66 AN ACT
77 relating to appointments by certain state officials to a
88 legislative agency or an advisory committee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 301, Government Code, is
1111 amended by adding Section 301.035 to read as follows:
1212 Sec. 301.035. APPOINTMENTS TO LEGISLATIVE AGENCY.
1313 Notwithstanding any other law, a person appointed by the lieutenant
1414 governor or the speaker of the house to the governing body of a
1515 legislative agency or committee under Subtitle C serves at the
1616 pleasure of the appointing officer and may be removed or replaced by
1717 the appointing officer or the appointing officer's successor.
1818 SECTION 2. Chapter 651, Government Code, is amended by
1919 adding Section 651.011 to read as follows:
2020 Sec. 651.011. APPOINTMENTS BY CERTAIN STATE OFFICERS.
2121 (a) This section applies only to a committee, council, commission,
2222 task force, or other public entity with multiple members that:
2323 (1) does not control or supervise public business or
2424 policy; and
2525 (2) has as its primary function advising a branch of
2626 state government.
2727 (b) Notwithstanding any other law, a person appointed by the
2828 governor, the lieutenant governor, the speaker of the house, or a
2929 statewide elected officer to an entity described by Subsection (a)
3030 serves at the pleasure of the appointing officer and may be removed
3131 or replaced by the appointing officer or the appointing officer's
3232 successor.
3333 SECTION 3. The change in law made by this Act applies to a
3434 person serving on an entity described by Section 301.035 or
3535 651.011(a), Government Code, as added by this Act, on or after the
3636 effective date of this Act, regardless of whether the person was
3737 appointed to the entity before, on, or after the effective date of
3838 this Act.
3939 SECTION 4. This Act takes effect September 1, 2017.
