55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to procedures for the review and selection of certain
88 instructional materials by public school districts and
99 open-enrollment charter schools.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 31, Education Code, is
1212 amended by adding Sections 31.1011 and 31.1012 to read as follows:
1313 Sec. 31.1011. LOCAL REVIEW AND SELECTION. (a) Each board
1414 of trustees of a school district and governing body of an
1515 open-enrollment charter school shall adopt procedures for
1616 selecting instructional materials.
1717 (b) The procedures adopted under Subsection (a) must
1818 include procedures for:
1919 (1) providing public notice of any instructional
2020 material scheduled for review and selection;
2121 (2) providing public access, including electronic
2222 access if available, to the instructional material scheduled for
2323 review and selection; and
2424 (3) conducting a public meeting and allowing public
2525 comment regarding any instructional material scheduled for review
2626 and selection.
2727 (c) For purposes of Subsection (b)(2), the procedures
2828 adopted must grant public access to the instructional material for
2929 at least 30 days before the date the district or school officially
3030 selects the instructional material.
3131 Sec. 31.1012. ADDITIONAL LOCAL PUBLIC MEETING FOR
3232 INSTRUCTIONAL MATERIAL THAT INCLUDES COMMON CORE STATE STANDARDS
3333 MATERIAL. (a) In this section:
3434 (1) "Common core state standards" has the meaning
3535 assigned by Section 28.002(b-1).
3636 (2) "Parent" includes a person standing in parental
3737 relation.
3838 (b) If any instructional material selected by a school
3939 district or open-enrollment charter school includes common core
4040 state standards material, a parent of a student enrolled in the
4141 district or school may request that the district or school conduct a
4242 public meeting specifically addressing the selection of that
4343 instructional material in addition to the public meeting required
4444 under Section 31.1011.
4545 (c) The board of trustees of a school district or the
4646 governing body of an open-enrollment charter school shall schedule
4747 the additional public meeting under this section not later than the
4848 10th day after the date a parent requests the meeting under
4949 Subsection (b). The district or school shall:
5050 (1) provide public notice of the meeting;
5151 (2) provide public access, including electronic
5252 access if available, to the instructional material that includes
5353 the common core state standards material; and
5454 (3) allow public comment regarding the instructional
5555 material that includes the common core state standards material.
5656 (d) After a school district or open-enrollment charter
5757 school has conducted the additional public meeting required under
5858 this section, a parent of a student enrolled in the district or
5959 school may request that the district or school remove the
6060 instructional material that includes the common core state
6161 standards material from the selected list of the district or
6262 school.
6363 (e) A school district or open-enrollment charter school
6464 shall remove any instructional material that includes common core
6565 state standards material from the selected list of the district or
6666 school on the request of a parent under Subsection (d).
6767 SECTION 2. This Act takes effect immediately if it receives
6868 a vote of two-thirds of all the members elected to each house, as
6969 provided by Section 39, Article III, Texas Constitution. If this
7070 Act does not receive the vote necessary for immediate effect, this
7171 Act takes effect September 1, 2017.
