66 AN ACT
77 relating to requirements regarding assessment instruments required
88 for public high school graduation and the use of individual
99 graduation committees to satisfy certain public high school
1010 graduation requirements.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 12.104(b-2), Education Code, is amended
1313 to read as follows:
1414 (b-2) An open-enrollment charter school is subject to the
1515 requirement to establish an individual graduation committee under
1616 Section 28.0258. [This subsection expires September 1, 2017.]
1717 SECTION 2. Section 18.006(b), Education Code, is amended to
1818 read as follows:
1919 (b) In addition to other factors determined to be
2020 appropriate by the commissioner, the accountability system must
2121 include consideration of:
2222 (1) student performance on the [end-of-course]
2323 assessment instruments required by Section 39.023(c); and
2424 (2) dropout rates, including dropout rates and diploma
2525 program completion rates for the grade levels served by the diploma
2626 program.
2727 SECTION 3. Section 25.005(b), Education Code, is amended to
2828 read as follows:
2929 (b) A reciprocity agreement must:
3030 (1) address procedures for:
3131 (A) transferring student records;
3232 (B) awarding credit for completed course work;
3333 and
3434 (C) permitting a student to satisfy the
3535 requirements of Section 39.025 through successful performance on
3636 comparable [end-of-course or other exit-level] assessment
3737 instruments administered in another state; and
3838 (2) include appropriate criteria developed by the
3939 agency.
4040 SECTION 4. Section 28.014(a), Education Code, is amended to
4141 read as follows:
4242 (a) Each school district shall partner with at least one
4343 institution of higher education to develop and provide courses in
4444 college preparatory mathematics and English language arts. The
4545 courses must be designed:
4646 (1) for students at the 12th grade level whose
4747 performance on:
4848 (A) an [end-of-course] assessment instrument
4949 required under Section 39.023(c) does not meet college readiness
5050 standards; or
5151 (B) coursework or[,] a college entrance
5252 examination[, or an assessment instrument designated under Section
5353 51.3062(c)] indicates that the student is not ready to perform
5454 entry-level college coursework; and
5555 (2) to prepare students for success in entry-level
5656 college courses.
5757 SECTION 5. Section 28.0211(o), Education Code, is amended
5858 to read as follows:
5959 (o) This section does not require the administration of
6060 a fifth [or eighth] grade assessment instrument in a subject under
6161 Section 39.023(a) to a student enrolled in the fifth [or eighth]
6262 grade[, as applicable,] if the student[:
6363 [(1)] is enrolled in a course in the subject intended
6464 for students above the student's grade level and will be
6565 administered an assessment instrument adopted or developed under
6666 Section 39.023(a) that aligns with the curriculum for the course in
6767 which the student is enrolled[; or
6868 [(2) is enrolled in a course in the subject for which
6969 the student will receive high school academic credit and will be
7070 administered an end-of-course assessment instrument adopted under
7171 Section 39.023(c) for the course].
7272 SECTION 6. Section 28.023(c), Education Code, is amended to
7373 read as follows:
7474 (c) A school district shall give a student in grade level
7575 six or above credit for a subject on the basis of an examination for
7676 credit in the subject approved by the board of trustees under
7777 Subsection (a) if the student scores in the 80th percentile or above
7878 on the examination or if the student achieves a score as provided by
7979 Subsection (c-1). If a student is given credit in a subject on the
8080 basis of an examination, the district shall enter the examination
8181 score on the student's transcript and the student is not required to
8282 take an [end-of-course] assessment instrument adopted under
8383 Section 39.023(c) for that subject.
8484 SECTION 7. Sections 28.025(b-4) and (c-6), Education Code,
8585 are amended to read as follows:
8686 (b-4) A school district may offer the curriculum described
8787 in Subsections (b-1)(1) through (4) in an applied manner. Courses
8888 delivered in an applied manner must cover the essential knowledge
8989 and skills, and the student shall be administered the applicable
9090 [end-of-course] assessment instrument as provided by Sections
9191 39.023(c) and 39.025.
9292 (c-6) Notwithstanding Subsection (c), a person may receive
9393 a diploma if the person is eligible for a diploma under Section
9494 28.0258. [This subsection expires September 1, 2017.]
9595 SECTION 8. Section 28.0255, Education Code, is amended by
9696 amending Subsections (g) and (h) and adding Subsection (g-1) to
9797 read as follows:
9898 (g) A student entering the ninth grade during the 2017-2018
9999 school year is entitled to a high school diploma if the student:
100100 (1) successfully complies with the curriculum
101101 requirements specified under Subsection (e); and
102102 (2) performs satisfactorily, as determined by the
103103 commissioner under Subsection (h), on:
104104 (A) end-of-course assessment instruments listed
105105 under Section 39.023(c) for courses in which the student was
106106 enrolled; and
107107 (B) the mathematics and reading portions of the
108108 Texas Success Initiative (TSI) diagnostic assessment required to be
109109 administered under Section 39.023(c).
