55 AN ACT
66 relating to the liability of certain property owners who allow
77 handguns to be carried on certain property.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Title 4, Civil Practice and Remedies Code, is
1010 amended by adding Chapter 95A to read as follows:
1111 CHAPTER 95A. GUN-FREE ZONE REDUCTION ACT
1212 Sec. 95A.001. DEFINITIONS. In this chapter:
1313 (1) "License holder" means a person licensed under
1414 Subchapter H, Chapter 411, Government Code.
1515 (2) "Non-prohibited property" means property on which
1616 the carrying of a handgun by a license holder is not prohibited
1717 pursuant to Sections 46.03 or 46.035, Penal Code.
1818 Sec. 95A.002. NO CAUSE OF ACTION FOR ALLOWING HANDGUNS ON
1919 CERTAIN PROPERTY. There shall be no cause of action against an
2020 owner or lessee of non-prohibited property based on the owner's or
2121 lessee's decision not to forbid the carrying of handguns on the
2222 non-prohibited property by giving notice pursuant to Sections 30.06
2323 or 30.07, Penal Code.
2424 SECTION 2. Chapter 95A, Civil Practice and Remedies Code, as
2525 added by this Act, does not apply to a cause of action that accrued
2626 before the effective date of this Act. A cause of action that
2727 accrued before the effective date of this Act is governed by the law
2828 applicable to the cause of action immediately before that date, and
2929 the former law is continued in effect for that purpose.
3030 SECTION 3. This Act takes effect September 1, 2017.
