requests the meeting under |
|---|
| 49 | 49 | | Subsection (b). The district or school shall: |
|---|
| 50 | 50 | | (1) provide public notice of the meeting; |
|---|
| 51 | 51 | | (2) provide public access, including electronic |
|---|
| 52 | 52 | | access if available, to the instructional material that includes |
|---|
| 53 | 53 | | the common core state standards material; and |
|---|
| 54 | 54 | | (3) allow public comment regarding the instructional |
|---|
| 55 | 55 | | material that includes the common core state standards material. |
|---|
| 56 | 56 | | (d) After a school district or open-enrollment charter |
|---|
| 57 | 57 | | school has conducted the additional public meeting required under |
|---|
| 58 | 58 | | this section, a parent of a student enrolled in the district or |
|---|
| 59 | 59 | | school may request that the district or school remove the |
|---|
| 60 | 60 | | instructional material that includes the common core state |
|---|
| 61 | 61 | | standards material from the selected list of the district or |
|---|
| 62 | 62 | | school. |
|---|
| 63 | 63 | | (e) A school district or open-enrollment charter school |
|---|
| 64 | 64 | | shall remove any instructional material that includes common core |
|---|
| 65 | 65 | | state standards material from the selected list of the district or |
|---|
| 66 | 66 | | school on the request of a parent under Subsection (d). |
|---|
| 67 | 67 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 68 | 68 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 69 | 69 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 70 | 70 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 71 | 71 | | Act takes effect September 1, 2017. |
