66 AN ACT
77 relating to the prosecution of the offense of aggravated
88 kidnapping.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 20.04(a), Penal Code, is amended to read
1111 as follows:
1212 (a) A person commits an offense if the actor [he]
1313 intentionally or knowingly abducts another person with the intent
1414 to:
1515 (1) hold the person [him] for ransom or reward;
1616 (2) use the person [him] as a shield or hostage;
1717 (3) facilitate the commission of a felony or the
1818 flight after the attempt or commission of a felony;
1919 (4) inflict bodily injury on the person [him or
2020 violate or abuse him sexually];
2121 (5) terrorize the person [him] or a third person; [or]
2222 (6) interfere with the performance of any governmental
2323 or political function; or
2424 (7) violate or abuse the person sexually.
2525 SECTION 2. Article 12.01, Code of Criminal Procedure, is
2626 amended to read as follows:
2727 Art. 12.01. FELONIES. Except as provided in Article 12.03,
2828 felony indictments may be presented within these limits, and not
2929 afterward:
3030 (1) no limitation:
3131 (A) murder and manslaughter;
3232 (B) sexual assault under Section 22.011(a)(2),
3333 Penal Code, or aggravated sexual assault under Section
3434 22.021(a)(1)(B), Penal Code;
3535 (C) sexual assault, if:
3636 (i) during the investigation of the offense
3737 biological matter is collected and subjected to forensic DNA
3838 testing and the testing results show that the matter does not match
3939 the victim or any other person whose identity is readily
4040 ascertained; or
4141 (ii) probable cause exists to believe that
4242 the defendant has committed the same or a similar sexual offense
4343 against five or more victims;
4444 (D) continuous sexual abuse of young child or
4545 children under Section 21.02, Penal Code;
4646 (E) indecency with a child under Section 21.11,
4747 Penal Code;
4848 (F) an offense involving leaving the scene of an
4949 accident under Section 550.021, Transportation Code, if the
5050 accident resulted in the death of a person;
5151 (G) trafficking of persons under Section
5252 20A.02(a)(7) or (8), Penal Code;
5353 (H) continuous trafficking of persons under
5454 Section 20A.03, Penal Code; or
5555 (I) compelling prostitution under Section
5656 43.05(a)(2), Penal Code;
5757 (2) ten years from the date of the commission of the
5858 offense:
5959 (A) theft of any estate, real, personal or mixed,
6060 by an executor, administrator, guardian or trustee, with intent to
6161 defraud any creditor, heir, legatee, ward, distributee,
6262 beneficiary or settlor of a trust interested in such estate;
6363 (B) theft by a public servant of government
6464 property over which he exercises control in his official capacity;
6565 (C) forgery or the uttering, using or passing of
6666 forged instruments;
6767 (D) injury to an elderly or disabled individual
6868 punishable as a felony of the first degree under Section 22.04,
6969 Penal Code;
7070 (E) sexual assault, except as provided by
7171 Subdivision (1);
7272 (F) arson;
7373 (G) trafficking of persons under Section
7474 20A.02(a)(1), (2), (3), or (4), Penal Code; or
7575 (H) compelling prostitution under Section
7676 43.05(a)(1), Penal Code;
7777 (3) seven years from the date of the commission of the
7878 offense:
7979 (A) misapplication of fiduciary property or
8080 property of a financial institution;
8181 (B) securing execution of document by deception;
8282 (C) a felony violation under Chapter 162, Tax
8383 Code;
8484 (D) false statement to obtain property or credit
8585 under Section 32.32, Penal Code;
8686 (E) money laundering;
8787 (F) credit card or debit card abuse under Section
8888 32.31, Penal Code;
8989 (G) fraudulent use or possession of identifying
