55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the applicability of the law governing the mineral use
88 of subdivided land.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 92.002(3), Natural Resources Code, is
1111 amended to read as follows:
1212 (3) "Qualified subdivision" means a tract of land of
1313 not more than 640 acres:
1414 (A) that is located:
1515 (i) in a county with [having] a population
1616 [in excess] of more than 400,000;
1717 (ii) [, or] in a county with [having] a
1818 population [in excess] of more than 140,000 that borders a county
1919 with [having] a population [in excess] of more than 400,000;
2020 (iii) in a county with a population of less
2121 than 300,000 that is located on the Texas-Mexico border and
2222 contains one or more municipalities with a population of 200,000 or
2323 more; or
2424 (iv) [located] on a barrier island;
2525 (B) that has been subdivided in a manner
2626 authorized by law by the surface owners for residential,
2727 commercial, or industrial use; and
2828 (C) that contains an operations site for each
2929 separate 80 acres within the 640-acre tract and provisions for road
3030 and pipeline easements to allow use of the operations site.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2017.
