| 12 | 12 | SECTION 1. Section 40.112, Natural Resources Code, is | |
| 13 | 13 | amended to read as follows: | |
| 14 | 14 | Sec. 40.112. ISSUANCE. On compliance with Sections 40.109 | |
| 15 | 15 | through 40.111 [of this code and on payment of the certificate | |
| 16 | 16 | application fee], the commissioner shall issue the applicant a | |
| 17 | 17 | discharge prevention and response certificate covering the | |
| 18 | 18 | terminal facility. | |
| 19 | 19 | SECTION 2. Section 40.110(e), Natural Resources Code, is | |
| 20 | 20 | repealed. | |
| 21 | 21 | SECTION 3. This Act takes effect September 1, 2017. |