110110 (g-1) A student other than a student described by Subsection
111111 (g) is entitled to a high school diploma if the student:
112112 (1) successfully complies with the curriculum
113113 requirements specified under Subsection (e); and
114114 (2) performs satisfactorily, as determined by the
115115 commissioner under Subsection (h), on assessment instruments
116116 listed under Section 39.023(c), as that section existed before
117117 amendment by _.B. ___, Acts of the 85th Legislature, Regular
118118 Session, 2017, for courses in which the student was enrolled.
119119 (h) For purposes of Subsections [Subsection] (g)(2) and
120120 (g-1)(2), the commissioner shall determine the level of
121121 satisfactory performance on applicable [end-of-course] assessment
122122 instruments administered to a student.
123123 SECTION 9. Section 28.0258, Education Code, is amended by
124124 amending Subsections (a), (b), (e), (f), (h), (j), and (k) and
125125 adding Subsection (m) to read as follows:
126126 (a) This section applies only to an 11th or 12th grade
127127 student who has failed to comply with the [end-of-course]
128128 assessment instrument performance requirements under Section
129129 39.025 for not more than two subjects identified under Section
130130 39.023(c) [courses]. For purposes of this section, English I
131131 writing, English II writing, and reading are considered separate
132132 subjects.
133133 (b) For each student to whom this section applies, the
134134 school district that the student attends shall establish an
135135 individual graduation committee at the end of or after the
136136 student's 11th grade year to determine whether the student may
137137 qualify to graduate as provided by this section. A student may not
138138 qualify to graduate under this section before the student's 12th
139139 grade year. The committee shall be composed of:
140140 (1) the principal or principal's designee;
141141 (2) for each subject identified under Section
142142 39.023(c) for [end-of-course assessment instrument on] which the
143143 student failed to perform satisfactorily on the appropriate
144144 corresponding required assessment instrument, the teacher of the
145145 course, if appropriate, or a teacher of the student in that subject,
146146 designated by the principal;
147147 (3) the department chair or lead teacher supervising
148148 the teacher described by Subdivision (2); and
149149 (4) as applicable:
150150 (A) the student's parent or person standing in
151151 parental relation to the student;
152152 (B) a designated advocate described by
153153 Subsection (c) if the person described by Paragraph (A) is unable to
154154 serve; or
155155 (C) the student, at the student's option, if the
156156 student is at least 18 years of age or is an emancipated minor.
157157 (e) To be eligible to graduate and receive a high school
158158 diploma under this section, a student must successfully complete
159159 the curriculum requirements required for high school graduation:
160160 (1) identified by the State Board of Education under
161161 Section 28.025(a); or
162162 (2) as otherwise provided by the transition plan
163163 adopted by the commissioner to implement and administer the
164164 amendments made by Chapter 211 (H.B. 5), Acts of the 83rd
165165 Legislature, Regular Session, 2013, replacing the minimum,
166166 recommended, and advanced high school programs with the foundation
167167 high school program [under Section 28.025(h)].
168168 (f) Notwithstanding any other law, a student's individual
169169 graduation committee established under this section shall
170170 recommend additional requirements by which the student may qualify
171171 to graduate, including:
172172 (1) additional remediation; and
173173 (2) for each [end-of-course] assessment instrument
174174 required under Section 39.023(c) on which the student failed to
175175 perform satisfactorily:
176176 (A) the completion of a project related to the
177177 subject [area of the course] that demonstrates proficiency in the
178178 subject [area]; or
179179 (B) the preparation of a portfolio of work
180180 samples in the subject [area of the course], including work samples
181181 [from the course] that demonstrate proficiency in the subject
182182 [area].
183183 (h) In determining whether a student for whom an individual
184184 graduation committee is established is qualified to graduate, the
185185 committee shall consider:
186186 (1) the recommendation of the student's teacher in
187187 each course of the subject for which the student failed to perform
188188 satisfactorily on an [end-of-course] assessment instrument;
189189 (2) the student's grade in each course of the subject
190190 for which the student failed to perform satisfactorily on an
191191 [end-of-course] assessment instrument;
192192 (3) the student's score on each [end-of-course]
193193 assessment instrument required under Section 39.023(c) on which the
194194 student failed to perform satisfactorily;
195195 (4) the student's performance on any additional
196196 requirements recommended by the committee under Subsection (f);
197197 (5) the number of hours of remediation that the
198198 student has attended, including[:
199199 [(A) attendance in a college preparatory course
200200 required under Section 39.025(b-2), if applicable; or
201201 [(B)] attendance in and successful completion of
202202 a transitional college course in reading or mathematics;
203203 (6) the student's school attendance rate;
204204 (7) the student's satisfaction of any of the Texas
205205 Success Initiative (TSI) college readiness benchmarks prescribed
206206 by the Texas Higher Education Coordinating Board;
207207 (8) the student's successful completion of a dual
208208 credit course in English, mathematics, science, or social studies;
209209 (9) the student's successful completion of a high
210210 school pre-advanced placement, advanced placement, or
211211 international baccalaureate program course in English,
212212 mathematics, science, or social studies;
213213 (10) the student's rating of advanced high on the most
214214 recent high school administration of the Texas English Language
215215 Proficiency Assessment System;
216216 (11) the student's score of 50 or greater on a
217217 College-Level Examination Program examination;
218218 (12) the student's score on the ACT, the SAT, or the
219219 Armed Services Vocational Aptitude Battery test;
220220 (13) the student's completion of a sequence of courses
221221 under a career and technical education program required to attain
222222 an industry-recognized credential or certificate;
223223 (14) the student's overall preparedness for
224224 postsecondary success; and
225225 (15) any other academic information designated for
226226 consideration by the board of trustees of the school district.
