9 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 8 | | SECTION 1. Section 504.053(e), Labor Code, is amended to |
---|
11 | 9 | | read as follows: |
---|
12 | 10 | | (e) Nothing in this chapter waives sovereign immunity or |
---|
13 | 11 | | creates a new cause of action, except that a political subdivision |
---|
14 | 12 | | that self-insures either individually or collectively is liable for |
---|
15 | 13 | | attorney's fees as provided by Section 417.003. |
---|
16 | 14 | | SECTION 2. Section 504.053, Labor Code, as amended by this |
---|
17 | 15 | | Act, applies only to a third-party action under Chapter 417, Labor |
---|
18 | 16 | | Code, commenced on or after the effective date of this Act. A |
---|
19 | 17 | | third-party action under Chapter 417, Labor Code, commenced before |
---|
20 | 18 | | the effective date of this Act is governed by the law applicable to |
---|
21 | 19 | | the action immediately before the effective date of this Act, and |
---|
22 | 20 | | that law is continued in effect for that purpose. |

23 | 21 | | SECTION 3. This Act takes effect September 1, 2017. |
