66 AN ACT
77 relating to municipal voting rights and eligibility for municipal
88 office of residents in areas subject to limited-purpose annexation
99 under strategic partnership agreements.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 43.0751, Local Government Code, is
1212 amended by amending Subsection (q) and adding Subsection (q-1) to
1313 read as follows:
1414 (q) The qualified voters of a district annexed for limited
1515 purposes under a strategic partnership agreement are entitled to
1616 vote in municipal elections as provided by Section 43.130(a) in the
1717 same manner as qualified voters of any other area annexed for
1818 limited purposes, and that subsection applies to a limited-purpose
1919 annexation under a strategic partnership agreement. Residents of a
2020 district annexed for limited purposes under a strategic partnership
2121 agreement are not eligible to be a candidate for or to be elected to
2222 a municipal office as provided by Section 43.130(b).
2323 (q-1) Except as provided by Subsection (q) [for Sections
2424 43.130(a) and (b)], Subchapter F does not apply to a
2525 limited-purpose annexation under a strategic partnership
2626 agreement.
2727 SECTION 2. The change in law made by this Act is intended
2828 only to clarify existing law with respect to the municipal voting
2929 rights and eligibility for office of residents in areas subject to
3030 limited-purpose annexation under strategic partnership agreements.
3131 SECTION 3. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2017.
