7 | 7 | | relating to the biennial report to the legislature on grants made to |

8 | 8 | | entities under the Texas Enterprise Fund. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 481.079, Government Code, is amended by |
---|
11 | 11 | | amending Subsection (a) and adding Subsection (a-2) to read as |
---|
12 | 12 | | follows: |
---|
13 | 13 | | (a) Before the beginning of each regular session of the |
---|
14 | 14 | | legislature, the governor shall submit to the lieutenant governor, |
---|
15 | 15 | | the speaker of the house of representatives, and each other member |
---|
16 | 16 | | of the legislature a report on grants made under Section 481.078 |
---|
17 | 17 | | that states: |
---|
18 | 18 | | (1) the number of direct jobs each recipient committed |
---|
19 | 19 | | to create in this state; |
---|
20 | 20 | | (2) the number of direct jobs each recipient created |
---|
21 | 21 | | in this state; |
---|
22 | 22 | | (3) the median wage of the jobs each recipient created |
---|
23 | 23 | | in this state; |
---|
24 | 24 | | (4) the amount of capital investment each recipient |
---|
25 | 25 | | committed to expend or allocate per project in this state; |
---|
26 | 26 | | (5) the amount of capital investment each recipient |
---|
27 | 27 | | expended or allocated per project in this state; |
---|
28 | 28 | | (6) the total amount of grants made to each recipient; |
---|
29 | 29 | | (7) the average amount of money granted in this state |
---|
30 | 30 | | for each job created in this state by grant recipients; |
---|
31 | 31 | | (8) the number of jobs created in this state by grant |
---|
32 | 32 | | recipients in each sector of the North American Industry |
---|
33 | 33 | | Classification System (NAICS); [and] |
---|
34 | 34 | | (9) of the number of direct jobs each recipient |
---|
35 | 35 | | created in this state, the number of positions created that provide |
---|
36 | 36 | | health benefits for employees; and |
---|
37 | 37 | | (10) the total number of grant recipients that are |
---|
38 | 38 | | historically underutilized businesses and the total amount of |
---|
39 | 39 | | grants made to those recipients. |
---|
40 | 40 | | (a-2) For purposes of Subsection (a)(10): |
---|
41 | 41 | | (1) "Historically underutilized business" means: |
---|
42 | 42 | | (A) a corporation formed for the purpose of |
---|
43 | 43 | | making a profit in which 51 percent or more of all classes of the |
---|
44 | 44 | | shares of stock or other equitable securities are owned by one or |
---|
45 | 45 | | more economically disadvantaged persons who have a proportionate |
---|
46 | 46 | | interest and actively participate in the corporation's control, |
---|
47 | 47 | | operation, and management; |
---|
48 | 48 | | (B) a sole proprietorship created for the purpose |
---|
49 | 49 | | of making a profit that is completely owned, operated, and |
---|
50 | 50 | | controlled by an economically disadvantaged person; |
---|
51 | 51 | | (C) a partnership formed for the purpose of |
---|
52 | 52 | | making a profit in which 51 percent or more of the assets and |
---|
53 | 53 | | interest in the partnership are owned by one or more economically |
---|
54 | 54 | | disadvantaged persons who have a proportionate interest and |
---|
55 | 55 | | actively participate in the partnership's control, operation, and |
---|
56 | 56 | | management; or |
---|
57 | 57 | | (D) a joint venture in which each entity in the |
---|
58 | 58 | | venture is a historically underutilized business, as determined |
---|
59 | 59 | | under another paragraph of this subdivision. |
---|
60 | 60 | | (2) "Economically disadvantaged person" has the |
---|
61 | 61 | | meaning assigned by Section 2161.001. |
---|
62 | 62 | | SECTION 2. This Act takes effect September 1, 2017. |
