97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Sections 552.221(b-1) and (b-2), Government
119 Code, are amended to read as follows:
1210 (b-1) In addition to the methods of production described by
1311 Subsection (b), an officer for public information for a
1412 governmental body [political subdivision of this state] complies
1513 with Subsection (a) by referring a requestor to an exact Internet
1614 location or uniform resource locator (URL) address on a website
1715 maintained by the governmental body [political subdivision] and
1816 accessible to the public if the requested information is
1917 identifiable and readily available on that website. If the person
2018 requesting the information prefers a manner other than access
2119 through the URL, the governmental body [political subdivision] must
2220 supply the information in the manner required by Subsection (b).
2321 (b-2) If an officer for public information for a
2422 governmental body [political subdivision] provides by e-mail an
2523 Internet location or uniform resource locator (URL) address as
2624 permitted by Subsection (b-1), the e-mail must contain a statement
2725 in a conspicuous font clearly indicating that the requestor may
2826 nonetheless access the requested information by inspection or
2927 duplication or by receipt through United States mail, as provided
3028 by Subsection (b).
3129 SECTION 2. The changes in law made by this Act apply only to
3230 a request for information that is received by a governmental body or
3331 an officer for public information on or after the effective date of
3432 this Act. A request for information that was received before the
3533 effective date of this Act is governed by the law in effect on the
3634 date the request was received, and the former law is continued in
3735 effect for that purpose.
3836 SECTION 3. This Act takes effect September 1, 2017.
