55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to certain duties of the Department of Family and
88 Protective Services regarding parental child safety placements.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 264.904(d), Family Code, is amended to
1111 read as follows:
1212 (d) Before the department may close a case with a child
1313 still living in a parental child safety placement, the department
1414 must:
1515 (1) determine and document in the case file that the
1616 child can safely remain in the placement without the department's
1717 supervision;
1818 (2) obtain the written agreement of the parent or
1919 person who made the parental child safety placement, if possible;
2020 (3) obtain the caregiver's agreement in writing that
2121 the child can continue living in the placement after the department
2222 closes the case; [and]
2323 (4) develop a written plan for the child's care after
2424 the department closes the case;
2525 (5) ensure that the parent or person who made the
2626 parental child safety placement, if appropriate, and the caregiver
2727 have:
2828 (A) obtained any public benefits for which the
2929 child qualifies;
3030 (B) enrolled the child in school or made other
3131 arrangements relating to the child's education;
3232 (C) obtained health insurance for the child or
3333 made other arrangements relating to the child's medical care;
3434 (D) filed for or transferred to the caregiver any
3535 child support, social security income, or public benefits being
3636 paid on behalf of the child to the parent or other person who made
3737 the parental child safety placement;
3838 (E) obtained the following documents for the
3939 child:
4040 (i) the child's birth certificate;
4141 (ii) a social security card or a
4242 replacement social security card;
4343 (iii) a driver's license or personal
4444 identification card; and
4545 (iv) any other personal document the
4646 department determines appropriate; and
4747 (F) obtained any other resources necessary to
4848 care for the child; and
4949 (6) assist the parent or person who made the parental
5050 child safety placement, if appropriate, and the caregiver in
5151 complying with requirements described by Subdivision (5).
5252 SECTION 2. This Act takes effect September 1, 2017.