9090 information under Section 32.51, Penal Code;
9191 (H) Medicaid fraud under Section 35A.02, Penal
9292 Code; or
9393 (I) bigamy under Section 25.01, Penal Code,
9494 except as provided by Subdivision (6);
9595 (4) five years from the date of the commission of the
9696 offense:
9797 (A) theft or robbery;
9898 (B) except as provided by Subdivision (5),
9999 kidnapping or burglary;
100100 (C) injury to an elderly or disabled individual
101101 that is not punishable as a felony of the first degree under Section
102102 22.04, Penal Code;
103103 (D) abandoning or endangering a child; or
104104 (E) insurance fraud;
105105 (5) if the investigation of the offense shows that the
106106 victim is younger than 17 years of age at the time the offense is
107107 committed, 20 years from the 18th birthday of the victim of one of
108108 the following offenses:
109109 (A) sexual performance by a child under Section
110110 43.25, Penal Code;
111111 (B) aggravated kidnapping under Section
112112 20.04(a)(7) [20.04(a)(4)], Penal Code [, if the defendant committed
113113 the offense with the intent to violate or abuse the victim
114114 sexually]; or
115115 (C) burglary under Section 30.02, Penal Code, if
116116 the offense is punishable under Subsection (d) of that section and
117117 the defendant committed the offense with the intent to commit an
118118 offense described by Subdivision (1)(B) or (D) of this article or
119119 Paragraph (B) of this subdivision;
120120 (6) ten years from the 18th birthday of the victim of
121121 the offense:
122122 (A) trafficking of persons under Section
123123 20A.02(a)(5) or (6), Penal Code;
124124 (B) injury to a child under Section 22.04, Penal
125125 Code; or
126126 (C) bigamy under Section 25.01, Penal Code, if
127127 the investigation of the offense shows that the person, other than
128128 the legal spouse of the defendant, whom the defendant marries or
129129 purports to marry or with whom the defendant lives under the
130130 appearance of being married is younger than 18 years of age at the
131131 time the offense is committed; or
132132 (7) three years from the date of the commission of the
133133 offense: all other felonies.
134134 SECTION 3. Article 42A.056, Code of Criminal Procedure, is
135135 amended to read as follows:
136136 Art. 42A.056. LIMITATION ON JURY-RECOMMENDED COMMUNITY
137137 SUPERVISION. A defendant is not eligible for community
138138 supervision under Article 42A.055 if the defendant:
139139 (1) is sentenced to a term of imprisonment that
140140 exceeds 10 years;
141141 (2) is convicted of a state jail felony for which
142142 suspension of the imposition of the sentence occurs automatically
143143 under Article 42A.551;
144144 (3) is adjudged guilty of an offense under Section
145145 19.02, Penal Code;
146146 (4) is convicted of an offense under Section
147147 21.11(a)(1), 22.011, or 22.021, Penal Code, if the victim of the
148148 offense was younger than 14 years of age at the time the offense was
149149 committed;
150150 (5) is convicted of an offense under Section
151151 20.04(a)(7) [20.04], Penal Code, if [:
152152 [(A)] the victim of the offense was younger than
153153 14 years of age at the time the offense was committed [; and
154154 [(B) the actor committed the offense with the
155155 intent to violate or abuse the victim sexually];
156156 (6) is convicted of an offense under Section 20A.02,
157157 43.05, or 43.25, Penal Code; or
158158 (7) is convicted of an offense for which punishment is
159159 increased under Section 481.134(c), (d), (e), or (f), Health and
160160 Safety Code, if it is shown that the defendant has been previously
161161 convicted of an offense for which punishment was increased under
162162 any of those subsections.
