66 AN ACT
77 relating to state collaboration with federally recognized Indian
88 tribes.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. This Act may be cited as the State-Tribal
1111 Collaboration Act.
1212 SECTION 2. Subtitle E, Title 4, Government Code, is amended
1313 by adding Chapter 471 to read as follows:
1414 CHAPTER 471. STATE COLLABORATION WITH INDIAN TRIBES
1515 Sec. 471.001. DEFINITIONS. In this chapter:
1616 (1) "Indian tribe" means a federally recognized tribe,
1717 band, pueblo, or community, located wholly or partially in this
1818 state, whose members are eligible for funding and services from the
1919 United States Bureau of Indian Affairs.
2020 (2) "State agency" means an agency, department,
2121 office, or other entity in the executive, legislative, or judicial
2222 branch of state government and includes an institution of higher
2323 education, as defined by Section 61.003, Education Code.
2424 Sec. 471.002. ANNUAL MEETING. Not later than the last day
2525 of the third quarter of each state fiscal year, the governor shall
2626 meet with leaders of Indian tribes to address issues of mutual
2727 concern. If the governor is unable to attend the meeting, the
2828 governor may designate an employee of the governor's office, a
2929 member of the legislature, or an employee of an appropriate state
3030 agency to attend the meeting.
3131 Sec. 471.003. NO CAUSE OF ACTION OR WAIVER OF IMMUNITY.
3232 Nothing in this chapter creates a cause of action against a state
3333 agency or waives state or tribal immunity.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2017.
