55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the criminal consequences of engaging in certain
88 conduct with respect to a firearm silencer.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 46.05(a), Penal Code, is amended to read
1111 as follows:
1212 (a) A person commits an offense if the person intentionally
1313 or knowingly possesses, manufactures, transports, repairs, or
1414 sells:
1515 (1) any of the following items, unless the item is
1616 registered in the National Firearms Registration and Transfer
1717 Record maintained by the Bureau of Alcohol, Tobacco, Firearms and
1818 Explosives or classified as a curio or relic by the United States
1919 Department of Justice:
2020 (A) an explosive weapon;
2121 (B) a machine gun; or
2222 (C) a short-barrel firearm; [or
2323 [(D) a firearm silencer;]
2424 (2) knuckles;
2525 (3) armor-piercing ammunition;
2626 (4) a chemical dispensing device;
2727 (5) a zip gun; [or]
2828 (6) a tire deflation device; or
2929 (7) a firearm silencer, unless the firearm silencer is
3030 classified as a curio or relic by the United States Department of
3131 Justice or the actor otherwise possesses, manufactures,
3232 transports, repairs, or sells the firearm silencer in compliance
3333 with federal law.
3434 SECTION 2. The change in law made by this Act applies only
3535 to an offense committed on or after the effective date of this Act.
3636 An offense committed before the effective date of this Act is
3737 governed by the law in effect on the date the offense was committed,
3838 and the former law is continued in effect for that purpose. For
3939 purposes of this section, an offense was committed before the
4040 effective date of this Act if any element of the offense occurred
4141 before that date.
4242 SECTION 3. This Act takes effect September 1, 2017.
