10 | 10 | SECTION 1. Title 4, Civil Practice and Remedies Code, is | |
11 | 11 | amended by adding Chapter 95A to read as follows: | |
12 | 12 | CHAPTER 95A. LIMITED LIABILITY FOR CERTAIN PROPERTY OWNERS WHO | |
13 | 13 | ALLOW HANDGUNS | |
14 | 14 | Sec. 95A.001. LIMITED LIABILITY FOR CERTAIN PROPERTY OWNERS | |
15 | 15 | WHO ALLOW HANDGUNS. (a) Except as provided by Subsection (b), an | |
16 | 16 | owner of property on which the carrying of a handgun is not | |
17 | 17 | otherwise unlawful is immune from civil liability with respect to | |
18 | 18 | any claim that is based on the property owner's failure to exercise | |
19 | 19 | the option to forbid the carrying of handguns on the property. | |
20 | 20 | (b) This section does not limit the liability of a property | |
21 | 21 | owner for any damage or injury that arises from a wilful or wanton | |
22 | 22 | act or gross negligence by the owner. | |
23 | 23 | SECTION 2. Chapter 95A, Civil Practice and Remedies Code, | |
24 | 24 | as added by this Act, does not apply to a cause of action that | |
25 | 25 | accrued before the effective date of this Act. A cause of action | |
26 | 26 | that accrued before the effective date of this Act is governed by | |
27 | 27 | the law applicable to the cause of action immediately before that | |
28 | 28 | date, and the former law is continued in effect for that purpose. | |
29 | 29 | SECTION 3. This Act takes effect September 1, 2017. |
