66 AN ACT
77 relating to requiring financial institutions to report the
88 suspected financial abuse of elderly persons; providing a civil and
99 criminal penalty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle Z, Title 3, Finance Code, is amended by
1212 adding Chapter 280 to read as follows:
1313 CHAPTER 280. REPORTING OF FINANCIAL ABUSE OF ELDERLY PERSONS
1414 Sec. 280.001. DEFINITIONS. (a) In this chapter:
1515 (1) "Adult protective services division" means the
1616 adult protective services division of the Department of Family and
1717 Protective Services.
1818 (2) "Elderly person" has the meaning assigned by
1919 Section 48.002, Human Resources Code.
2020 (3) "Finance commission" means the Finance Commission
2121 of Texas.
2222 (4) "Financial abuse" means the wrongful or negligent
2323 taking, appropriation, obtaining, retention, or use of or assisting
2424 in the wrongful or negligent taking, appropriation, obtaining,
2525 retention, or use of the property of an elderly person by any means,
2626 including by exerting undue influence. The term includes financial
2727 exploitation.
2828 (5) "Financial exploitation" means the wrongful or
2929 negligent taking, appropriation, obtaining, retention, or use of
3030 the money or other property of an elderly person by a person who has
3131 a relationship of confidence or trust with the elderly person.
3232 Financial exploitation may involve coercion, manipulation,
3333 threats, intimidation, misrepresentation, or the exerting of undue
3434 influence. The term includes:
3535 (A) the breach of a fiduciary relationship,
3636 including the misuse of a durable power of attorney or the abuse of
3737 guardianship powers, that results in the unauthorized
3838 appropriation, sale, or transfer of the elderly person's property;
3939 (B) the unauthorized taking of personal assets;
4040 (C) the misappropriation, misuse, or
4141 unauthorized transfer of the elderly person's money from a personal
4242 or a joint account; and
4343 (D) the negligent or intentional failure to
4444 effectively use the elderly person's income and assets for the
4545 necessities required for the elderly person's support and
4646 maintenance.
4747 (6) "Financial institution" has the meaning assigned
4848 by Section 277.001.
4949 (7) "Financial regulatory officials" means the
5050 banking commissioner of Texas, the savings and mortgage lending
5151 commissioner, and the credit union commissioner.
5252 (b) For purposes of Subsection (a)(5), a person has a
5353 relationship of confidence or trust with an elderly person if the
5454 person:
5555 (1) is a parent, spouse, adult child, or other
5656 relative by blood or marriage of the elderly person;
5757 (2) is a joint tenant or tenant-in-common with the
5858 elderly person;
5959 (3) has a legal or fiduciary relationship with the
6060 elderly person;
6161 (4) is a financial planner or investment professional
6262 who provides services to the elderly person; or
6363 (5) is a paid or unpaid caregiver of the elderly
6464 person.
6565 Sec. 280.002. REPORTING FINANCIAL ABUSE OF ELDERLY PERSONS.
6666 (a) Notwithstanding any other law, if an officer or employee of a
6767 financial institution has a good faith belief that financial abuse
6868 of an elderly person has occurred or is occurring, the financial
6969 institution shall:
7070 (1) subject to Subchapter B-1, Chapter 48, Human
7171 Resources Code, submit a report notifying the adult protective
7272 services division of the suspected financial abuse; and
7373 (2) notify the appropriate local law enforcement
7474 agency with jurisdiction over the municipality or county in which
7575 the elderly person resides of the suspected financial abuse for
7676 purposes of investigating and determining whether an offense under
7777 Section 32.53, Penal Code, or other law has occurred.
7878 (b) The report and notification required by Subsection (a)
7979 must be made:
8080 (1) by telephone or electronic means, not later than
8181 24 hours after the financial institution becomes aware of the
8282 suspected financial abuse; and
8383 (2) in writing, not later than the third business day
8484 after the date the financial institution becomes aware of the
8585 suspected financial abuse.
