| 7 | 7 | | relating to the applicability of the law governing the mineral use |

| 8 | 8 | | of subdivided land. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 92.002(3), Natural Resources Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (3) "Qualified subdivision" means a tract of land of |
|---|
| 13 | 13 | | not more than 640 acres: |
|---|
| 14 | 14 | | (A) that is located: |
|---|
| 15 | 15 | | (i) in a county with [having] a population |
|---|
| 16 | 16 | | [in excess] of more than 400,000; |
|---|
| 17 | 17 | | (ii) [, or] in a county with [having] a |
|---|
| 18 | 18 | | population [in excess] of more than 140,000 that borders a county |
|---|
| 19 | 19 | | with [having] a population [in excess] of more than 400,000; |
|---|
| 20 | 20 | | (iii) in a county with a population of less |
|---|
| 21 | 21 | | than 300,000 that is located on the Texas-Mexico border and |
|---|
| 22 | 22 | | contains one or more municipalities with a population of 200,000 or |
|---|
| 23 | 23 | | more; or |
|---|
| 24 | 24 | | (iv) [located] on a barrier island; |
|---|
| 25 | 25 | | (B) that has been subdivided in a manner |
|---|
| 26 | 26 | | authorized by law by the surface owners for residential, |
|---|
| 27 | 27 | | commercial, or industrial use; and |
|---|
| 28 | 28 | | (C) that contains an operations site for each |
|---|
| 29 | 29 | | separate 80 acres within the 640-acre tract and provisions for road |
|---|
| 30 | 30 | | and pipeline easements to allow use of the operations site. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2017. |
