108 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
119 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1210 Code, is amended by adding Chapter 7975 to read as follows:
1311 CHAPTER 7975. CRESSON MUNICIPAL UTILITY DISTRICT NO. 1 OF HOOD
1412 COUNTY
1513 SUBCHAPTER A. GENERAL PROVISIONS
1614 Sec. 7975.001. DEFINITIONS. In this chapter:
1715 (1) "Board" means the district's board of directors.
1816 (2) "Commission" means the Texas Commission on
1917 Environmental Quality.
2018 (3) "Director" means a board member.
2119 (4) "District" means the Cresson Municipal Utility
2220 District No. 1 of Hood County.
2321 Sec. 7975.002. NATURE OF DISTRICT. The district is a
2422 municipal utility district created under Section 59, Article XVI,
2523 Texas Constitution.
2624 Sec. 7975.003. CONFIRMATION AND DIRECTORS' ELECTION
2725 REQUIRED. The temporary directors shall hold an election to
2826 confirm the creation of the district and to elect five permanent
2927 directors as provided by Section 49.102, Water Code.
3028 Sec. 7975.004. CONSENT OF MUNICIPALITY REQUIRED. The
3129 temporary directors may not hold an election under Section 7975.003
3230 until each municipality in whose corporate limits or
3331 extraterritorial jurisdiction the district is located has
3432 consented by ordinance or resolution to the creation of the
3533 district and to the inclusion of land in the district.
3634 Sec. 7975.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3735 (a) The district is created to serve a public purpose and benefit.
3836 (b) The district is created to accomplish the purposes of:
3937 (1) a municipal utility district as provided by
4038 general law and Section 59, Article XVI, Texas Constitution; and
4139 (2) Section 52, Article III, Texas Constitution, that
4240 relate to the construction, acquisition, improvement, operation,
4341 or maintenance of macadamized, graveled, or paved roads, or
4442 improvements, including storm drainage, in aid of those roads.
4543 Sec. 7975.006. INITIAL DISTRICT TERRITORY. (a) The
4644 district is initially composed of the territory described by
4745 Section 2 of the Act enacting this chapter.
4846 (b) The boundaries and field notes contained in Section 2 of
4947 the Act enacting this chapter form a closure. A mistake made in the
5048 field notes or in copying the field notes in the legislative process
5149 does not affect the district's:
5250 (1) organization, existence, or validity;
5351 (2) right to issue any type of bond for the purposes
5452 for which the district is created or to pay the principal of and
5553 interest on a bond;
5654 (3) right to impose a tax; or
5755 (4) legality or operation.
5856 SUBCHAPTER B. BOARD OF DIRECTORS
5957 Sec. 7975.051. GOVERNING BODY; TERMS. (a) The district is
6058 governed by a board of five elected directors.
6159 (b) Except as provided by Section 7975.052, directors serve
6260 staggered four-year terms.
6361 Sec. 7975.052. TEMPORARY DIRECTORS. (a) On or after
6462 September 1, 2017, the owner or owners of a majority of the assessed
6563 value of the real property in the district may submit a petition to
6664 the commission requesting that the commission appoint as temporary
6765 directors the five persons named in the petition. The commission
6866 shall appoint as temporary directors the five persons named in the
6967 petition.
7068 (b) Temporary directors serve until the earlier of:
7169 (1) the date permanent directors are elected under
7270 Section 7975.003; or
7371 (2) September 1, 2021.
7472 (c) If permanent directors have not been elected under
7573 Section 7975.003 and the terms of the temporary directors have
7674 expired, successor temporary directors shall be appointed or
7775 reappointed as provided by Subsection (d) to serve terms that
7876 expire on the earlier of:
7977 (1) the date permanent directors are elected under
8078 Section 7975.003; or
8179 (2) the fourth anniversary of the date of the
8280 appointment or reappointment.
8381 (d) If Subsection (c) applies, the owner or owners of a
8482 majority of the assessed value of the real property in the district
8583 may submit a petition to the commission requesting that the
8684 commission appoint as successor temporary directors the five
8785 persons named in the petition. The commission shall appoint as
8886 successor temporary directors the five persons named in the
8987 petition.
9088 SUBCHAPTER C. POWERS AND DUTIES
9189 Sec. 7975.101. GENERAL POWERS AND DUTIES. The district has
9290 the powers and duties necessary to accomplish the purposes for
9391 which the district is created.
9492 Sec. 7975.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9593 DUTIES. The district has the powers and duties provided by the
9694 general law of this state, including Chapters 49 and 54, Water Code,
9795 applicable to municipal utility districts created under Section 59,
9896 Article XVI, Texas Constitution.
9997 Sec. 7975.103. AUTHORITY FOR ROAD PROJECTS. Under Section
10098 52, Article III, Texas Constitution, the district may design,
10199 acquire, construct, finance, issue bonds for, improve, operate,
102100 maintain, and convey to this state, a county, or a municipality for
103101 operation and maintenance macadamized, graveled, or paved roads, or
104102 improvements, including storm drainage, in aid of those roads.
