7 | 7 | | relating to providing the financial cost incurred by the Texas |

8 | 8 | | Education Agency as a result of providing educational services to |

9 | 9 | | persons who are not lawfully present in the United States. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter B, Chapter 7, Education Code, is |
---|
12 | 12 | | amended by adding Section 7.032 to read as follows: |
---|
13 | 13 | | Sec. 7.032. FINANCIAL COST RELATED TO ILLEGAL IMMIGRATION. |
---|
14 | 14 | | (a) Not later than the 30th day before the first day of each |
---|
15 | 15 | | regular legislative session, the agency, with assistance from the |
---|
16 | 16 | | comptroller, shall certify to the speaker of the house of |
---|
17 | 17 | | representatives, the lieutenant governor, the governor, and the |
---|
18 | 18 | | attorney general the financial cost to the agency incurred during |
---|
19 | 19 | | the preceding two-year period resulting from providing educational |
---|
20 | 20 | | services to persons who are not lawfully present in the United |
---|
21 | 21 | | States. |
---|
22 | 22 | | (b) The financial cost statement must include a separate |
---|
23 | 23 | | accounting for the costs to the agency incurred in specific |
---|
24 | 24 | | categories of agency spending as determined by the comptroller. |
---|
25 | 25 | | SECTION 2. This state recognizes that it is the |
---|
26 | 26 | | responsibility of the federal government to maintain the security |
---|
27 | 27 | | of the national border to prevent unlawful entry of persons and |
---|
28 | 28 | | finds that the federal government should reimburse this state for |
---|
29 | 29 | | this state's expenditures in providing educational services to |
---|
30 | 30 | | persons who are not lawfully present in the United States. |
---|
31 | 31 | | SECTION 3. This Act takes effect September 1, 2017. |
