| 7 | 7 | | relating to determining eligibility of a county for a grant from the |
|---|
| 8 | 8 | | transportation infrastructure fund. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 256.104(a) and (b), Transportation |
|---|
| 11 | 11 | | Code, are amended to read as follows: |
|---|
| 12 | 12 | | (a) In applying for a grant under this subchapter, the |
|---|
| 13 | 13 | | county shall: |
|---|
| 14 | 14 | | (1) provide the road condition report described by |
|---|
| 15 | 15 | | Section 251.018 made by the county for the previous year; [and] |
|---|
| 16 | 16 | | (2) submit to the department: |
|---|
| 17 | 17 | | (A) a copy of the order or resolution |
|---|
| 18 | 18 | | establishing a county energy transportation reinvestment zone in |
|---|
| 19 | 19 | | the county, except that the department may waive the submission |
|---|
| 20 | 20 | | until the time the grant is awarded; and |
|---|
| 21 | 21 | | (B) a plan that: |
|---|
| 22 | 22 | | (i) provides a list of transportation |
|---|
| 23 | 23 | | infrastructure projects to be funded by the grant; |
|---|
| 24 | 24 | | (ii) describes the scope of the |
|---|
| 25 | 25 | | transportation infrastructure project or projects to be funded by |
|---|
| 26 | 26 | | the grant using best practices for prioritizing the projects; |
|---|
| 27 | 27 | | (iii) provides for matching funds as |
|---|
| 28 | 28 | | required by Section 256.105; and |
|---|
| 29 | 29 | | (iv) meets any other requirements imposed |
|---|
| 30 | 30 | | by the department; and |
|---|
| 31 | 31 | | (3) provide the department with the amount of oil and |
|---|
| 32 | 32 | | gas production taxes collected in the county for the previous two |
|---|
| 33 | 33 | | fiscal years. |
|---|
| 34 | 34 | | (b) In reviewing grant applications under this subchapter, |
|---|
| 35 | 35 | | the department shall: |
|---|
| 36 | 36 | | (1) seek other potential sources of funding to |
|---|
| 37 | 37 | | maximize resources available for the transportation infrastructure |
|---|
| 38 | 38 | | projects to be funded by grants under this subchapter; [and] |
|---|
| 39 | 39 | | (2) consult related transportation planning documents |
|---|
| 40 | 40 | | to improve project efficiency and work effectively in partnership |
|---|
| 41 | 41 | | with counties; and |
|---|
| 42 | 42 | | (3) consider the amount of oil and gas production |
|---|
| 43 | 43 | | taxes provided by a county under Subsection (a)(3) in determining |
|---|
| 44 | 44 | | whether a transportation infrastructure project to be funded by the |
|---|
| 45 | 45 | | grant is located in an area of the state affected by increased oil |
|---|
| 46 | 46 | | and gas production. |
|---|
| 47 | 47 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 48 | 48 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 49 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 50 | 50 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 51 | 51 | | Act takes effect September 1, 2017. |
