55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to accounting for costs incurred by the Texas Department
88 of Criminal Justice as a result of the presence in this state of
99 persons who are not lawfully present in the United States.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 493, Government Code, is amended by
1212 adding Section 493.0152 to read as follows:
1313 Sec. 493.0152. ACCOUNTING FOR COSTS OF ILLEGAL IMMIGRATION.
1414 (a) Not later than the 30th day before the first day of each regular
1515 legislative session, the department shall issue to the speaker of
1616 the house of representatives, the lieutenant governor, the
1717 governor, and the attorney general a report of the financial costs
1818 to the department incurred during the preceding two-year period
1919 that resulted from the presence in this state of persons who are not
2020 lawfully present in the United States.
2121 (b) The report must include a separate accounting for the
2222 costs to the department incurred in specific categories of spending
2323 as determined by the department.
2424 (c) On request of the department, the comptroller shall
2525 assist the department in preparing the report.
2626 SECTION 2. This state recognizes that it is the
2727 responsibility of the federal government to maintain the security
2828 of the national border to prevent unlawful entry of persons and
2929 finds that the federal government should reimburse this state for
3030 expenditures by the Texas Department of Criminal Justice made
3131 necessary by the presence of persons in this state who are not
3232 lawfully present in the United States.
3333 SECTION 3. This Act takes effect September 1, 2017.
