55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the biennial report to the legislature on grants made to
88 entities under the Texas Enterprise Fund.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 481.079, Government Code, is amended by
1111 amending Subsection (a) and adding Subsection (a-2) to read as
1212 follows:
1313 (a) Before the beginning of each regular session of the
1414 legislature, the governor shall submit to the lieutenant governor,
1515 the speaker of the house of representatives, and each other member
1616 of the legislature a report on grants made under Section 481.078
1717 that states:
1818 (1) the number of direct jobs each recipient committed
1919 to create in this state;
2020 (2) the number of direct jobs each recipient created
2121 in this state;
2222 (3) the median wage of the jobs each recipient created
2323 in this state;
2424 (4) the amount of capital investment each recipient
2525 committed to expend or allocate per project in this state;
2626 (5) the amount of capital investment each recipient
2727 expended or allocated per project in this state;
2828 (6) the total amount of grants made to each recipient;
2929 (7) the average amount of money granted in this state
3030 for each job created in this state by grant recipients;
3131 (8) the number of jobs created in this state by grant
3232 recipients in each sector of the North American Industry
3333 Classification System (NAICS); [and]
3434 (9) of the number of direct jobs each recipient
3535 created in this state, the number of positions created that provide
3636 health benefits for employees; and
3737 (10) the total number of grant recipients that are
3838 historically underutilized businesses and the total amount of
3939 grants made to those recipients.
4040 (a-2) For purposes of Subsection (a)(10):
4141 (1) "Historically underutilized business" means:
4242 (A) a corporation formed for the purpose of
4343 making a profit in which 51 percent or more of all classes of the
4444 shares of stock or other equitable securities are owned by one or
4545 more economically disadvantaged persons who have a proportionate
4646 interest and actively participate in the corporation's control,
4747 operation, and management;
4848 (B) a sole proprietorship created for the purpose
4949 of making a profit that is completely owned, operated, and
5050 controlled by an economically disadvantaged person;
5151 (C) a partnership formed for the purpose of
5252 making a profit in which 51 percent or more of the assets and
5353 interest in the partnership are owned by one or more economically
5454 disadvantaged persons who have a proportionate interest and
5555 actively participate in the partnership's control, operation, and
5656 management; or
5757 (D) a joint venture in which each entity in the
5858 venture is a historically underutilized business, as determined
5959 under another paragraph of this subdivision.
6060 (2) "Economically disadvantaged person" has the
6161 meaning assigned by Section 2161.001.
6262 SECTION 2. This Act takes effect September 1, 2017.