227227 (j) Notwithstanding any action taken by an individual
228228 graduation committee under this section, a school district shall
229229 administer an [end-of-course] assessment instrument required under
230230 Section 39.023(c) to any student who fails to perform
231231 satisfactorily on an [end-of-course] assessment instrument
232232 required under Section 39.023(c) as provided by Section 39.025(b).
233233 For purposes of Section 39.053(c)(1), an assessment instrument
234234 administered as provided by this subsection is considered an
235235 assessment instrument required for graduation retaken by a student.
236236 (k) The commissioner shall adopt rules as necessary to
237237 administer [implement] this section [not later than the 2015-2016
238238 school year].
239239 (m) With respect to students that are administered
240240 end-of-course assessment instruments required by Section
241241 39.023(c), as that section existed before amendment by _.B. ___,
242242 Acts of the 85th Legislature, Regular Session, 2017, as provided by
243243 Sections 39.025(f) and (f-1), English I and English II are
244244 considered separate subjects for purposes of Subsection (a). This
245245 subsection expires September 1, 2023.
246246 SECTION 10. Sections 29.081(b) and (b-1), Education Code,
247247 are amended to read as follows:
248248 (b) Each district shall provide accelerated instruction to
249249 a student enrolled in the district who has taken an [end-of-course]
250250 assessment instrument required [administered] under Section
251251 39.023(c) and has not performed satisfactorily on the assessment
252252 instrument or who is at risk of dropping out of school.
253253 (b-1) Each school district shall offer before the next
254254 scheduled administration of the assessment instrument, without
255255 cost to the student, additional accelerated instruction to each
256256 student in any subject in which the student failed to perform
257257 satisfactorily on an [end-of-course] assessment instrument
258258 required for graduation.
259259 SECTION 11. Section 29.087(f), Education Code, is amended
260260 to read as follows:
261261 (f) A student participating in a program authorized by this
262262 section, other than a student ordered to participate under
263263 Subsection (d)(1), must have taken the appropriate [end-of-course]
264264 assessment instruments specified by Section 39.023(c) before
265265 entering the program and must take each appropriate [end-of-course]
266266 assessment instrument administered during the period in which the
267267 student is enrolled in the program. Except for a student ordered
268268 to participate under Subsection (d)(1), a student participating in
269269 the program may not take the high school equivalency examination
270270 unless the student has taken the assessment instruments required by
271271 this subsection.
272272 SECTION 12. Section 29.402(b), Education Code, is amended
273273 to read as follows:
274274 (b) A person who is under 26 years of age is eligible to
275275 enroll in a dropout recovery program under this subchapter if the
276276 person:
277277 (1) must complete not more than three course credits
278278 to complete the curriculum requirements for the foundation high
279279 school program for high school graduation; or
280280 (2) has failed to perform satisfactorily on:
281281 (A) an [end-of-course] assessment instrument
282282 administered under Section 39.023(c);
283283 (B) an assessment instrument administered under
284284 Section 39.023(c) as that section existed before amendment by _.B.
285285 ___, Acts of the 85th Legislature, Regular Session, 2017; or
286286 (C) an assessment instrument administered under
287287 Section 39.023(c) as that section existed before amendment by
288288 Chapter 1312 (S.B. 1031), Acts of the 80th Legislature, Regular
289289 Session, 2007.
290290 SECTION 13. Sections 39.023(a-2), (c-1), (c-3), and (e),
291291 Education Code, as effective September 1, 2017, are amended to read
292292 as follows:
293293 (a-2) Except as required by federal law, a student is not
294294 required to be assessed in a subject otherwise assessed at the
295295 student's grade level under Subsection (a) if the student[:
296296 [(1)] is enrolled in a course in the subject intended
297297 for students above the student's grade level and will be
298298 administered an assessment instrument adopted or developed under
299299 Subsection (a) that aligns with the curriculum for the course in
300300 which the student is enrolled[; or
301301 [(2) is enrolled in a course in the subject for which
302302 the student will receive high school academic credit and will be
303303 administered an end-of-course assessment instrument adopted under
304304 Subsection (c) for the course].
305305 (c-1) For an [The agency shall develop any] assessment
306306 instrument required under this section that is developed by the
307307 agency, the agency shall develop the assessment instrument in a
308308 manner that allows for the measurement of annual improvement in
309309 student achievement as required by Sections 39.034(c) and (d).