163163 SECTION 4. Article 42A.251(2), Code of Criminal Procedure,
164164 is amended to read as follows:
165165 (2) "Sex offender" means a person who has been
166166 convicted of, or has entered a plea of guilty or nolo contendere
167167 for, an offense under any one of the following provisions of the
168168 Penal Code:
169169 (A) Section 20.04(a)(7) [20.04(a)(4)]
170170 (Aggravated Kidnapping) [, if the person committed the offense with
171171 the intent to violate or abuse the victim sexually];
172172 (B) Section 21.08 (Indecent Exposure);
173173 (C) Section 21.11 (Indecency with a Child);
174174 (D) Section 22.011 (Sexual Assault);
175175 (E) Section 22.021 (Aggravated Sexual Assault);
176176 (F) Section 25.02 (Prohibited Sexual Conduct);
177177 (G) Section 30.02 (Burglary), if:
178178 (i) the offense is punishable under
179179 Subsection (d) of that section; and
180180 (ii) the person committed the offense with
181181 the intent to commit a felony listed in this subdivision;
182182 (H) Section 43.25 (Sexual Performance by a
183183 Child); or
184184 (I) Section 43.26 (Possession or Promotion of
185185 Child Pornography).
186186 SECTION 5. Article 42A.453(b), Code of Criminal Procedure,
187187 is amended to read as follows:
188188 (b) This article applies to a defendant placed on community
189189 supervision for an offense under:
190190 (1) Section 20.04(a)(7) [20.04(a)(4)], Penal Code [,
191191 if the defendant committed the offense with the intent to violate or
192192 abuse the victim sexually];
193193 (2) Section 20A.02, Penal Code, if the defendant:
194194 (A) trafficked the victim with the intent or
195195 knowledge that the victim would engage in sexual conduct, as
196196 defined by Section 43.25, Penal Code; or
197197 (B) benefited from participating in a venture
198198 that involved a trafficked victim engaging in sexual conduct, as
199199 defined by Section 43.25, Penal Code;
200200 (3) Section 21.08, 21.11, 22.011, 22.021, or 25.02,
201201 Penal Code;
202202 (4) Section 30.02, Penal Code, punishable under
203203 Subsection (d) of that section, if the defendant committed the
204204 offense with the intent to commit a felony listed in Subdivision (1)
205205 or (3); or
206206 (5) Section 43.05(a)(2), 43.25, or 43.26, Penal Code.
207207 SECTION 6. Article 60.051(g), Code of Criminal Procedure,
208208 is amended to read as follows:
209209 (g) In addition to the information described by Subsections
210210 (a)-(f), information in the computerized criminal history system
211211 must include the age of the victim of the offense if the defendant
212212 was arrested for or charged with an offense under:
213213 (1) Section 21.02 (Continuous sexual abuse of young
214214 child or children), Penal Code;
215215 (2) Section 21.11 (Indecency with a child), Penal
216216 Code;
217217 (3) Section 22.011 (Sexual assault) or 22.021
218218 (Aggravated sexual assault), Penal Code;
219219 (4) Section 43.25 (Sexual performance by a child),
220220 Penal Code;
221221 (5) Section 20.04(a)(7) [20.04(a)(4)] (Aggravated
222222 kidnapping), Penal Code [, if the defendant committed the offense
223223 with intent to violate or abuse the victim sexually];
224224 (6) Section 30.02 (Burglary), Penal Code, if the
225225 offense is punishable under Subsection (d) of that section and the
226226 defendant committed the offense with intent to commit an offense
227227 described by Subdivision (2), (3), or (5);
