| 8 | 8 | | legislative agency or an advisory committee. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 301, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 301.035 to read as follows: |
|---|
| 12 | 12 | | Sec. 301.035. APPOINTMENTS TO LEGISLATIVE AGENCY. |
|---|
| 13 | 13 | | Notwithstanding any other law, a person appointed by the lieutenant |
|---|
| 14 | 14 | | governor or the speaker of the house to the governing body of a |
|---|
| 15 | 15 | | legislative agency or committee under Subtitle C serves at the |
|---|
| 16 | 16 | | pleasure of the appointing officer and may be removed or replaced by |
|---|
| 17 | 17 | | the appointing officer or the appointing officer's successor. |
|---|
| 18 | 18 | | SECTION 2. Chapter 651, Government Code, is amended by |
|---|
| 19 | 19 | | adding Section 651.011 to read as follows: |
|---|
| 20 | 20 | | Sec. 651.011. APPOINTMENTS BY CERTAIN STATE OFFICERS. |
|---|
| 21 | 21 | | (a) This section applies only to a committee, council, commission, |
|---|
| 22 | 22 | | task force, or other public entity with multiple members that: |
|---|
| 23 | 23 | | (1) does not control or supervise public business or |
|---|
| 24 | 24 | | policy; and |
|---|
| 25 | 25 | | (2) has as its primary function advising a branch of |
|---|
| 26 | 26 | | state government. |
|---|
| 27 | 27 | | (b) Notwithstanding any other law, a person appointed by the |
|---|
| 28 | 28 | | governor, the lieutenant governor, the speaker of the house, or a |
|---|
| 29 | 29 | | statewide elected officer to an entity described by Subsection (a) |
|---|
| 30 | 30 | | serves at the pleasure of the appointing officer and may be removed |
|---|
| 31 | 31 | | or replaced by the appointing officer or the appointing officer's |
|---|
| 32 | 32 | | successor. |
|---|
| 33 | 33 | | SECTION 3. The change in law made by this Act applies to a |
|---|
| 34 | 34 | | person serving on an entity described by Section 301.035 or |
|---|
| 35 | 35 | | 651.011(a), Government Code, as added by this Act, on or after the |
|---|
| 36 | 36 | | effective date of this Act, regardless of whether the person was |
|---|
| 37 | 37 | | appointed to the entity before, on, or after the effective date of |
|---|
| 38 | 38 | | this Act. |
|---|
| 39 | 39 | | SECTION 4. This Act takes effect September 1, 2017. |
