55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to required disclosures in and to the length of ballot
88 proposition language authorizing political subdivisions to issue
99 bonds or impose or change a tax.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 52.072, Election Code, is amended by
1212 amending Subsection (e) and adding Subsection (f) to read as
1313 follows:
1414 (e) In addition to any other requirement imposed by law for
1515 a proposition, including a provision prescribing the proposition
1616 language, a proposition in an election of a political subdivision,
1717 including a city, county, school district, or special taxing
1818 district, submitted to the voters for approval of [the issuance of
1919 bonds or] the imposition, increase, or reduction of a tax shall
2020 specifically state, as applicable:
2121 (1) [with respect to a proposition seeking voter
2222 approval of the issuance of bonds:
2323 [(A) the total principal amount of the bonds to
2424 be authorized, if approved; and
2525 [(B) a general description of the purposes for
2626 which the bonds are to be authorized, if approved;
2727 [(2)] with respect to a proposition that only seeks
2828 voter approval of the imposition or increase of a tax:
2929 (A) [,] the amount of or maximum tax rate of the
3030 tax or tax increase for which approval is sought;
3131 (B) the estimated additional tax burden that
3232 would be imposed on a homestead with a value equal to the median
3333 homestead value in the political subdivision, as computed by the
3434 appraisal district, after the imposition or increase of the tax, if
3535 approved; and
3636 (C) a detailed description of the purposes for
3737 which the tax is to be imposed or increased, if approved; or
3838 (2) [(3)] with respect to a proposition that only
3939 seeks voter approval of the reduction of a tax:
4040 (A) [,] the amount of tax rate reduction or the
4141 tax rate for which approval is sought; and
4242 (B) the estimated tax reduction for a homestead
4343 with a value equal to the median homestead value in the political
4444 subdivision, as computed by the appraisal district, if the
4545 reduction of the tax is approved.
4646 (f) A proposition to which Subsection (e) applies or for
4747 approval of the issuance of bonds may not exceed:
4848 (1) 5,000 characters; or
4949 (2) a different limit prescribed by the secretary of
5050 state that ensures that the length of the proposition does not
5151 exceed one page of the ballot or one screen on an electronic voting
5252 machine.
5353 SECTION 2. Chapter 1251, Government Code, is amended by
5454 designating Sections 1251.001, 1251.002, 1251.003, 1251.004,
5555 1251.005, and 1251.006 as Subchapter A and adding a subchapter
5656 heading to read as follows:
5757 SUBCHAPTER A. PROVISIONS RELATING GENERALLY TO BOND ELECTIONS
5858 SECTION 3. Chapter 1251, Government Code, is amended by
5959 adding Subchapter B to read as follows:
6060 SUBCHAPTER B. BALLOT PROPOSITION FOR BONDS ISSUED BY POLITICAL
6161 SUBDIVISION
6262 Sec. 1251.051. APPLICABILITY. This subchapter applies to
6363 bonds issued by any political subdivision, including a
6464 municipality, county, school district, or special taxing district.
6565 Sec. 1251.052. FORM. A proposition seeking voter approval
6666 of the issuance of bonds shall specifically state:
6767 (1) a general description of the purposes for which
6868 the bonds are to be authorized;
6969 (2) the total principal amount of the bonds;
7070 (3) the total amount of the political subdivision's
7171 debt secured by ad valorem taxes currently outstanding;
7272 (4) the total amount of the political subdivision's
7373 current payments on debt secured by ad valorem taxes;
7474 (5) the amount of taxes required to be imposed on a
7575 homestead with a value equal to the median homestead value in the
7676 political subdivision, as computed by the appraisal district, to
7777 repay the political subdivision's current debt obligations secured
7878 by ad valorem taxes; and
7979 (6) the estimated tax burden that would be imposed on a
8080 homestead with a value equal to the median homestead value in the
8181 political subdivision, as computed by the appraisal district, to
8282 repay the bonds to be authorized, if approved.
8383 SECTION 4. The changes in law made by this Act apply only to
8484 a ballot for an election ordered on or after the effective date of
8585 this Act. An election ordered before the effective date of this Act
8686 is governed by the law in effect when the election was ordered, and
8787 the former law is continued in effect for that purpose.
8888 SECTION 5. This Act takes effect September 1, 2017.
