66 AN ACT
77 relating to the regulation of temporary common worker employers.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 92, Labor Code, is repealed.
1010 SECTION 2. (a) An administrative proceeding pending under
1111 Chapter 51, Occupations Code, or Chapter 92, Labor Code, on the
1212 effective date of this Act related to a violation of Chapter 92,
1313 Labor Code, as that chapter existed immediately before the
1414 effective date of this Act, is dismissed.
1515 (b) An administrative penalty assessed by the Texas
1616 Commission of Licensing and Regulation or the executive director of
1717 the Texas Department of Licensing and Regulation related to a
1818 violation of Chapter 92, Labor Code, as that chapter existed
1919 immediately before the effective date of this Act, may be collected
2020 as provided by Chapter 51, Occupations Code.
2121 (c) The changes in law made by this Act do not affect the
2222 pending prosecution of an offense under Chapter 92, Labor Code, as
2323 that chapter existed immediately before the effective date of this
2424 Act. An offense committed before the effective date of this Act is
2525 governed by the law in effect on the date the offense was committed,
2626 and the former law is continued in effect for that purpose. For
2727 purposes of this subsection, an offense was committed before the
2828 effective date of this Act if any element of the offense was
2929 committed before that date.
3030 (d) The Texas Department of Licensing and Regulation shall
3131 return to a person who holds a valid license under Chapter 92, Labor
3232 Code, as that chapter existed immediately before the effective date
3333 of this Act, a prorated portion of the fee paid to the department
3434 for the issuance or renewal of the license.
3535 SECTION 3. This Act takes effect September 1, 2017.
