66 AN ACT
77 relating to public school class size limits in certain grades.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 25.112(a), Education Code, is amended to
1010 read as follows:
1111 (a) Except as otherwise authorized by this section, a school
1212 district may not enroll more than 22 students in a kindergarten,
1313 first, or second[, third, or fourth] grade class. That limitation
1414 does not apply during:
1515 (1) any 12-week period of the school year selected by
1616 the district, in the case of a district whose average daily
1717 attendance is adjusted under Section 42.005(c); or
1818 (2) the last 12 weeks of any school year in the case of
1919 any other district.
2020 SECTION 2. This Act applies beginning with the 2017-2018
2121 school year.
2222 SECTION 3. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2017.
