55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of a school district of innovation to
88 administer alternative assessment instruments to district
99 students.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 12A.003, Education Code, is amended by
1212 amending Subsection (b) and adding Subsection (c) to read as
1313 follows:
1414 (b) A local innovation plan must:
1515 (1) provide for a comprehensive educational program
1616 for the district, which program may include:
1717 (A) innovative curriculum, instructional
1818 methods, and provisions regarding community participation, campus
1919 governance, and parental involvement;
2020 (B) modifications to the school day or year;
2121 (C) provisions regarding the district budget and
2222 sustainable program funding;
2323 (D) administration of national norm-referenced
2424 assessment instruments instead of state assessment instruments
2525 adopted under Section 39.023;
2626 (E) accountability and assessment measures that
2727 exceed the requirements of state and federal law; and
2828 (F) [(E)] any other innovations prescribed by
2929 the board of trustees; and
3030 (2) identify requirements imposed by this code that
3131 inhibit the goals of the plan and from which the district should be
3232 exempted on adoption of the plan, subject to Section 12A.004.
3333 (c) If a local innovation plan includes the administration
3434 of national assessment instruments as provided by Subsection
3535 (b)(1)(D), the commissioner shall adopt rules necessary to:
3636 (1) ensure that information regarding student
3737 performance on the national assessment instruments is provided to
3838 the agency; and
3939 (2) provide procedures for the commissioner to assign
4040 performance ratings to the district under Section 39.054 based on
4141 student performance on the national assessment instruments.
4242 SECTION 2. Section 12A.004(a), Education Code, is amended
4343 to read as follows:
4444 (a) A local innovation plan may not provide for the
4545 exemption of a district designated as a district of innovation from
4646 the following provisions of this title:
4747 (1) a state or federal requirement applicable to an
4848 open-enrollment charter school operating under Subchapter D,
4949 Chapter 12;
5050 (2) Subchapters A, C, D, and E, Chapter 11, except that
5151 a district may be exempt from Sections 11.1511(b)(5) and (14) and
5252 Section 11.162;
5353 (3) state curriculum and graduation requirements
5454 adopted under Chapter 28; and
5555 (4) academic and financial accountability and
5656 sanctions under Chapter 39, except as provided by Sections
5757 12A.003(b)(1)(D) and (c).
5858 SECTION 3. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2017.