105103 Sec. 7975.104. ROAD STANDARDS AND REQUIREMENTS. (a) A
106104 road project must meet all applicable construction standards,
107105 zoning and subdivision requirements, and regulations of each
108106 municipality in whose corporate limits or extraterritorial
109107 jurisdiction the road project is located.
110108 (b) If a road project is not located in the corporate limits
111109 or extraterritorial jurisdiction of a municipality, the road
112110 project must meet all applicable construction standards,
113111 subdivision requirements, and regulations of each county in which
114112 the road project is located.
115113 (c) If the state will maintain and operate the road, the
116114 Texas Transportation Commission must approve the plans and
117115 specifications of the road project.
118116 Sec. 7975.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
119117 OR RESOLUTION. The district shall comply with all applicable
120118 requirements of any ordinance or resolution that is adopted under
121119 Section 54.016 or 54.0165, Water Code, and that consents to the
122120 creation of the district or to the inclusion of land in the
123121 district.
124122 Sec. 7975.106. FIREFIGHTING SERVICES. Notwithstanding
125123 Section 49.351(a), Water Code, the district may, as authorized by
126124 Section 59(f), Article XVI, Texas Constitution, and Section 49.351,
127125 Water Code:
128126 (1) establish, operate, and maintain a fire
129127 department;
130128 (2) contract with another political subdivision for
131129 the joint operation of a fire department; or
132130 (3) contract with any other person to perform
133131 firefighting services in the district and may issue bonds and
134132 impose taxes to pay for the department and the activities.
135133 Sec. 7975.107. FEES AND CHARGES. (a) The district may
136134 adopt and enforce all necessary charges, mandatory fees, or
137135 rentals, in addition to taxes, for providing or making available
138136 any district facility or service, including firefighting
139137 activities provided under Section 7975.106.
140138 (b) To enforce payment of an unpaid fee or charge due to the
141139 district, on the request of the district, a retail public utility,
142140 as defined by Section 13.002, Water Code, providing water or sewer
143141 service to a customer in the district shall terminate the service.
144142 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
145143 Sec. 7975.151. ELECTIONS REGARDING TAXES OR BONDS.
146144 (a) The district may issue, without an election, bonds and other
147145 obligations secured by:
148146 (1) revenue other than ad valorem taxes; or
149147 (2) contract payments described by Section 7975.153.
150148 (b) The district must hold an election in the manner
151149 provided by Chapters 49 and 54, Water Code, to obtain voter approval
152150 before the district may impose an ad valorem tax or issue bonds
153151 payable from ad valorem taxes.
154152 (c) The district may not issue bonds payable from ad valorem
155153 taxes to finance a road project unless the issuance is approved by a
156154 vote of a two-thirds majority of the district voters voting at an
157155 election held for that purpose.
158156 Sec. 7975.152. OPERATION AND MAINTENANCE TAX. (a) If
159157 authorized at an election held under Section 7975.151, the district
160158 may impose an operation and maintenance tax on taxable property in
161159 the district in accordance with Section 49.107, Water Code.
162160 (b) The board shall determine the tax rate. The rate may not
163161 exceed the rate approved at the election.
164162 Sec. 7975.153. CONTRACT TAXES. (a) In accordance with
165163 Section 49.108, Water Code, the district may impose a tax other than
166164 an operation and maintenance tax and use the revenue derived from
167165 the tax to make payments under a contract after the provisions of
168166 the contract have been approved by a majority of the district voters
169167 voting at an election held for that purpose.
170168 (b) A contract approved by the district voters may contain a
171169 provision stating that the contract may be modified or amended by
172170 the board without further voter approval.
173171 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
174172 Sec. 7975.201. AUTHORITY TO ISSUE BONDS AND OTHER
175173 OBLIGATIONS. The district may issue bonds or other obligations
176174 payable wholly or partly from ad valorem taxes, impact fees,
177175 revenue, contract payments, grants, or other district money, or any
178176 combination of those sources, to pay for any authorized district
179177 purpose.
180178 Sec. 7975.202. TAXES FOR BONDS. At the time the district
181179 issues bonds payable wholly or partly from ad valorem taxes, the
182180 board shall provide for the annual imposition of a continuing
183181 direct ad valorem tax, without limit as to rate or amount, while all
184182 or part of the bonds are outstanding as required and in the manner
185183 provided by Sections 54.601 and 54.602, Water Code.
186184 Sec. 7975.203. BONDS FOR ROAD PROJECTS. At the time of
187185 issuance, the total principal amount of bonds or other obligations
188186 issued or incurred to finance road projects and payable from ad
189187 valorem taxes may not exceed one-fourth of the assessed value of the
190188 real property in the district.

467465 Sec. 7975.108. NO EMINENT DOMAIN POWER. The district may