310310 (c-3) In adopting a schedule for the administration of
311311 assessment instruments under this section, the State Board of
312312 Education shall require:
313313 (1) assessment instruments administered under
314314 Subsection (a) to be administered on a schedule so that the first
315315 assessment instrument is administered at least two weeks later than
316316 the date on which the first assessment instrument was administered
317317 under Subsection (a) during the 2006-2007 school year; and
318318 (2) the spring administration of end-of-course
319319 assessment instruments listed under Subsection (c) to occur in each
320320 school district not earlier than the first full week in May, except
321321 that the spring administration of the end-of-course assessment
322322 instruments in English I writing and English II writing must be
323323 permitted to occur at an earlier date.
324324 (e) Under rules adopted by the State Board of Education,
325325 every third year, the agency shall release the questions and answer
326326 keys to each assessment instrument administered under Subsection
327327 (a), (b), [(c),] (d), or (l), excluding any assessment instrument
328328 administered to a student for the purpose of retaking the
329329 assessment instrument, after the last time the instrument is
330330 administered for that school year. To ensure a valid bank of
331331 questions for use each year, the agency is not required to release a
332332 question that is being field-tested and was not used to compute the
333333 student's score on the instrument. The agency shall also release,
334334 under board rule, each question that is no longer being
335335 field-tested and that was not used to compute a student's score.
336336 This subsection applies in the same manner to each end-of-course
337337 assessment instrument administered under Subsection (c) [During
338338 the 2014-2015 and 2015-2016 school years, the agency shall release
339339 the questions and answer keys to assessment instruments as
340340 described by this subsection each year].
341341 SECTION 14. Sections 39.023(c), (c-2), (c-5), (h), and (i),
342342 Education Code, are amended to read as follows:
343343 (c) The agency shall also adopt end-of-course assessment
344344 instruments for secondary-level courses in [Algebra I,] biology,
345345 English I, English II, and United States history. [The Algebra I
346346 end-of-course assessment instrument must be administered with the
347347 aid of technology.] The English I and English II end-of-course
348348 assessment instruments may only [must each] assess essential
349349 knowledge and skills in [both reading and] writing [in the same
350350 assessment instrument and must provide a single score]. A school
351351 district shall comply with State Board of Education rules regarding
352352 administration of the end-of-course assessment instruments listed
353353 in this subsection. The agency shall also adopt the Texas Success
354354 Initiative (TSI) diagnostic assessment as the assessment
355355 instrument to be administered in mathematics and reading at the
356356 secondary level. The agency shall determine the appropriate grade
357357 level, manner, and schedule for the administration of those
358358 portions of the Texas Success Initiative (TSI) diagnostic
359359 assessment. If a student is in a special education program under
360360 Subchapter A, Chapter 29, the student's admission, review, and
361361 dismissal committee shall determine whether any allowable
362362 modification is necessary in administering to the student an
363363 assessment instrument required under this subsection. The State
364364 Board of Education shall administer the end-of-course assessment
365365 instruments listed in this subsection. The State Board of
366366 Education shall adopt a schedule for the administration of the
367367 end-of-course assessment instruments that complies with the
368368 requirements of Subsection (c-3).
369369 (c-2) The agency may adopt end-of-course assessment
370370 instruments for subjects [courses] not identified [listed] in
371371 Subsection (c). A student's performance on an end-of-course
372372 assessment instrument adopted under this subsection is not subject
373373 to the performance requirements established under Subsection (c) or
374374 Section 39.025.
375375 (c-5) A student's performance on an [end-of-course]
376376 assessment instrument required under Subsection (c) must be
377377 included in the student's academic achievement record.
378378 (h) Subject to any alternative procedures provided by rule
379379 under this subsection, the [The] agency shall notify school
380380 districts and campuses of the results of assessment instruments
381381 administered under this section not later than the 21st day after
382382 the date the assessment instrument is administered. The agency by
383383 rule shall adopt procedures to ensure that school districts and
384384 campuses are notified of the results of the mathematics and reading
385385 portions of the Texas Success Initiative (TSI) assessment
386386 administered in accordance with Section 39.023(c) not later than
387387 the 21st day after the date those portions of the assessment are
388388 administered. The school district shall disclose to each district
389389 teacher the results of assessment instruments administered under
390390 this section to students taught by the teacher in the subject for
391391 the school year in which the assessment instrument is administered.
392392 (i) Except as provided by this subsection, the [The]
393393 provisions of this section[, except Subsection (d),] are subject to
394394 modification by rules adopted under Section 39.022. The provisions
395395 of Subsection (c) requiring the administration of the Texas Success
396396 Initiative (TSI) diagnostic assessment in mathematics and reading
397397 at the secondary level and the provisions of Subsection (d)
398398 regarding voluntary standardized end-of-course assessment
399399 instruments are not subject to modification. Each assessment
400400 instrument adopted under [those] rules adopted under Section 39.022
401401 and each assessment instrument required under Subsection (d) must
402402 be reliable and valid and must meet any applicable federal
403403 requirements for measurement of student progress.
