| 7 | 7 | | relating to the authority of a school district of innovation to |
|---|
| 8 | 8 | | administer alternative assessment instruments to district |
|---|
| 9 | 9 | | students. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 12A.003, Education Code, is amended by |
|---|
| 12 | 12 | | amending Subsection (b) and adding Subsection (c) to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | (b) A local innovation plan must: |
|---|
| 15 | 15 | | (1) provide for a comprehensive educational program |
|---|
| 16 | 16 | | for the district, which program may include: |
|---|
| 17 | 17 | | (A) innovative curriculum, instructional |
|---|
| 18 | 18 | | methods, and provisions regarding community participation, campus |
|---|
| 19 | 19 | | governance, and parental involvement; |
|---|
| 20 | 20 | | (B) modifications to the school day or year; |
|---|
| 21 | 21 | | (C) provisions regarding the district budget and |
|---|
| 22 | 22 | | sustainable program funding; |
|---|
| 23 | 23 | | (D) administration of national norm-referenced |
|---|
| 24 | 24 | | assessment instruments instead of state assessment instruments |
|---|
| 25 | 25 | | adopted under Section 39.023; |
|---|
| 26 | 26 | | (E) accountability and assessment measures that |
|---|
| 27 | 27 | | exceed the requirements of state and federal law; and |
|---|
| 28 | 28 | | (F) [(E)] any other innovations prescribed by |
|---|
| 29 | 29 | | the board of trustees; and |
|---|
| 30 | 30 | | (2) identify requirements imposed by this code that |
|---|
| 31 | 31 | | inhibit the goals of the plan and from which the district should be |
|---|
| 32 | 32 | | exempted on adoption of the plan, subject to Section 12A.004. |
|---|
| 33 | 33 | | (c) If a local innovation plan includes the administration |
|---|
| 34 | 34 | | of national assessment instruments as provided by Subsection |
|---|
| 35 | 35 | | (b)(1)(D), the commissioner shall adopt rules necessary to: |
|---|
| 36 | 36 | | (1) ensure that information regarding student |
|---|
| 37 | 37 | | performance on the national assessment instruments is provided to |
|---|
| 38 | 38 | | the agency; and |
|---|
| 39 | 39 | | (2) provide procedures for the commissioner to assign |
|---|
| 40 | 40 | | performance ratings to the district under Section 39.054 based on |
|---|
| 41 | 41 | | student performance on the national assessment instruments. |
|---|
| 42 | 42 | | SECTION 2. Section 12A.004(a), Education Code, is amended |
|---|
| 43 | 43 | | to read as follows: |
|---|
| 44 | 44 | | (a) A local innovation plan may not provide for the |
|---|
| 45 | 45 | | exemption of a district designated as a district of innovation from |
|---|
| 46 | 46 | | the following provisions of this title: |
|---|
| 47 | 47 | | (1) a state or federal requirement applicable to an |
|---|
| 48 | 48 | | open-enrollment charter school operating under Subchapter D, |
|---|
| 49 | 49 | | Chapter 12; |
|---|
| 50 | 50 | | (2) Subchapters A, C, D, and E, Chapter 11, except that |
|---|
| 51 | 51 | | a district may be exempt from Sections 11.1511(b)(5) and (14) and |
|---|
| 52 | 52 | | Section 11.162; |
|---|
| 53 | 53 | | (3) state curriculum and graduation requirements |
|---|
| 54 | 54 | | adopted under Chapter 28; and |
|---|
| 55 | 55 | | (4) academic and financial accountability and |
|---|
| 56 | 56 | | sanctions under Chapter 39, except as provided by Sections |
|---|
| 57 | 57 | | 12A.003(b)(1)(D) and (c). |
|---|
| 58 | 58 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 59 | 59 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 60 | 60 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 61 | 61 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 62 | 62 | | Act takes effect September 1, 2017. |
