55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the eligibility of a person to serve on an appraisal
88 review board.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 6.412(a), Tax Code, is amended to read as
1111 follows:
1212 (a) An individual is ineligible to serve on an appraisal
1313 review board if the individual:
1414 (1) is related within the second degree by
1515 consanguinity or affinity, as determined under Chapter 573,
1616 Government Code, to an individual who is engaged in the business of
1717 appraising property for compensation for use in proceedings under
1818 this title or of representing property owners for compensation in
1919 proceedings under this title in the appraisal district for which
2020 the appraisal review board is established;
2121 (2) owns property on which delinquent taxes have been
2222 owed to a taxing unit for more than 60 days after the date the
2323 individual knew or should have known of the delinquency unless:
2424 (A) the delinquent taxes and any penalties and
2525 interest are being paid under an installment payment agreement
2626 under Section 33.02; or
2727 (B) a suit to collect the delinquent taxes is
2828 deferred or abated under Section 33.06 or 33.065; [or]
2929 (3) is related within the third degree by
3030 consanguinity or within the second degree by affinity, as
3131 determined under Chapter 573, Government Code, to a member of the
3232 appraisal district's board of directors; or
3333 (4) is related within the first degree by
3434 consanguinity or affinity, as determined under Chapter 573,
3535 Government Code, to a member of the appraisal review board,
3636 including an auxiliary appraisal review board member.
3737 SECTION 2. The change in law made by this Act does not
3838 affect the eligibility of a person serving on an appraisal review
3939 board immediately before the effective date of this Act to continue
4040 to serve on the board for the term to which the member was
4141 appointed.
4242 SECTION 3. This Act takes effect September 1, 2017.