404404 SECTION 15. The heading to Section 39.0232, Education Code,
405405 is amended to read as follows:
406406 Sec. 39.0232. USE OF [END-OF-COURSE] ASSESSMENT INSTRUMENT
407407 AS PLACEMENT INSTRUMENT; CERTAIN USES PROHIBITED.
408408 SECTION 16. Sections 39.0232(a), (b), and (c), Education
409409 Code, are amended to read as follows:
410410 (a) To the extent practicable, the agency shall ensure that
411411 any high school [end-of-course] assessment instrument adopted
412412 under Section 39.023(c) [developed by the agency is developed in
413413 such a manner that the assessment instrument] may be used to
414414 determine the appropriate placement of a student in a course of the
415415 same subject matter at an institution of higher education.
416416 (b) A student's performance on an [end-of-course]
417417 assessment instrument required under Section 39.023(c) may not be
418418 used:
419419 (1) in determining the student's class ranking for any
420420 purpose, including entitlement to automatic college admission
421421 under Section 51.803 or 51.804; or
422422 (2) as a sole criterion in the determination of
423423 whether to admit the student to a general academic teaching
424424 institution in this state.
425425 (c) Subsection (b)(2) does not prohibit a general academic
426426 teaching institution from implementing an admission policy that
427427 takes into consideration a student's performance on an
428428 [end-of-course] assessment instrument required under Section
429429 39.023(c) in addition to other criteria.
430430 SECTION 17. The heading to Section 39.0233, Education Code,
431431 is amended to read as follows:
432432 Sec. 39.0233. SPECIAL-PURPOSE QUESTIONS INCLUDED IN
433433 CERTAIN END-OF-COURSE ASSESSMENT INSTRUMENTS.
434434 SECTION 18. Section 39.0233(b), Education Code, is amended
435435 to read as follows:
436436 (b) The [In addition to the questions adopted under
437437 Subsection (a), the] agency shall adopt a series of questions to be
438438 included in the biology and United States history [an]
439439 end-of-course assessment instruments [instrument] administered
440440 under Section 39.023(c) to be used for purposes of identifying
441441 students who are likely to succeed in an advanced high school
442442 course. A school district shall notify a student who performs at a
443443 high level on the questions adopted under this subsection and the
444444 student's parent or guardian of the student's performance and
445445 potential to succeed in an advanced high school course. A school
446446 district may not require a student to perform at a particular level
447447 on the questions adopted under this subsection in order to be
448448 eligible to enroll in an advanced high school course.
449449 SECTION 19. Section 39.024(i), Education Code, is amended
450450 to read as follows:
451451 (i) The agency shall gather data and conduct research to
452452 substantiate any correlation between a certain level of performance
453453 by students on [end-of-course] assessment instruments required
454454 under Section 39.023(c) and success in:
455455 (1) military service; or
456456 (2) a workforce training, certification, or other
457457 credential program at a postsecondary educational institution that
458458 primarily offers associate degrees or certificates or credentials
459459 other than baccalaureate or advanced degrees.
460460 SECTION 20. Section 39.0241(a-1), Education Code, is
461461 amended to read as follows:
462462 (a-1) Except as provided by this subsection, the [The]
463463 commissioner of education, in collaboration with the commissioner
464464 of higher education, shall determine the level of performance
465465 necessary to indicate college readiness, as defined by Section
466466 39.024(a). The level of performance necessary to indicate college
467467 readiness, as defined by Section 39.024(a), for the mathematics and
468468 reading portion of the Texas Success Initiative (TSI) diagnostic
469469 assessment required to be administered under Section 39.023(c) is
470470 satisfaction of the Texas Success Initiative (TSI) college
471471 readiness benchmarks prescribed by the Texas Higher Education
472472 Coordinating Board under Section 51.3062(f).
473473 SECTION 21. Section 39.025, Education Code, is amended by
474474 amending Subsections (a), (a-1), (a-3), (a-4), (b), (b-1), and (f)
475475 and adding Subsection (f-1) to read as follows:
476476 (a) The commissioner shall adopt rules requiring a student
477477 in the foundation high school program under Section 28.025 to be
478478 administered an end-of-course assessment instrument listed in
479479 Section 39.023(c) only for a course in which the student is enrolled
480480 and for which an end-of-course assessment instrument is
481481 administered. Each student in the foundation high school program
482482 under Section 28.025 shall be administered the Texas Success
483483 Initiative (TSI) diagnostic assessment in mathematics and reading
484484 as provided by agency rule under Section 39.023(c). A student is
485485 required to achieve a scale score that indicates satisfactory
486486 performance, as determined by the commissioner under Section
487487 39.0241(a), on each [end-of-course] assessment instrument
488488 administered to the student. For each scale score required under
489489 this subsection that is not based on a 100-point scale scoring
490490 system, the commissioner shall provide for conversion, in
491491 accordance with commissioner rule, of the scale score to an
492492 equivalent score based on a 100-point scale scoring system. A
493493 student may not receive a high school diploma until the student has
494494 performed satisfactorily on [end-of-course] assessment instruments
495495 in the manner provided under this subsection. This subsection does
496496 not require a student to demonstrate readiness to enroll in an
497497 institution of higher education.