228228 (7) Section 20A.02 (Trafficking of persons), Penal
229229 Code, if the defendant:
230230 (A) trafficked a person with the intent or
231231 knowledge that the person would engage in sexual conduct, as
232232 defined by Section 43.25, Penal Code; or
233233 (B) benefited from participating in a venture
234234 that involved a trafficked person engaging in sexual conduct, as
235235 defined by Section 43.25, Penal Code; or
236236 (8) Section 43.05(a)(2) (Compelling prostitution),
237237 Penal Code.
238238 SECTION 7. Articles 62.001(5) and (6), Code of Criminal
239239 Procedure, are amended to read as follows:
240240 (5) "Reportable conviction or adjudication" means a
241241 conviction or adjudication, including an adjudication of
242242 delinquent conduct or a deferred adjudication, that, regardless of
243243 the pendency of an appeal, is a conviction for or an adjudication
244244 for or based on:
245245 (A) a violation of Section 21.02 (Continuous
246246 sexual abuse of young child or children), 21.11 (Indecency with a
247247 child), 22.011 (Sexual assault), 22.021 (Aggravated sexual
248248 assault), or 25.02 (Prohibited sexual conduct), Penal Code;
249249 (B) a violation of Section 43.05 (Compelling
250250 prostitution), 43.25 (Sexual performance by a child), or 43.26
251251 (Possession or promotion of child pornography), Penal Code;
252252 (B-1) a violation of Section 43.02
253253 (Prostitution), Penal Code, if the offense is punishable under
254254 Subsection (c)(3) of that section;
255255 (C) a violation of Section 20.04(a)(7)
256256 [20.04(a)(4)] (Aggravated kidnapping), Penal Code [, if the actor
257257 committed the offense or engaged in the conduct with intent to
258258 violate or abuse the victim sexually];
259259 (D) a violation of Section 30.02 (Burglary),
260260 Penal Code, if the offense or conduct is punishable under
261261 Subsection (d) of that section and the actor committed the offense
262262 or engaged in the conduct with intent to commit a felony listed in
263263 Paragraph (A) or (C);
264264 (E) a violation of Section 20.02 (Unlawful
265265 restraint), 20.03 (Kidnapping), or 20.04 (Aggravated kidnapping),
266266 Penal Code, if, as applicable:
267267 (i) the judgment in the case contains an
268268 affirmative finding under Article 42.015; or
269269 (ii) the order in the hearing or the papers
270270 in the case contain an affirmative finding that the victim or
271271 intended victim was younger than 17 years of age;
272272 (F) the second violation of Section 21.08
273273 (Indecent exposure), Penal Code, but not if the second violation
274274 results in a deferred adjudication;
275275 (G) an attempt, conspiracy, or solicitation, as
276276 defined by Chapter 15, Penal Code, to commit an offense or engage in
277277 conduct listed in Paragraph (A), (B), (C), (D), (E), or (K);
278278 (H) a violation of the laws of another state,
279279 federal law, the laws of a foreign country, or the Uniform Code of
280280 Military Justice for or based on the violation of an offense
281281 containing elements that are substantially similar to the elements
282282 of an offense listed under Paragraph (A), (B), (B-1), (C), (D), (E),
283283 (G), (J), or (K), but not if the violation results in a deferred
284284 adjudication;
285285 (I) the second violation of the laws of another
286286 state, federal law, the laws of a foreign country, or the Uniform
287287 Code of Military Justice for or based on the violation of an offense
288288 containing elements that are substantially similar to the elements
289289 of the offense of indecent exposure, but not if the second violation
290290 results in a deferred adjudication;
291291 (J) a violation of Section 33.021 (Online
292292 solicitation of a minor), Penal Code; or
293293 (K) a violation of Section 20A.02(a)(3), (4),
294294 (7), or (8) (Trafficking of persons), Penal Code.
295295 (6) "Sexually violent offense" means any of the
296296 following offenses committed by a person 17 years of age or older:
297297 (A) an offense under Section 21.02 (Continuous
298298 sexual abuse of young child or children), 21.11(a)(1) (Indecency
299299 with a child), 22.011 (Sexual assault), or 22.021 (Aggravated
300300 sexual assault), Penal Code;
301301 (B) an offense under Section 43.25 (Sexual
302302 performance by a child), Penal Code;
303303 (C) an offense under Section 20.04(a)(7)
304304 [20.04(a)(4)] (Aggravated kidnapping), Penal Code [, if the
305305 defendant committed the offense with intent to violate or abuse the
306306 victim sexually];
307307 (D) an offense under Section 30.02 (Burglary),
308308 Penal Code, if the offense is punishable under Subsection (d) of
309309 that section and the defendant committed the offense with intent to
310310 commit a felony listed in Paragraph (A) or (C) of Subdivision (5);
