55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to providing the financial cost incurred by the Texas
88 Education Agency as a result of providing educational services to
99 persons who are not lawfully present in the United States.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 7, Education Code, is
1212 amended by adding Section 7.032 to read as follows:
1313 Sec. 7.032. FINANCIAL COST RELATED TO ILLEGAL IMMIGRATION.
1414 (a) Not later than the 30th day before the first day of each
1515 regular legislative session, the agency, with assistance from the
1616 comptroller, shall certify to the speaker of the house of
1717 representatives, the lieutenant governor, the governor, and the
1818 attorney general the financial cost to the agency incurred during
1919 the preceding two-year period resulting from providing educational
2020 services to persons who are not lawfully present in the United
2121 States.
2222 (b) The financial cost statement must include a separate
2323 accounting for the costs to the agency incurred in specific
2424 categories of agency spending as determined by the comptroller.
2525 SECTION 2. This state recognizes that it is the
2626 responsibility of the federal government to maintain the security
2727 of the national border to prevent unlawful entry of persons and
2828 finds that the federal government should reimburse this state for
2929 this state's expenditures in providing educational services to
3030 persons who are not lawfully present in the United States.
3131 SECTION 3. This Act takes effect September 1, 2017.
