99 relating to compensation of certain justices and judges for
1010 performing extrajudicial services.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 659.012, Government Code, is amended by
1313 amending Subsection (a) and adding Subsection (a-1) to read as
1414 follows:
1515 (a) Notwithstanding Section 659.011 and except as provided
1616 by Subsection (a-1):
1717 (1) a judge of a district court is entitled to an
1818 annual salary from the state of at least $125,000, except that the
1919 combined salary of a district judge from state and county sources,
2020 including compensation for any extrajudicial services performed on
2121 behalf of the county, may not exceed the amount that is $5,000 less
2222 than the salary provided for a justice of a court of appeals other
2323 than a chief justice;
2424 (2) a justice of a court of appeals other than the
2525 chief justice is entitled to an annual salary from the state that is
2626 equal to 110 percent of the salary of a district judge, except that
2727 the combined salary of a justice of the court of appeals other than
2828 the chief justice from all state and county sources, including
2929 compensation for any extrajudicial services performed on behalf of
3030 the county, may not exceed the amount that is $5,000 less than the
3131 salary provided for a justice of the supreme court;
3232 (3) a justice of the supreme court other than the chief
3333 justice or a judge of the court of criminal appeals other than the
3434 presiding judge is entitled to an annual salary from the state that
3535 is equal to 120 percent of the salary of a district judge; and
3636 (4) the chief justice or presiding judge of an
3737 appellate court is entitled to an annual salary from the state that
3838 is $2,500 more than the salary provided for the other justices or
3939 judges of the court, except that the combined salary of the chief
4040 justice of a court of appeals may not exceed the amount that is
4141 $2,500 less than the salary provided for a justice of the supreme
4242 court.
4343 (a-1) This subsection applies only to a court located in a
4444 county with a population of 1.8 million or more that is adjacent to
4545 a county with a population of 2.2 million or more. Notwithstanding
4646 Section 659.011 and Subsection (a):
4747 (1) a judge of a district court is entitled to an
4848 annual salary from the state of at least $125,000, except that the
4949 combined salary of a district judge from state and county sources,
5050 not including compensation for any extrajudicial services
5151 performed on behalf of the county, may not exceed the amount that is
5252 $5,000 less than the salary provided for a justice of a court of
5353 appeals other than a chief justice; and
5454 (2) a justice of a court of appeals other than the
5555 chief justice is entitled to an annual salary from the state that is
5656 equal to 110 percent of the salary of a district judge, except that
5757 the combined salary of a justice of the court of appeals other than
5858 the chief justice from all state and county sources, not including
5959 compensation for any extrajudicial services performed on behalf of
6060 the county, may not exceed the amount that is $5,000 less than the
6161 salary provided for a justice of the supreme court.
6262 SECTION 2. This Act takes effect September 1, 2017.