498498 (a-1) A student enrolled in a college preparatory
499499 [mathematics or] English language arts course under Section 28.014
500500 who satisfies the Texas Success Initiative (TSI) college readiness
501501 benchmarks prescribed by the Texas Higher Education Coordinating
502502 Board under Section 51.3062(f) on an assessment instrument
503503 designated by the Texas Higher Education Coordinating Board under
504504 Section 51.3062(c) administered at the end of the college
505505 preparatory [mathematics or] English language arts course
506506 satisfies the requirements concerning and is exempt from the
507507 administration of [the Algebra I or] the English I writing and
508508 English II writing end-of-course assessment instruments, as
509509 applicable, as prescribed by Section 39.023(c), even if the student
510510 did not perform satisfactorily on a previous administration of the
511511 applicable end-of-course assessment instrument. A student who
512512 fails to perform satisfactorily on the assessment instrument
513513 designated by the Texas Higher Education Coordinating Board under
514514 Section 51.3062(c) administered as provided by this subsection may
515515 retake that assessment instrument for purposes of this subsection
516516 or may take the appropriate end-of-course assessment instrument.
517517 (a-3) A student who, after retaking an end-of-course
518518 assessment instrument for [Algebra I or] English II writing, has
519519 failed to perform satisfactorily as required by Subsection (a), but
520520 who receives a score of proficient on the writing portion of the
521521 Texas Success Initiative (TSI) diagnostic assessment [for the
522522 corresponding subject for which the student failed to perform
523523 satisfactorily on the end-of-course assessment instrument]
524524 satisfies the requirement concerning the [Algebra I or] English II
525525 writing end-of-course assessment instrument[, as applicable. This
526526 subsection expires September 1, 2017].
527527 (a-4) The admission, review, and dismissal committee of a
528528 student in a special education program under Subchapter A, Chapter
529529 29, shall determine whether, to receive a high school diploma, the
530530 student is required to achieve satisfactory performance on
531531 [end-of-course] assessment instruments required under Section
532532 39.023(c).
533533 (b) Each time an [end-of-course] assessment instrument
534534 required [adopted] under Section 39.023(c) is administered, a
535535 student who failed to achieve a score requirement under Subsection
536536 (a) may retake the assessment instrument. A student is not required
537537 to retake a course as a condition of retaking an [end-of-course]
538538 assessment instrument.
539539 (b-1) A school district shall provide each student who fails
540540 to perform satisfactorily as determined by the commissioner under
541541 Section 39.0241(a) on an [end-of-course] assessment instrument
542542 required under Section 39.023(c) with accelerated instruction in
543543 the subject assessed by the assessment instrument.
544544 (f) The commissioner shall by rule adopt a transition plan
545545 to implement and administer the amendments made by _.B. ___, Acts of
546546 the 85th Legislature, Regular Session, 2017 [Chapter 1312 (S.B.
547547 No. 1031), Acts of the 80th Legislature, Regular Session, 2007],
548548 replacing the Algebra I end-of-course assessment instrument with
549549 the Texas Success Initiative (TSI) diagnostic assessment in
550550 mathematics and English I and II end-of-course assessment
551551 instruments with the Texas Success Initiative (TSI) diagnostic
552552 assessment in reading and the English I writing and English II
553553 writing [general subject assessment instruments administered at
554554 the high school level with] end-of-course assessment instruments as
555555 provided by Section 39.023(c). Except as otherwise provided by
556556 this subsection, the [The] rules must provide for the replacement
557557 [end-of-course] assessment instruments [adopted under Section
558558 39.023(c)] to be administered beginning with students entering the
559559 ninth grade during the 2017-2018 [2011-2012] school year. The
560560 rules must provide that:
561561 (1) a student entering the ninth grade during the
562562 2017-2018 school year who, before entering the ninth grade, was
563563 administered and performed successfully on the Algebra I
564564 end-of-course assessment instrument satisfies the requirements
565565 concerning the Texas Success Initiative (TSI) diagnostic
566566 assessment in mathematics as prescribed by Section 39.025(a);
567567 (2) a student entering the ninth grade during the
568568 2017-2018 school year who, before entering the ninth grade, was
569569 administered and performed successfully on the English I
570570 end-of-course assessment instrument:
571571 (A) may choose to be administered the English II
572572 end-of-course assessment instrument under Section 39.023(c), as
573573 that section existed before amendment by _.B. ___, Acts of the 85th
574574 Legislature, Regular Session, 2017, provided that the student's
575575 parent or person standing in parental relation to the student
576576 consents; and
577577 (B) must comply with the performance
578578 requirements of Section 39.025, as that section existed before
579579 amendment by _.B. ___, Acts of the 85th Legislature, Regular
580580 Session, 2017, for purposes of the English II assessment
581581 instrument;