8686 (c) For purposes of Subsection (a), an officer's or
8787 employee's good faith belief must be acquired in connection with
8888 the provision of financial services by the financial institution to
8989 or on behalf of the elderly person and must be based on:
9090 (1) the officer's or employee's observation or
9191 knowledge of an incident of suspected financial abuse, if the
9292 officer or employee has direct contact with the elderly person; or
9393 (2) the presence of information indicating potential
9494 financial abuse during a review or approval process performed by
9595 the officer or employee in connection with the provision of
9696 financial services, if the officer or employee does not have direct
9797 contact with the elderly person but reviews or approves the elderly
9898 person's financial documents, records, or transactions.
9999 (d) Nothing in this section shall be construed to require a
100100 financial institution to investigate an allegation of financial
101101 abuse made by an elderly person or other person.
102102 Sec. 280.003. CONFIDENTIALITY OF INFORMATION. (a) Except
103103 as provided by Subsection (b), the following information is
104104 confidential and is not subject to disclosure to the public, except
105105 under court order:
106106 (1) the information contained in a report submitted or
107107 notification made under this chapter;
108108 (2) the name of the financial institution making the
109109 report or notification or the identity of the officers or employees
110110 described by Section 280.002(a); and
111111 (3) information provided by or submitted to a
112112 financial institution in connection with an investigation arising
113113 out of a report submitted or notification made under Section
114114 280.002.
115115 (b) Information that is confidential under Subsection (a)
116116 may be disclosed only:
117117 (1) to the adult protective services division or
118118 another state agency, a law enforcement agency, or the attorney
119119 general, in connection with the reporting of or an investigation of
120120 suspected financial abuse of the elderly person to whom the
121121 information pertains;
122122 (2) to, or as authorized by, the elderly person or the
123123 guardian of the elderly person, unless the financial institution
124124 suspects the guardian of financial abuse of the elderly person; or
125125 (3) as part of a civil or criminal action related to
126126 the reported financial abuse.
127127 (c) A person commits an offense if the person discloses
128128 information in violation of this section. An offense under this
129129 section is a Class C misdemeanor.
130130 Sec. 280.004. IMMUNITY FROM LIABILITY. A financial
131131 institution that is acting in good faith and that submits a report
132132 or makes a notification under this chapter is immune from any
133133 criminal or civil liability arising from:
134134 (1) the report or notification; or
135135 (2) participation in any judicial proceeding arising
136136 from the report or notification.
137137 Sec. 280.005. CIVIL PENALTY. (a) A financial institution
138138 that fails to submit a report or make a notification in violation of
139139 this chapter is liable to this state for a civil penalty in an
140140 amount not to exceed $1,000, unless a court finds the violation to
141141 be wilful, in which case the amount of the civil penalty may not
142142 exceed $5,000.
143143 (b) The attorney general may bring an action on behalf of
144144 this state to recover a civil penalty under Subsection (a).
145145 Sec. 280.006. RULEMAKING. Subject to Section 48.072, Human
146146 Resources Code, the finance commission, the Credit Union
147147 Commission, and the executive commissioner of the Health and Human
148148 Services Commission, after consulting with the financial
149149 regulatory officials and the Department of Family and Protective
150150 Services, shall jointly adopt rules necessary to implement this
151151 chapter, including rules that require each financial institution to
152152 implement a training program to:
153153 (1) assist its officers and employees in recognizing
154154 signs of potential financial abuse of an elderly person; and
155155 (2) inform its officers and employees about the
156156 reporting and notification requirements of this chapter.
