9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. This Act may be cited as the State-Tribal |
---|
11 | 11 | | Collaboration Act. |
---|
12 | 12 | | SECTION 2. Subtitle E, Title 4, Government Code, is amended |
---|
13 | 13 | | by adding Chapter 471 to read as follows: |
---|
14 | 14 | | CHAPTER 471. STATE COLLABORATION WITH INDIAN TRIBES |
---|
15 | 15 | | Sec. 471.001. DEFINITIONS. In this chapter: |
---|
16 | 16 | | (1) "Indian tribe" means a federally recognized tribe, |
---|
17 | 17 | | band, pueblo, or community, located wholly or partially in this |
---|
18 | 18 | | state, whose members are eligible for funding and services from the |
---|
19 | 19 | | United States Bureau of Indian Affairs. |
---|
20 | 20 | | (2) "State agency" means an agency, department, |
---|
21 | 21 | | office, or other entity in the executive, legislative, or judicial |
---|
22 | 22 | | branch of state government and includes an institution of higher |
---|
23 | 23 | | education, as defined by Section 61.003, Education Code. |
---|
24 | 24 | | Sec. 471.002. ANNUAL MEETING. Not later than the last day |
---|
25 | 25 | | of the third quarter of each state fiscal year, the governor shall |
---|
26 | 26 | | meet with leaders of Indian tribes to address issues of mutual |
---|
27 | 27 | | concern. If the governor is unable to attend the meeting, the |
---|
28 | 28 | | governor may designate an employee of the governor's office, a |
---|
29 | 29 | | member of the legislature, or an employee of an appropriate state |
---|
30 | 30 | | agency to attend the meeting. |
---|
31 | 31 | | Sec. 471.003. NO CAUSE OF ACTION OR WAIVER OF IMMUNITY. |
---|
32 | 32 | | Nothing in this chapter creates a cause of action against a state |
---|
33 | 33 | | agency or waives state or tribal immunity. |
---|
34 | 34 | | SECTION 3. This Act takes effect immediately if it receives |
---|
35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
---|
36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
---|
38 | 38 | | Act takes effect September 1, 2017. |
