1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to education requirements for a notary public appointment;
1414 authorizing a fee.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Subchapter A, Chapter 406, Government Code, is
1717 amended by adding Section 406.0045 to read as follows:
1818 Sec. 406.0045. REQUIRED EDUCATIONAL COURSE. (a) An
1919 applicant for an initial appointment as a notary public shall
2020 complete an educational course approved by the secretary of state.
2121 The educational course may be an online, self-study, or classroom
2222 course.
2323 (b) The secretary of state shall adopt rules necessary to
2424 implement the educational course requirement imposed by Subsection
2525 (a). The rules must:
2626 (1) establish the standards for an educational course;
2727 (2) establish the procedures for approving an
2828 educational course; and
2929 (3) set a nonrefundable vendor application and renewal
3030 fee for a vendor of an educational course in an amount sufficient to
3131 administer this section.
3232 (c) The secretary of state may provide an educational course
3333 to satisfy the requirements of Subsection (a).
3434 (d) A fee received by the secretary of state under
3535 Subsection (b)(3) must be appropriated to and used by the secretary
3636 of state to administer this section.
3737 SECTION 2. Section 406.005, Government Code, is amended by
3838 adding Subsection (c) to read as follows:
3939 (c) An application for an initial appointment under this
4040 section must include a statement that the applicant has completed
4141 an educational course required by Section 406.0045.
4242 SECTION 3. Section 406.006, Government Code, is amended to
4343 read as follows:
4444 Sec. 406.006. QUALIFICATION. An individual qualifies by:
4545 (1) properly completing the application form;
4646 (2) executing the statement;
4747 (3) providing the bond, if required;
4848 (4) paying the required filing fees; [and]
4949 (5) meeting the eligibility requirements; and
5050 (6) providing a statement of completion of an
5151 educational course if required by Section 406.0045.
5252 SECTION 4. Section 406.007(a), Government Code, is amended
5353 to read as follows:
5454 (a) The applicant must submit to the secretary of state:
5555 (1) a fee of $10 for approving and filing the bond of
5656 the notary public, if required; and
5757 (2) a fee of $1 to be appropriated to and used by the
5858 secretary of state [only] for:
5959 (A) hiring an investigator;
6060 (B) administering and managing an educational
6161 course under Section 406.0045(c); and
6262 (C) [for] preparing and distributing the
6363 materials required to be distributed under Section 406.008.
6464 SECTION 5. Section 406.011, Government Code, is amended by
6565 adding Subsection (c) to read as follows:
6666 (c) Section 406.0045 does not apply to a notary public
6767 applying for reappointment under this section.
6868 SECTION 6. The changes in law made by this Act apply only to
6969 an application for a notary public appointment received and
7070 qualified on or after September 1, 2018. An application received
7171 and qualified before September 1, 2018, is governed by the law as it
7272 existed immediately before the effective date of this Act, and that
7373 law is continued in effect for that purpose.
7474 SECTION 7. This Act takes effect January 1, 2018.