157157 SECTION 2. Section 59.006(a), Finance Code, is amended to
158158 read as follows:
159159 (a) This section provides the exclusive method for
160160 compelled discovery of a record of a financial institution relating
161161 to one or more customers but does not create a right of privacy in a
162162 record. This section does not apply to and does not require or
163163 authorize a financial institution to give a customer notice of:
164164 (1) a demand or inquiry from a state or federal
165165 government agency authorized by law to conduct an examination of
166166 the financial institution;
167167 (2) a record request from a state or federal
168168 government agency or instrumentality under statutory or
169169 administrative authority that provides for, or is accompanied by, a
170170 specific mechanism for discovery and protection of a customer
171171 record of a financial institution, including a record request from
172172 a federal agency subject to the Right to Financial Privacy Act of
173173 1978 (12 U.S.C. Section 3401 et seq.), as amended, or from the
174174 Internal Revenue Service under Section 1205, Internal Revenue Code
175175 of 1986;
176176 (3) a record request from or report to a government
177177 agency arising out of:
178178 (A) the investigation or prosecution of a
179179 criminal offense;
180180 (B) the investigation of alleged abuse, neglect,
181181 or exploitation of an elderly or disabled person or of alleged
182182 financial abuse of an elderly person in accordance with Chapter 48,
183183 Human Resources Code; or
184184 (C) the assessment for or provision of
185185 guardianship services under Subchapter E, Chapter 161, Human
186186 Resources Code;
187187 (4) a record request in connection with a garnishment
188188 proceeding in which the financial institution is garnishee and the
189189 customer is debtor;
190190 (5) a record request by a duly appointed receiver for
191191 the customer;
192192 (6) an investigative demand or inquiry from a state
193193 legislative investigating committee;
194194 (7) an investigative demand or inquiry from the
195195 attorney general of this state as authorized by law other than the
196196 procedural law governing discovery in civil cases;
197197 (8) the voluntary use or disclosure of a record by a
198198 financial institution subject to other applicable state or federal
199199 law; or
200200 (9) a record request in connection with an
201201 investigation conducted under Section 1054.151, 1054.152, or
202202 1102.001, Estates Code.
203203 SECTION 3. Subchapter A, Chapter 48, Human Resources Code,
204204 is amended by adding Section 48.008 to read as follows:
205205 Sec. 48.008. CONSOLIDATION OF CERTAIN REPORTS. If
206206 cost-effective and feasible, the executive commissioner by rule may
207207 consolidate the form and procedures used to submit a report under
208208 Sections 48.051 and 48.072.
209209 SECTION 4. Chapter 48, Human Resources Code, is amended by
210210 adding Subchapter B-1 to read as follows:
211211 SUBCHAPTER B-1. FINANCIAL ABUSE OF ELDERLY PERSONS
212212 Sec. 48.071. DEFINITIONS. In this subchapter, "financial
213213 abuse," "financial institution," and "financial regulatory
214214 officials" have the meanings assigned by Section 280.001, Finance
215215 Code.
216216 Sec. 48.072. CERTAIN REPORTS OF SUSPECTED FINANCIAL ABUSE.
217217 (a) The executive commissioner, after consultation with the
218218 financial regulatory officials, by rule shall prescribe the form
219219 and content of a report submitted by a financial institution under
220220 Section 280.002, Finance Code. A report submitted by a financial
221221 institution under Section 280.002, Finance Code, constitutes a
222222 report of suspected financial abuse of an elderly person for
223223 purposes of this subchapter.
224224 (b) In adopting rules under this section, the executive
225225 commissioner shall ensure that a report of suspected financial
226226 abuse of an elderly person described by Subsection (a) includes to
227227 the extent possible the same information required under Section
228228 48.051(d).
229229 (c) A financial institution that submits a report to the
230230 department of suspected financial abuse of an elderly person under
231231 Section 280.002, Finance Code, in accordance with this section
232232 satisfies the requirement of making a report of suspected abuse,
233233 neglect, or exploitation, as applicable, under Section 48.051, if
234234 applicable.
235235 Sec. 48.073. ASSESSMENT, INVESTIGATION, AND DISPOSITION OF
236236 REPORTS. The executive commissioner shall adopt rules regarding
237237 the assessment, investigation, and disposition of a report of
238238 suspected financial abuse of an elderly person received under
239239 Section 280.002, Finance Code. The executive commissioner shall
240240 model rules adopted under this section after the assessment,
241241 investigation, and disposition procedures used for reports of
242242 abuse, neglect, or exploitation received by the department under
243243 this chapter, other than a report received under Subchapter F, and
244244 shall include rules requiring:
245245 (1) a risk assessment similar to the assessment
246246 required under Section 48.004;
247247 (2) investigations similar to the investigations
248248 required under Subchapter D, including requirements that the
249249 department:
250250 (A) take action on a report within the timeframe
251251 and manner provided by Section 48.151;
252252 (B) perform an interview with the elderly person
253253 similar to the interview required by Section 48.152;
254254 (C) if appropriate, implement a system to
255255 investigate complex cases similar to the system implemented under
256256 Section 48.1521;
257257 (D) report criminal conduct to appropriate law
258258 enforcement agencies similar to Section 48.1522; and
259259 (E) review certain cases involving multiple
260260 reports under Section 48.051 and this subchapter similar to Section
261261 48.1523; and
262262 (3) a determination of services similar to the
263263 determination required by Section 48.202.
