8	8	AN ACT
9	9	relating to compensation of certain justices and judges for
10	10	performing extrajudicial services.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 659.012, Government Code, is amended by
13	13	amending Subsection (a) and adding Subsection (a-1) to read as
14	14	follows:
15	15	(a) Notwithstanding Section 659.011 and except as provided
16	16	by Subsection (a-1):
17	17	(1) a judge of a district court is entitled to an
18	18	annual salary from the state of at least $125,000, except that the
19	19	combined salary of a district judge from state and county sources,
20	20	including compensation for any extrajudicial services performed on
21	21	behalf of the county, may not exceed the amount that is $5,000 less
22	22	than the salary provided for a justice of a court of appeals other
23	23	than a chief justice;
24	24	(2) a justice of a court of appeals other than the
25	25	chief justice is entitled to an annual salary from the state that is
26	26	equal to 110 percent of the salary of a district judge, except that
27	27	the combined salary of a justice of the court of appeals other than
28	28	the chief justice from all state and county sources, including
29	29	compensation for any extrajudicial services performed on behalf of
30	30	the county, may not exceed the amount that is $5,000 less than the
31	31	salary provided for a justice of the supreme court;
32	32	(3) a justice of the supreme court other than the chief
33	33	justice or a judge of the court of criminal appeals other than the
34	34	presiding judge is entitled to an annual salary from the state that
35	35	is equal to 120 percent of the salary of a district judge; and
36	36	(4) the chief justice or presiding judge of an
37	37	appellate court is entitled to an annual salary from the state that
38	38	is $2,500 more than the salary provided for the other justices or
39	39	judges of the court, except that the combined salary of the chief
40	40	justice of a court of appeals may not exceed the amount that is
41	41	$2,500 less than the salary provided for a justice of the supreme
42	42	court.
43	43	(a-1) This subsection applies only to a court located in a
44	44	county with a population of 1.8 million or more that is adjacent to
45	45	a county with a population of 2.2 million or more. Notwithstanding
46	46	Section 659.011 and Subsection (a):
47	47	(1) a judge of a district court is entitled to an
48	48	annual salary from the state of at least $125,000, except that the
49	49	combined salary of a district judge from state and county sources,
50	50	not including compensation for any extrajudicial services
51	51	performed on behalf of the county, may not exceed the amount that is
52	52	$5,000 less than the salary provided for a justice of a court of
53	53	appeals other than a chief justice; and
54	54	(2) a justice of a court of appeals other than the
55	55	chief justice is entitled to an annual salary from the state that is
56	56	equal to 110 percent of the salary of a district judge, except that
57	57	the combined salary of a justice of the court of appeals other than
58	58	the chief justice from all state and county sources, not including
59	59	compensation for any extrajudicial services performed on behalf of
60	60	the county, may not exceed the amount that is $5,000 less than the
61	61	salary provided for a justice of the supreme court.
62	62	SECTION 2. This Act takes effect September 1, 2017.