582582 (3) a student entering a grade above the ninth grade
583583 during the 2017-2018 school year may choose to be administered the
584584 replacement assessment instruments, provided that the student's
585585 parent or person standing in parental relation to the student
586586 consents, and must comply with the performance requirements of
587587 Section 39.025; and
588588 (4) a student entering a grade above the ninth grade
589589 during the 2017-2018 school year who does not make the choice
590590 provided by Subdivision (3) must be administered the end-of-course
591591 assessment instruments listed under Section 39.023(c), as that
592592 section existed before amendment by _.B. ___, Acts of the 85th
593593 Legislature, Regular Session, 2017, and must comply with the
594594 performance requirements of Section 39.025, as that section existed
595595 before amendment by _.B. ___, Acts of the 85th Legislature, Regular
596596 Session, 2017.
597597 (f-1) During the period under which the transition to the
598598 replacement instruments described by Subsection (f) [end-of-course
599599 assessment instruments] is made:
600600 (1) for students described by Subsection (f)(1),
601601 students described by Subsection (f)(2) who make the choice
602602 provided by that subdivision, and students described by Subsection
603603 (f)(4) [entering a grade above the ninth grade during the 2011-2012
604604 school year], the commissioner shall provide for the retention,
605605 administration [retain, administer], and use for purposes of
606606 accreditation and other campus and district accountability
607607 measures under this chapter the applicable assessment instruments
608608 required by Section 39.023(c) [39.023(a) or (c)], as that section
609609 existed before amendment by _.B. ___, Acts of the 85th Legislature,
610610 Regular Session, 2017 [Chapter 1312 (S.B. No. 1031), Acts of the
611611 80th Legislature, Regular Session, 2007]; and
612612 (2) a student subject to Subdivision (1) may not
613613 receive a high school diploma unless:
614614 (A) the student has performed satisfactorily on:
615615 (i) each required assessment instrument
616616 administered under Section 39.023(c) applicable to the student; and
617617 (ii) each required assessment instrument
618618 administered under Section 39.023(c), as that section existed
619619 before amendment by _.B. ___, Acts of the 85th Legislature, Regular
620620 Session, 2017, applicable to the student; or
621621 (B) an individual graduation committee
622622 established under Section 28.0258 determines that the student is
623623 eligible to receive a high school diploma [Chapter 1312 (S.B.
624624 No. 1031), Acts of the 80th Legislature, Regular Session, 2007].
625625 SECTION 22. Section 39.025(a-2), Education Code, as added
626626 by Chapter 5 (S.B. 149), Acts of the 84th Legislature, Regular
627627 Session, 2015, is amended to read as follows:
628628 (a-2) Notwithstanding Subsection (a), a student who has
629629 failed to perform satisfactorily on [end-of-course] assessment
630630 instruments in the manner provided under this section may receive a
631631 high school diploma if the student has qualified for graduation
632632 under Section 28.0258. [This subsection expires September 1,
633633 2017.]
634634 SECTION 23. Section 39.025(a-2), Education Code, as added
635635 by Chapter 1036 (H.B. 1613), Acts of the 84th Legislature, Regular
636636 Session, 2015, is amended to read as follows:
637637 (a-2) The commissioner shall determine a method by which a
638638 student's satisfactory performance on an advanced placement test,
639639 an international baccalaureate examination, an SAT Subject Test,
640640 the SAT, the ACT, or any nationally recognized norm-referenced
641641 assessment instrument used by institutions of higher education to
642642 award course credit based on satisfactory performance on the
643643 assessment instrument shall be used to satisfy the requirements
644644 concerning an [end-of-course] assessment instrument required under
645645 Section 39.023(c) in an equivalent subject [course] as prescribed
646646 by Subsection (a). The commissioner shall determine a method by
647647 which a student's satisfactory performance on the PSAT or the
648648 ACT-Plan shall be used to satisfy the requirements concerning an
649649 [end-of-course] assessment instrument required under Section
650650 39.023(c) in an equivalent subject [course] as prescribed by
651651 Subsection (a). A student who fails to perform satisfactorily on a
652652 test or other assessment instrument authorized under this
653653 subsection, other than the PSAT or the ACT-Plan, may retake that
654654 test or other assessment instrument for purposes of this subsection
655655 or may take the appropriate [end-of-course] assessment instrument
656656 required under Section 39.023(c). A student who fails to perform
657657 satisfactorily on the PSAT or the ACT-Plan must take the
658658 appropriate [end-of-course] assessment instrument required under
659659 Section 39.023(c). The commissioner shall adopt rules as necessary
660660 for the administration of this subsection.
