| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 32, Human Resources Code, |
|---|
| 11 | 11 | | is amended by adding Section 32.0249 to read as follows: |
|---|
| 12 | 12 | | Sec. 32.0249. MENTAL HEALTH SCREENINGS IN TEXAS HEALTH |
|---|
| 13 | 13 | | STEPS PROGRAM. The executive commissioner, in the rules governing |
|---|
| 14 | 14 | | the Texas Health Steps program, shall: |
|---|
| 15 | 15 | | (1) require that at least one mental health screening |
|---|
| 16 | 16 | | be provided under the program using one or more validated, |
|---|
| 17 | 17 | | standardized mental health screening tools to each recipient who is |
|---|
| 18 | 18 | | at least 12 years of age but younger than 19 years of age; |
|---|
| 19 | 19 | | (2) require the mental health screening described in |
|---|
| 20 | 20 | | Subdivision (1) to be conducted during a recipient's annual medical |
|---|
| 21 | 21 | | exam; |
|---|
| 22 | 22 | | (3) allow a provider to conduct a mental health |
|---|
| 23 | 23 | | screening using one or more validated, standardized mental health |
|---|
| 24 | 24 | | screening tools during each annual medical exam of a recipient |
|---|
| 25 | 25 | | described by Subdivision (1); and |
|---|
| 26 | 26 | | (4) only allow a provider to be reimbursed for |
|---|
| 27 | 27 | | conducting one mental health screening using one or more validated, |
|---|
| 28 | 28 | | standardized mental health screening tools during each annual |
|---|
| 29 | 29 | | medical exam of a recipient described by Subdivision (1). |
|---|
| 30 | 30 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 31 | 31 | | a state agency determines that a waiver or authorization from a |
|---|
| 32 | 32 | | federal agency is necessary for implementation of that provision, |
|---|
| 33 | 33 | | the agency affected by the provision shall request the waiver or |
|---|
| 34 | 34 | | authorization and may delay implementing that provision until the |
|---|
| 35 | 35 | | waiver or authorization is granted. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect September 1, 2017. |
