| 9 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 8 | | SECTION 1. Section 1118.054, Special District Local Laws |
|---|
| 11 | 9 | | Code, is amended by amending Subsection (a) and adding Subsection |
|---|
| 12 | 10 | | (c) to read as follows: |
|---|
| 13 | 11 | | (a) If a vacancy occurs in the office of director, the |
|---|
| 14 | 12 | | remaining directors by majority [a unanimous] vote shall appoint a |
|---|
| 15 | 13 | | director for the unexpired term. |
|---|
| 16 | 14 | | (c) If the number of directors is reduced to fewer than |
|---|
| 17 | 15 | | three for any reason, the remaining directors shall immediately |
|---|
| 18 | 16 | | call a special election to fill the vacancies. If the remaining |
|---|
| 19 | 17 | | directors do not call the election, a district court, on |
|---|
| 20 | 18 | | application of a district voter or taxpayer, may order the |
|---|
| 21 | 19 | | directors to hold the election. |
|---|
| 22 | 20 | | SECTION 2. Section 1118.055, Special District Local Laws |
|---|
| 23 | 21 | | Code, is amended to read as follows: |
|---|
| 24 | 22 | | Sec. 1118.055. OFFICERS. The board shall elect from among |
|---|
| 25 | 23 | | its members a chairman, a vice-chairman, [president,] a secretary, |
|---|
| 26 | 24 | | and a treasurer at the first meeting after each directors' |
|---|
| 27 | 25 | | election. |
|---|
| 28 | 26 | | SECTION 3. Section 1118.207(a), Special District Local Laws |
|---|
| 29 | 27 | | Code, is amended to read as follows: |
|---|
| 30 | 28 | | (a) The board chairman [president] shall execute the |
|---|
| 31 | 29 | | district's bonds in the district's name. |
|---|
| 32 | 30 | | SECTION 4. This Act takes effect September 1, 2017. |
