77 relating to the liability of a property owner who allows handguns to
88 be carried on the owner's property.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 4, Civil Practice and Remedies Code, is
1111 amended by adding Chapter 95A to read as follows:
1212 CHAPTER 95A. LIMITED LIABILITY FOR CERTAIN PROPERTY OWNERS WHO
1313 ALLOW HANDGUNS
1414 Sec. 95A.001. LIMITED LIABILITY FOR CERTAIN PROPERTY OWNERS
1515 WHO ALLOW HANDGUNS. (a) Except as provided by Subsection (b), an
1616 owner of property on which the carrying of a handgun is not
1717 otherwise unlawful is immune from civil liability with respect to
1818 any claim that is based on the property owner's failure to exercise
1919 the option to forbid the carrying of handguns on the property.
2020 (b) This section does not limit the liability of a property
2121 owner for any damage or injury that arises from a wilful or wanton
2222 act or gross negligence by the owner.
2323 SECTION 2. Chapter 95A, Civil Practice and Remedies Code,
2424 as added by this Act, does not apply to a cause of action that
2525 accrued before the effective date of this Act. A cause of action
2626 that accrued before the effective date of this Act is governed by
2727 the law applicable to the cause of action immediately before that
2828 date, and the former law is continued in effect for that purpose.
2929 SECTION 3. This Act takes effect September 1, 2017.
