66 AN ACT
77 relating to certain mental health screenings under the Texas Health
88 Steps program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1111 is amended by adding Section 32.0249 to read as follows:
1212 Sec. 32.0249. MENTAL HEALTH SCREENINGS IN TEXAS HEALTH
1313 STEPS PROGRAM. The executive commissioner, in the rules governing
1414 the Texas Health Steps program, shall:
1515 (1) require that at least one mental health screening
1616 be provided under the program using one or more validated,
1717 standardized mental health screening tools to each recipient who is
1818 at least 12 years of age but younger than 19 years of age;
1919 (2) require the mental health screening described in
2020 Subdivision (1) to be conducted during a recipient's annual medical
2121 exam;
2222 (3) allow a provider to conduct a mental health
2323 screening using one or more validated, standardized mental health
2424 screening tools during each annual medical exam of a recipient
2525 described by Subdivision (1); and
2626 (4) only allow a provider to be reimbursed for
2727 conducting one mental health screening using one or more validated,
2828 standardized mental health screening tools during each annual
2929 medical exam of a recipient described by Subdivision (1).
3030 SECTION 2. If before implementing any provision of this Act
3131 a state agency determines that a waiver or authorization from a
3232 federal agency is necessary for implementation of that provision,
3333 the agency affected by the provision shall request the waiver or
3434 authorization and may delay implementing that provision until the
3535 waiver or authorization is granted.
3636 SECTION 3. This Act takes effect September 1, 2017.
