| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Title 4, Civil Practice and Remedies Code, is |
|---|
| 10 | 10 | | amended by adding Chapter 95A to read as follows: |
|---|
| 11 | 11 | | CHAPTER 95A. GUN-FREE ZONE REDUCTION ACT |
|---|
| 12 | 12 | | Sec. 95A.001. DEFINITIONS. In this chapter: |
|---|
| 13 | 13 | | (1) "License holder" means a person licensed under |
|---|
| 14 | 14 | | Subchapter H, Chapter 411, Government Code. |
|---|
| 15 | 15 | | (2) "Non-prohibited property" means property on which |
|---|
| 16 | 16 | | the carrying of a handgun by a license holder is not prohibited |
|---|
| 17 | 17 | | pursuant to Sections 46.03 or 46.035, Penal Code. |
|---|
| 18 | 18 | | Sec. 95A.002. NO CAUSE OF ACTION FOR ALLOWING HANDGUNS ON |
|---|
| 19 | 19 | | CERTAIN PROPERTY. There shall be no cause of action against an |
|---|
| 20 | 20 | | owner or lessee of non-prohibited property based on the owner's or |
|---|
| 21 | 21 | | lessee's decision not to forbid the carrying of handguns on the |
|---|
| 22 | 22 | | non-prohibited property by giving notice pursuant to Sections 30.06 |
|---|
| 23 | 23 | | or 30.07, Penal Code. |
|---|
| 24 | 24 | | SECTION 2. Chapter 95A, Civil Practice and Remedies Code, as |
|---|
| 25 | 25 | | added by this Act, does not apply to a cause of action that accrued |
|---|
| 26 | 26 | | before the effective date of this Act. A cause of action that |
|---|
| 27 | 27 | | accrued before the effective date of this Act is governed by the law |
|---|
| 28 | 28 | | applicable to the cause of action immediately before that date, and |
|---|
| 29 | 29 | | the former law is continued in effect for that purpose. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2017. |
