66 AN ACT
77 relating to an exemption from licensing requirements for physicians
88 associated with certain sports teams.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 151, Occupations Code, is
1111 amended by adding Section 151.0521 to read as follows:
1212 Sec. 151.0521. EXEMPTION FOR SPORTS TEAM PHYSICIAN. A
1313 person is exempt from the licensing requirements of this subtitle
1414 and may engage in the practice of medicine in this state if the
1515 person:
1616 (1) is employed or designated as a team physician by a
1717 sports team visiting this state for a specific sporting event;
1818 (2) is licensed to practice medicine in the team's home
1919 state; and
2020 (3) limits the person's practice of medicine in this
2121 state to treating, during the period beginning on the date the team
2222 arrives in this state for the event and ending on the 10th day after
2323 the date of the event:
2424 (A) the members, coaches, and staff of the team;
2525 and
2626 (B) a family member of a person described by
2727 Paragraph (A) if the family member is visiting this state for the
2828 event.
2929 SECTION 2. Section 451.003, Occupations Code, is amended to
3030 read as follows:
3131 Sec. 451.003. APPLICABILITY. This chapter does not apply
3232 to:
3333 (1) a physician licensed by the Texas Medical Board or
3434 engaged in the practice of medicine as authorized by Section
3535 151.0521;
3636 (2) a dentist, licensed under the laws of this state,
3737 engaged in the practice of dentistry;
3838 (3) a licensed optometrist or therapeutic optometrist
3939 engaged in the practice of optometry or therapeutic optometry as
4040 defined by statute;
4141 (4) an occupational therapist engaged in the practice
4242 of occupational therapy;
4343 (5) a nurse engaged in the practice of nursing;
4444 (6) a licensed podiatrist engaged in the practice of
4545 podiatry as defined by statute;
4646 (7) a physical therapist engaged in the practice of
4747 physical therapy;
4848 (8) a registered massage therapist engaged in the
4949 practice of massage therapy;
5050 (9) a commissioned or contract physician, physical
5151 therapist, or physical therapist assistant in the United States
5252 Army, Navy, Air Force, or Public Health Service; or
5353 (10) an athletic trainer who does not live in this
5454 state, who is licensed, registered, or certified by an authority
5555 recognized by the department, and who provides athletic training in
5656 this state for a period determined by the department.
5757 SECTION 3. This Act takes effect September 1, 2017.