661661 SECTION 24. Section 39.034(d), Education Code, is amended
662662 to read as follows:
663663 (d) The agency shall determine the necessary annual
664664 improvement required each year for a student to be prepared to
665665 perform satisfactorily on, as applicable:
666666 (1) the grade five assessment instruments;
667667 (2) the grade eight assessment instruments; and
668668 (3) the [end-of-course] assessment instruments
669669 required under this subchapter for graduation.
670670 SECTION 25. Section 39.035, Education Code, is amended by
671671 amending Subsection (a) and adding Subsection (b-1) to read as
672672 follows:
673673 (a) Subject to Subsection (b) and except as provided by
674674 Subsection (b-1), the agency may conduct field testing of questions
675675 for any assessment instrument administered under Section
676676 39.023(a), (b), (c), (d), or (l) that is separate from the
677677 administration of the assessment instrument not more frequently
678678 than every other school year.
679679 (b-1) Subsection (a) does not apply to the Texas Success
680680 Initiative (TSI) diagnostic assessment in mathematics and reading
681681 administered under Section 39.023(c).
682682 SECTION 26. Section 39.053(d-1), Education Code, is amended
683683 to read as follows:
684684 (d-1) In aggregating results of assessment instruments
685685 across grade levels by subject in accordance with Subsection
686686 (c)(1), the performance of a student enrolled below the high school
687687 level on an assessment instrument required under Section 39.023(c)
688688 is included with results relating to other students enrolled at the
689689 same grade level. This subsection expires September 1, 2018.
690690 SECTION 27. Section 39.203(d), Education Code, is amended
691691 to read as follows:
692692 (d) In addition to the distinction designations otherwise
693693 described by this section, the commissioner may award a distinction
694694 designation for outstanding performance in advanced middle or
695695 junior high school student achievement to a campus with a
696696 significant number of students below grade nine who perform
697697 satisfactorily on an end-of-course assessment instrument
698698 administered under Section 39.023(c). This subsection expires
699699 September 1, 2018.
700700 SECTION 28. Section 51.3062(q), Education Code, is amended
701701 to read as follows:
702702 (q) A student who has achieved scores set by the board on the
703703 questions developed for applicable end-of-course assessment
704704 instruments under Section 39.0233(a), as that section existed
705705 before repeal by _.B. ___, Acts of the 85th Legislature, Regular
706706 Session, 2017, is exempt from the requirements of this section. The
707707 exemption is effective for the three-year period following the date
708708 a student takes the last assessment instrument for purposes of this
709709 section and achieves the standard set by the board. This subsection
710710 does not apply during any period for which the board designates the
711711 questions developed for end-of-course assessment instruments under
712712 Section 39.0233(a), as that section existed before repeal by _.B.
713713 ___, Acts of the 85th Legislature, Regular Session, 2017, as the
714714 primary assessment instrument under this section, except that the
715715 three-year period described by this subsection remains in effect
716716 for students who qualify for an exemption under this subsection
717717 before that period.
718718 SECTION 29. The following sections of the Education Code
719719 are repealed:
720720 (1) Section 28.0258(l);
721721 (2) Section 28.0259(e);
722722 (3) Section 39.0233(a); and
723723 (4) Section 39.025(e-1).
724724 SECTION 30. A reference in the Education Code to an
725725 assessment instrument under Section 39.023(c), Education Code, as
726726 amended by this Act, includes, as applicable, an Algebra I, English
727727 I, or English II end-of-course assessment instrument administered
728728 under the transition plan provided for under Section 39.025(f),
729729 Education Code, as amended by this Act, and Section 39.025(f-1),
730730 Education Code, as added by this Act.
731731 SECTION 31. (a) As soon as practicable, each school
732732 district that provided notice to an eighth grade student under
733733 Section 39.025(g), Education Code, during the 2016-2017 school year
734734 shall send an updated notice to that student informing the student
735735 of:
736736 (1) the specific requirements applicable to the
737737 student under Section 39.025(a), Education Code, as amended by this
738738 Act; and
739739 (2) the options available to students who qualify
740740 under Sections 39.025(f)(1) and (2), as added by this Act.
741741 (b) As soon as practicable, the commissioner of education
742742 shall determine the level of performance considered to be
743743 satisfactory as required under Section 39.0241(a), Education Code,
744744 on the mathematics and reading portions of the Texas Success
745745 Initiative (TSI) diagnostic assessment required under Section
746746 39.023(c), Education Code, as amended by this Act.
747747 SECTION 32. This Act applies beginning with the 2017-2018
748748 school year.
749749 SECTION 33. This Act takes effect immediately if it
750750 receives a vote of two-thirds of all the members elected to each
751751 house, as provided by Section 39, Article III, Texas Constitution.
752752 If this Act does not receive the vote necessary for immediate
753753 effect, this Act takes effect September 1, 2017.
