55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to determining eligibility of a county for a grant from the
88 transportation infrastructure fund.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 256.104(a) and (b), Transportation
1111 Code, are amended to read as follows:
1212 (a) In applying for a grant under this subchapter, the
1313 county shall:
1414 (1) provide the road condition report described by
1515 Section 251.018 made by the county for the previous year; [and]
1616 (2) submit to the department:
1717 (A) a copy of the order or resolution
1818 establishing a county energy transportation reinvestment zone in
1919 the county, except that the department may waive the submission
2020 until the time the grant is awarded; and
2121 (B) a plan that:
2222 (i) provides a list of transportation
2323 infrastructure projects to be funded by the grant;
2424 (ii) describes the scope of the
2525 transportation infrastructure project or projects to be funded by
2626 the grant using best practices for prioritizing the projects;
2727 (iii) provides for matching funds as
2828 required by Section 256.105; and
2929 (iv) meets any other requirements imposed
3030 by the department; and
3131 (3) provide the department with the amount of oil and
3232 gas production taxes collected in the county for the previous two
3333 fiscal years.
3434 (b) In reviewing grant applications under this subchapter,
3535 the department shall:
3636 (1) seek other potential sources of funding to
3737 maximize resources available for the transportation infrastructure
3838 projects to be funded by grants under this subchapter; [and]
3939 (2) consult related transportation planning documents
4040 to improve project efficiency and work effectively in partnership
4141 with counties; and
4242 (3) consider the amount of oil and gas production
4343 taxes provided by a county under Subsection (a)(3) in determining
4444 whether a transportation infrastructure project to be funded by the
4545 grant is located in an area of the state affected by increased oil
4646 and gas production.
4747 SECTION 2. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2017.
