| 10 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 9 | | SECTION 1. Subchapter B, Chapter 223, Transportation Code, |
|---|
| 12 | 10 | | is amended by adding Section 223.051 to read as follows: |
|---|
| 13 | 11 | | Sec. 223.051. NOTIFICATION BY CERTAIN MUNICIPALITIES OF |
|---|
| 14 | 12 | | SCHEDULED EVENT. (a) This section applies only to a municipality |
|---|
| 15 | 13 | | that: |
|---|
| 16 | 14 | | (1) is partially located in three counties, two of |
|---|
| 17 | 15 | | which have a population of 1.8 million or more; |
|---|
| 18 | 16 | | (2) is primarily located in a county with a population |
|---|
| 19 | 17 | | of 1.8 million or more; and |
|---|
| 20 | 18 | | (3) has within its boundaries all or part of an |
|---|
| 21 | 19 | | international airport operated jointly by two municipalities. |
|---|
| 22 | 20 | | (b) A contract for an improvement to a segment of the state |
|---|
| 23 | 21 | | highway system must prohibit a contractor from temporarily closing |
|---|
| 24 | 22 | | the highway, including temporarily relocating or changing an |
|---|
| 25 | 23 | | entrance or exit ramp to or from the highway, on the date that an |
|---|
| 26 | 24 | | event is scheduled to be held in a municipality in which the |
|---|
| 27 | 25 | | improvement is being proposed if, not later than 180 days before the |
|---|
| 28 | 26 | | date the event is scheduled to be held, the municipality notifies |
|---|
| 29 | 27 | | the department and the contractor of the date. |
|---|
| 30 | 28 | | SECTION 2. Section 223.051, Transportation Code, as added |
|---|
| 31 | 29 | | by this Act, applies only to a contract entered into on or after the |
|---|
| 32 | 30 | | effective date of this Act. A contract entered into before the |
|---|
| 33 | 31 | | effective date of this Act is governed by the law in effect on the |
|---|
| 34 | 32 | | date the contract was entered into, and the former law is continued |
|---|
| 35 | 33 | | in effect for that purpose. |
|---|
| 36 | 34 | | SECTION 3. This Act takes effect September 1, 2017. |
