64 AN ACT
75 relating to prohibiting the temporary closure of segments of the
86 state highway system on days that certain scheduled events are
97 being held in certain municipalities.
108 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
119 SECTION 1. Subchapter B, Chapter 223, Transportation Code,
1210 is amended by adding Section 223.051 to read as follows:
1311 Sec. 223.051. NOTIFICATION BY CERTAIN MUNICIPALITIES OF
1412 SCHEDULED EVENT. (a) This section applies only to a municipality
1513 that:
1614 (1) is partially located in three counties, two of
1715 which have a population of 1.8 million or more;
1816 (2) is primarily located in a county with a population
1917 of 1.8 million or more; and
2018 (3) has within its boundaries all or part of an
2119 international airport operated jointly by two municipalities.
2220 (b) A contract for an improvement to a segment of the state
2321 highway system must prohibit a contractor from temporarily closing
2422 the highway, including temporarily relocating or changing an
2523 entrance or exit ramp to or from the highway, on the date that an
2624 event is scheduled to be held in a municipality in which the
2725 improvement is being proposed if, not later than 180 days before the
2826 date the event is scheduled to be held, the municipality notifies
2927 the department and the contractor of the date.
3028 SECTION 2. Section 223.051, Transportation Code, as added
3129 by this Act, applies only to a contract entered into on or after the
3230 effective date of this Act. A contract entered into before the
3331 effective date of this Act is governed by the law in effect on the
3432 date the contract was entered into, and the former law is continued
3533 in effect for that purpose.
3634 SECTION 3. This Act takes effect September 1, 2017.
