| 8 | 8 | | of Criminal Justice as a result of the presence in this state of |

| 9 | 9 | | persons who are not lawfully present in the United States. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 493, Government Code, is amended by |
|---|
| 12 | 12 | | adding Section 493.0152 to read as follows: |
|---|
| 13 | 13 | | Sec. 493.0152. ACCOUNTING FOR COSTS OF ILLEGAL IMMIGRATION. |
|---|
| 14 | 14 | | (a) Not later than the 30th day before the first day of each regular |
|---|
| 15 | 15 | | legislative session, the department shall issue to the speaker of |
|---|
| 16 | 16 | | the house of representatives, the lieutenant governor, the |
|---|
| 17 | 17 | | governor, and the attorney general a report of the financial costs |
|---|
| 18 | 18 | | to the department incurred during the preceding two-year period |
|---|
| 19 | 19 | | that resulted from the presence in this state of persons who are not |
|---|
| 20 | 20 | | lawfully present in the United States. |
|---|
| 21 | 21 | | (b) The report must include a separate accounting for the |
|---|
| 22 | 22 | | costs to the department incurred in specific categories of spending |
|---|
| 23 | 23 | | as determined by the department. |
|---|
| 24 | 24 | | (c) On request of the department, the comptroller shall |
|---|
| 25 | 25 | | assist the department in preparing the report. |
|---|
| 26 | 26 | | SECTION 2. This state recognizes that it is the |
|---|
| 27 | 27 | | responsibility of the federal government to maintain the security |
|---|
| 28 | 28 | | of the national border to prevent unlawful entry of persons and |
|---|
| 29 | 29 | | finds that the federal government should reimburse this state for |
|---|
| 30 | 30 | | expenditures by the Texas Department of Criminal Justice made |
|---|
| 31 | 31 | | necessary by the presence of persons in this state who are not |
|---|
| 32 | 32 | | lawfully present in the United States. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect September 1, 2017. |