311311 or
312312 (E) an offense under the laws of another state,
313313 federal law, the laws of a foreign country, or the Uniform Code of
314314 Military Justice if the offense contains elements that are
315315 substantially similar to the elements of an offense listed under
316316 Paragraph (A), (B), (C), or (D).
317317 SECTION 8. Section 411.1471(a), Government Code, is amended
318318 to read as follows:
319319 (a) This section applies to a defendant who is:
320320 (1) indicted or waives indictment for a felony
321321 prohibited or punishable under any of the following Penal Code
322322 sections:
323323 (A) Section 20.04(a)(4) or (7);
324324 (B) Section 21.11;
325325 (C) Section 22.011;
326326 (D) Section 22.021;
327327 (E) Section 25.02;
328328 (F) Section 30.02(d);
329329 (G) Section 43.05;
330330 (H) Section 43.25;
331331 (I) Section 43.26;
332332 (J) Section 21.02; or
333333 (K) Section 20A.03;
334334 (2) arrested for a felony described by Subdivision (1)
335335 after having been previously convicted of or placed on deferred
336336 adjudication for an offense described by Subdivision (1) or an
337337 offense punishable under Section 30.02(c)(2), Penal Code; or
338338 (3) convicted of an offense:
339339 (A) under Title 5, Penal Code, other than an
340340 offense described by Subdivision (1), that is punishable as a Class
341341 A misdemeanor or any higher category of offense, except for an
342342 offense punishable as a Class A misdemeanor under Section 20.02,
343343 22.01, or 22.05, Penal Code; or
344344 (B) under Section 21.08, 25.04, 43.03, or 43.24,
345345 Penal Code.
346346 SECTION 9. Section 508.187(a), Government Code, is amended
347347 to read as follows:
348348 (a) This section applies only to a releasee serving a
349349 sentence for an offense under:
350350 (1) Section 43.25 or 43.26, Penal Code;
351351 (2) Section 21.02, 21.11, 22.011, 22.021, or 25.02,
352352 Penal Code;
353353 (3) Section 20.04(a)(7) [20.04(a)(4)], Penal Code [,
354354 if the releasee committed the offense with the intent to violate or
355355 abuse the victim sexually];
356356 (4) Section 30.02, Penal Code, punishable under
357357 Subsection (d) of that section, if the releasee committed the
358358 offense with the intent to commit a felony listed in Subdivision (2)
359359 or (3);
360360 (5) Section 43.05(a)(2), Penal Code; or
361361 (6) Section 20A.02, Penal Code, if the defendant:
362362 (A) trafficked the victim with the intent or
363363 knowledge that the victim would engage in sexual conduct, as
364364 defined by Section 43.25, Penal Code; or
365365 (B) benefited from participating in a venture
366366 that involved a trafficked victim engaging in sexual conduct, as
367367 defined by Section 43.25, Penal Code.
368368 SECTION 10. Section 841.002(8), Health and Safety Code, is
369369 amended to read as follows:
370370 (8) "Sexually violent offense" means:
371371 (A) an offense under Section 21.02, 21.11(a)(1),
372372 22.011, or 22.021, Penal Code;
373373 (B) an offense under Section 20.04(a)(7)
374374 [20.04(a)(4)], Penal Code [, if the person committed the offense
375375 with the intent to violate or abuse the victim sexually];
376376 (C) an offense under Section 30.02, Penal Code,
377377 if the offense is punishable under Subsection (d) of that section
378378 and the person committed the offense with the intent to commit an
379379 offense listed in Paragraph (A) or (B);
380380 (D) an offense under Section 19.02 or 19.03,
381381 Penal Code, that, during the guilt or innocence phase or the
382382 punishment phase for the offense, during the adjudication or
383383 disposition of delinquent conduct constituting the offense, or
384384 subsequently during a civil commitment proceeding under Subchapter
385385 D, is determined beyond a reasonable doubt to have been based on
386386 sexually motivated conduct;
387387 (E) an attempt, conspiracy, or solicitation, as
388388 defined by Chapter 15, Penal Code, to commit an offense listed in
389389 Paragraph (A), (B), (C), or (D);
390390 (F) an offense under prior state law that
391391 contains elements substantially similar to the elements of an
392392 offense listed in Paragraph (A), (B), (C), (D), or (E); or
393393 (G) an offense under the law of another state,
394394 federal law, or the Uniform Code of Military Justice that contains
395395 elements substantially similar to the elements of an offense listed
396396 in Paragraph (A), (B), (C), (D), or (E).