264264 Sec. 48.074. AUTHORITY OF DEPARTMENT OR OTHER AGENCY. The
265265 department or another appropriate state agency has the authority to
266266 act on or with respect to an allegation of financial abuse of an
267267 elderly person under this subchapter to the same extent the
268268 department or other agency has the authority to act on or with
269269 respect to an allegation of abuse, neglect, or exploitation under
270270 Subchapter B.
271271 Sec. 48.075. ACCESS TO INVESTIGATION. (a) To implement an
272272 investigation of reported financial abuse of an elderly person, the
273273 probate court, as defined by Section 22.007, Estates Code, may
274274 authorize entry of the place of residence of an elderly person.
275275 (b) A peace officer shall accompany and assist the person
276276 making a court-ordered entry under this section, if in the opinion
277277 of the court such action is necessary.
278278 Sec. 48.076. INTERFERENCE WITH INVESTIGATION OR SERVICES
279279 PROHIBITED. (a) Notwithstanding Section 1151.001, Estates Code, a
280280 person, including a guardian, may not interfere with:
281281 (1) an investigation by the department or by another
282282 protective services agency of suspected financial abuse of an
283283 elderly person; or
284284 (2) the provision of protective services to an elderly
285285 person.
286286 (b) The department or another protective services agency
287287 may petition the appropriate court to enjoin any interference with:
288288 (1) an investigation of suspected financial abuse of
289289 an elderly person under this subchapter; or
290290 (2) the provision of protective services such as
291291 removal of an elderly person to safer surroundings or safeguarding
292292 the person's resources from financial abuse.
293293 Sec. 48.077. MEMORANDUM OF UNDERSTANDING. The commission,
294294 the banking commissioner of Texas, the savings and mortgage lending
295295 commissioner, the credit union commissioner, and the department
296296 shall enter into a memorandum of understanding regarding the
297297 reporting and investigation of suspected financial abuse of an
298298 elderly person under this subchapter.
299299 Sec. 48.078. CONFIDENTIALITY. (a) All files, reports,
300300 records, communications, and working papers used or developed by
301301 the department or other state agency in an investigation made under
302302 this subchapter or in providing services as a result of an
303303 investigation are confidential and not subject to disclosure under
304304 Chapter 552, Government Code.
305305 (b) The department or investigating state agency may
306306 establish procedures to exchange with another state agency or
307307 governmental entity information that is necessary for the
308308 department, state agency, or entity to properly execute its
309309 respective duties and responsibilities to provide services to
310310 elderly persons under this chapter or other law. An exchange of
311311 information under this subsection does not affect whether the
312312 information is subject to disclosure under Chapter 552, Government
313313 Code.
314314 SECTION 5. Subchapter C, Chapter 48, Human Resources Code,
315315 is amended by adding Section 48.104 to read as follows:
316316 Sec. 48.104. APPLICABILITY. (a) This subchapter does not
317317 apply to a report of financial abuse of an elderly person made under
318318 Subchapter B-1.
319319 (b) The confidentiality of information received or provided
320320 by the department in connection with a report of financial abuse of
321321 an elderly person made under Subchapter B-1 is governed by Section
322322 48.078 and by Section 280.003, Finance Code.
323323 SECTION 6. Subchapter D, Chapter 48, Human Resources Code,
324324 is amended by adding Section 48.1511 to read as follows:
325325 Sec. 48.1511. APPLICABILITY. This subchapter does not
326326 apply to an investigation conducted under Subchapter B-1 unless the
327327 executive commissioner by rule requires the application of a
328328 provision of this subchapter.
329329 SECTION 7. This Act takes effect September 1, 2017.
