64 AN ACT
75 relating to the participation of an advanced practice registered
86 nurse as a primary care or network provider for certain
97 governmental and other health benefit plans.
108 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
119 SECTION 1. Section 533.005, Government Code, is amended by
1210 adding Subsection (d) to read as follows:
1311 (d) For purposes of Subsection (a)(13), an advanced
1412 practice registered nurse may be included as a primary care
1513 provider in a managed care organization's provider network
1614 regardless of whether the physician supervising the advanced
1715 practice registered nurse is in the provider network. This
1816 subsection may not be construed as authorizing a managed care
1917 organization to supervise or control the practice of medicine as
2018 prohibited by Subtitle B, Title 3, Occupations Code.
2119 SECTION 2. Section 62.1551, Health and Safety Code, is
2220 amended to read as follows:
2321 Sec. 62.1551. INCLUSION OF CERTAIN HEALTH CARE PROVIDERS IN
2422 PROVIDER NETWORKS. (a) Notwithstanding any other law, including
2523 Sections 843.312 and 1301.052, Insurance Code, the executive
2624 commissioner shall adopt rules to require a managed care
2725 organization or other entity to ensure that advanced practice
2826 registered nurses and physician assistants are available as primary
2927 care providers in the organization's or entity's provider network.
3028 The rules must require advanced practice registered nurses and
3129 physician assistants to be treated in the same manner as primary
3230 care physicians with regard to:
3331 (1) selection and assignment as primary care
3432 providers;
3533 (2) inclusion as primary care providers in the
3634 provider network; and
3735 (3) inclusion as primary care providers in any
3836 provider network directory maintained by the organization or
3937 entity.
4038 (b) For purposes of Subsection (a), an advanced practice
4139 registered nurse may be included as a primary care provider in a
4240 managed care organization's or entity's provider network regardless
4341 of whether the physician supervising the advanced practice
4442 registered nurse is in the provider network.
4543 (c) This section may not be construed as authorizing a
4644 managed care organization or other entity to supervise or control
4745 the practice of medicine as prohibited by Subtitle B, Title 3,
4846 Occupations Code.
4947 SECTION 3. Section 32.024(gg), Human Resources Code, is
5048 amended to read as follows:
5149 (gg) Notwithstanding any other law, including Sections
5250 843.312 and 1301.052, Insurance Code, the commission shall ensure
5351 that advanced practice registered nurses and physician assistants
5452 may be selected by and assigned to recipients of medical assistance
5553 as the primary care providers of those recipients regardless of
5654 whether the physician supervising the advanced practice registered
5755 nurse is included in any directory of providers of medical
5856 assistance maintained by the commission. This subsection may not
5957 be construed as authorizing the commission to supervise or control
6058 the practice of medicine as prohibited by Subtitle B, Title 3,
6159 Occupations Code. The commission must require that advanced
6260 practice registered nurses and physician assistants be treated in
6361 the same manner as primary care physicians with regard to:
6462 (1) selection and assignment as primary care
6563 providers; and
6664 (2) inclusion as primary care providers in any
6765 directory of providers of medical assistance maintained by the
6866 commission.
6967 SECTION 4. If before implementing any provision of this Act
7068 a state agency determines that a waiver or authorization from a
7169 federal agency is necessary for implementation of that provision,
7270 the agency affected by the provision shall request the waiver or
7371 authorization and may delay implementing that provision until the
7472 waiver or authorization is granted.
7573 SECTION 5. This Act takes effect September 1, 2017.