397397 SECTION 11. Section 12.42(c)(2), Penal Code, is amended to
398398 read as follows:
399399 (2) Notwithstanding Subdivision (1), a defendant
400400 shall be punished by imprisonment in the Texas Department of
401401 Criminal Justice for life if:
402402 (A) the defendant is convicted of an offense:
403403 (i) under Section 20A.02(a)(7) or (8),
404404 21.11(a)(1), 22.021, or 22.011 [, Penal Code];
405405 (ii) under Section 20.04(a)(7)
406406 [20.04(a)(4), Penal Code, if the defendant committed the offense
407407 with the intent to violate or abuse the victim sexually]; or
408408 (iii) under Section 30.02, [Penal Code,]
409409 punishable under Subsection (d) of that section, if the defendant
410410 committed the offense with the intent to commit a felony described
411411 by Subparagraph (i) or (ii) or a felony under Section 21.11 [, Penal
412412 Code]; and
413413 (B) the defendant has been previously convicted
414414 of an offense:
415415 (i) under Section 43.25 or 43.26 [, Penal
416416 Code], or [an offense] under Section 43.23 if[, Penal Code,]
417417 punishable under Subsection (h) of that section;
418418 (ii) under Section 20A.02(a)(7) or (8),
419419 21.02, 21.11, 22.011, 22.021, or 25.02 [, Penal Code];
420420 (iii) under Section 20.04(a)(7)
421421 [20.04(a)(4), Penal Code, if the defendant committed the offense
422422 with the intent to violate or abuse the victim sexually];
423423 (iv) under Section 30.02, [Penal Code,]
424424 punishable under Subsection (d) of that section, if the defendant
425425 committed the offense with the intent to commit a felony described
426426 by Subparagraph (ii) or (iii); or
427427 (v) under the laws of another state
428428 containing elements that are substantially similar to the elements
429429 of an offense listed in Subparagraph (i), (ii), (iii), or (iv).
430430 SECTION 12. Section 21.02(c), Penal Code, is amended to
431431 read as follows:
432432 (c) For purposes of this section, "act of sexual abuse"
433433 means any act that is a violation of one or more of the following
434434 penal laws:
435435 (1) aggravated kidnapping under Section 20.04(a)(7)
436436 [20.04(a)(4), if the actor committed the offense with the intent to
437437 violate or abuse the victim sexually];
438438 (2) indecency with a child under Section 21.11(a)(1),
439439 if the actor committed the offense in a manner other than by
440440 touching, including touching through clothing, the breast of a
441441 child;
442442 (3) sexual assault under Section 22.011;
443443 (4) aggravated sexual assault under Section 22.021;
444444 (5) burglary under Section 30.02, if the offense is
445445 punishable under Subsection (d) of that section and the actor
446446 committed the offense with the intent to commit an offense listed in
447447 Subdivisions (1)-(4);
448448 (6) sexual performance by a child under Section 43.25;
449449 (7) trafficking of persons under Section 20A.02(a)(7)
450450 or (8); and
451451 (8) compelling prostitution under Section
452452 43.05(a)(2).
453453 SECTION 13. The change in law made by this Act applies only
454454 to an offense committed on or after the effective date of this Act.
455455 An offense committed before the effective date of this Act is
456456 governed by the law in effect on the date the offense was committed,
457457 and the former law is continued in effect for that purpose. For
458458 purposes of this section, an offense was committed before the
459459 effective date of this Act if any element of the offense occurred
460460 before that date.
461461 SECTION 14. This Act takes effect September 1, 2017.
