10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 551.404, Transportation Code, is amended | |
12 | 12 | by amending Subsection (a-1) and adding Subsection (a-3) to read as | |
13 | 13 | follows: | |
14 | 14 | (a-1) In addition to the operation authorized by Section | |
15 | 15 | 551.403, the commissioners court of a county described by | |
16 | 16 | Subsection (a-2) may allow an operator to operate a golf cart [or | |
17 | 17 | utility vehicle] on all or part of a public highway that: | |
18 | 18 | (1) is located in the unincorporated area of the | |
19 | 19 | county; and | |
20 | 20 | (2) has a speed limit of not more than 35 miles per | |
21 | 21 | hour. | |
22 | 22 | (a-3) A local authority may allow and regulate the operation | |
23 | 23 | of a utility vehicle on all or part of a public roadway in the | |
24 | 24 | jurisdiction of the authority. | |
25 | 25 | SECTION 2. Section 663.037, Transportation Code, is amended | |
26 | 26 | by adding Subsection (h) to read as follows: | |
27 | 27 | (h) A local authority may allow and regulate the operation | |
28 | 28 | of an all-terrain vehicle on all or part of a public roadway in the | |
29 | 29 | jurisdiction of the authority. | |
30 | 30 | SECTION 3. This Act takes effect September 1, 2017. |
