| 7 | 7 | | relating to the eligibility of a person to serve on an appraisal |

|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 6.412(a), Tax Code, is amended to read as |
|---|
| 11 | 11 | | follows: |
|---|
| 12 | 12 | | (a) An individual is ineligible to serve on an appraisal |
|---|
| 13 | 13 | | review board if the individual: |
|---|
| 14 | 14 | | (1) is related within the second degree by |
|---|
| 15 | 15 | | consanguinity or affinity, as determined under Chapter 573, |
|---|
| 16 | 16 | | Government Code, to an individual who is engaged in the business of |
|---|
| 17 | 17 | | appraising property for compensation for use in proceedings under |
|---|
| 18 | 18 | | this title or of representing property owners for compensation in |
|---|
| 19 | 19 | | proceedings under this title in the appraisal district for which |
|---|
| 20 | 20 | | the appraisal review board is established; |
|---|
| 21 | 21 | | (2) owns property on which delinquent taxes have been |
|---|
| 22 | 22 | | owed to a taxing unit for more than 60 days after the date the |
|---|
| 23 | 23 | | individual knew or should have known of the delinquency unless: |
|---|
| 24 | 24 | | (A) the delinquent taxes and any penalties and |
|---|
| 25 | 25 | | interest are being paid under an installment payment agreement |
|---|
| 26 | 26 | | under Section 33.02; or |
|---|
| 27 | 27 | | (B) a suit to collect the delinquent taxes is |
|---|
| 28 | 28 | | deferred or abated under Section 33.06 or 33.065; [or] |
|---|
| 29 | 29 | | (3) is related within the third degree by |
|---|
| 30 | 30 | | consanguinity or within the second degree by affinity, as |
|---|
| 31 | 31 | | determined under Chapter 573, Government Code, to a member of the |
|---|
| 32 | 32 | | appraisal district's board of directors; or |
|---|
| 33 | 33 | | (4) is related within the first degree by |
|---|
| 34 | 34 | | consanguinity or affinity, as determined under Chapter 573, |
|---|
| 35 | 35 | | Government Code, to a member of the appraisal review board, |
|---|
| 36 | 36 | | including an auxiliary appraisal review board member. |
|---|
| 37 | 37 | | SECTION 2. The change in law made by this Act does not |
|---|
| 38 | 38 | | affect the eligibility of a person serving on an appraisal review |
|---|
| 39 | 39 | | board immediately before the effective date of this Act to continue |
|---|
| 40 | 40 | | to serve on the board for the term to which the member was |
|---|
| 41 | 41 | | appointed. |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect September 1, 2017. |
