64 AN ACT
75 relating to liability of certain political subdivisions in certain
86 workers' compensation actions.
97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Section 504.053(e), Labor Code, is amended to
119 read as follows:
1210 (e) Nothing in this chapter waives sovereign immunity or
1311 creates a new cause of action, except that a political subdivision
1412 that self-insures either individually or collectively is liable for
1513 attorney's fees as provided by Section 417.003.
1614 SECTION 2. Section 504.053, Labor Code, as amended by this
1715 Act, applies only to a third-party action under Chapter 417, Labor
1816 Code, commenced on or after the effective date of this Act. A
1917 third-party action under Chapter 417, Labor Code, commenced before
2018 the effective date of this Act is governed by the law applicable to
2119 the action immediately before the effective date of this Act, and
2220 that law is continued in effect for that purpose.
2321 SECTION 3. This Act takes effect September 1, 2017.
