75 relating to the creation of the Kendall County Water Control and
86 Improvement District No. 3; granting a limited power of eminent
97 domain; providing authority to issue bonds; providing authority to
108 impose assessments, fees, and taxes.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Subtitle I, Title 6, Special District Local Laws
1311 Code, is amended by adding Chapter 9072 to read as follows:
1412 CHAPTER 9072. KENDALL COUNTY WATER CONTROL AND IMPROVEMENT
1513 DISTRICT NO. 3
1614 SUBCHAPTER A. GENERAL PROVISIONS
1715 Sec. 9072.001. DEFINITIONS. In this chapter:
1816 (1) "Board" means the district's board of directors.
1917 (2) "Commission" means the Texas Commission on
2018 Environmental Quality.
2119 (3) "Director" means a board member.
2220 (4) "District" means the Kendall County Water Control
2321 and Improvement District No. 3.
2422 Sec. 9072.002. NATURE OF DISTRICT. The district is a water
2523 control and improvement district created under Section 59, Article
2624 XVI, Texas Constitution.
2725 Sec. 9072.003. CONFIRMATION AND DIRECTORS' ELECTION
2826 REQUIRED. The temporary directors shall hold an election to
2927 confirm the creation of the district and to elect five permanent
3028 directors as provided by Section 49.102, Water Code.
3129 Sec. 9072.004. CONSENT OF MUNICIPALITY REQUIRED. The
3230 temporary directors may not hold an election under Section 9072.003
3331 until each municipality in whose corporate limits or
3432 extraterritorial jurisdiction the district is located has
3533 consented by ordinance or resolution to the creation of the
3634 district and to the inclusion of land in the district.
3735 Sec. 9072.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3836 (a) The district is created to serve a public purpose and benefit.
3937 (b) The district is created to accomplish the purposes of:
4038 (1) a water control and improvement district as
4139 provided by general law and Section 59, Article XVI, Texas
4240 Constitution; and
4341 (2) Section 52, Article III, Texas Constitution, that
4442 relate to the construction, acquisition, improvement, operation,
4543 or maintenance of macadamized, graveled, or paved roads, or
4644 improvements, including storm drainage, in aid of those roads.
4745 Sec. 9072.006. INITIAL DISTRICT TERRITORY. (a) The
4846 district is initially composed of the territory described by
4947 Section 2 of the Act enacting this chapter.
5048 (b) The boundaries and field notes contained in Section 2 of
5149 the Act enacting this chapter form a closure. A mistake made in the
5250 field notes or in copying the field notes in the legislative process
5351 does not affect the district's:
5452 (1) organization, existence, or validity;
5553 (2) right to issue any type of bond for the purposes
5654 for which the district is created or to pay the principal of and
5755 interest on a bond;
5856 (3) right to impose a tax; or
5957 (4) legality or operation.
6058 SUBCHAPTER B. BOARD OF DIRECTORS
6159 Sec. 9072.051. GOVERNING BODY; TERMS. (a) The district is
6260 governed by a board of five elected directors.
6361 (b) Except as provided by Section 9072.052, directors serve
6462 staggered four-year terms.
6563 Sec. 9072.052. TEMPORARY DIRECTORS. (a) The temporary
6664 board consists of:
6765 (1) R. Hunt Winton III;
6866 (2) Chad H. Foster Jr.;
6967 (3) David Sawtelle;
7068 (4) Craig Leeder; and
7169 (5) Zach Feller.
7270 (b) Temporary directors serve until the earlier of:
7371 (1) the date permanent directors are elected under
7472 Section 9072.003; or
7573 (2) the fourth anniversary of the effective date of
7674 the Act enacting this chapter.
7775 (c) If permanent directors have not been elected under
7876 Section 9072.003 and the terms of the temporary directors have
7977 expired, successor temporary directors shall be appointed or
8078 reappointed as provided by Subsection (d) to serve terms that
8179 expire on the earlier of:
8280 (1) the date permanent directors are elected under
8381 Section 9072.003; or
8482 (2) the fourth anniversary of the date of the
8583 appointment or reappointment.
8684 (d) If Subsection (c) applies, the owner or owners of a
8785 majority of the assessed value of the real property in the district
8886 may submit a petition to the commission requesting that the
8987 commission appoint as successor temporary directors the five
9088 persons named in the petition. The commission shall appoint as
9189 successor temporary directors the five persons named in the
9290 petition.
9391 SUBCHAPTER C. POWERS AND DUTIES
9492 Sec. 9072.101. GENERAL POWERS AND DUTIES. The district has
9593 the powers and duties necessary to accomplish the purposes for
9694 which the district is created.
9795 Sec. 9072.102. WATER CONTROL AND IMPROVEMENT DISTRICT
9896 POWERS AND DUTIES. The district has the powers and duties provided
9997 by the general law of this state, including Chapters 49 and 51,
10098 Water Code, applicable to water control and improvement districts
10199 created under Section 59, Article XVI, Texas Constitution.
102100 Sec. 9072.103. AUTHORITY FOR ROAD PROJECTS. Under Section
103101 52, Article III, Texas Constitution, the district may design,
104102 acquire, construct, finance, issue bonds for, improve, operate,
105103 maintain, and convey to this state, a county, or a municipality for
106104 operation and maintenance macadamized, graveled, or paved roads, or
107105 improvements, including storm drainage, in aid of those roads.
108106 Sec. 9072.104. ROAD STANDARDS AND REQUIREMENTS. (a) A
109107 road project must meet all applicable construction standards,
110108 zoning and subdivision requirements, and regulations of each
111109 municipality in whose corporate limits or extraterritorial
112110 jurisdiction the road project is located.
113111 (b) If a road project is not located in the corporate limits
114112 or extraterritorial jurisdiction of a municipality, the road
115113 project must meet all applicable construction standards, zoning and
116114 subdivision requirements, and regulations of each county in which
117115 the road project is located.
118116 (c) If the state will maintain and operate the road, the
119117 Texas Transportation Commission must approve the plans and
120118 specifications of the road project.
121119 Sec. 9072.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
122120 OR RESOLUTION. The district shall comply with all applicable
123121 requirements of any ordinance or resolution that is adopted under
124122 Section 42.042 or 42.0425, Local Government Code, and consents to
125123 the creation of the district or to the inclusion of land in the
126124 district.
127125 Sec. 9072.106. DIVISION OF DISTRICT. (a) The district may
128126 be divided into two or more new districts only if the district:
129127 (1) has no outstanding bonded debt; and
130128 (2) is not imposing ad valorem taxes.
131129 (b) This chapter applies to any new district created by the
132130 division of the district, and a new district has all the powers and
133131 duties of the district.
134132 (c) Any new district created by the division of the district
135133 may not, at the time the new district is created, contain any land
136134 outside the area described by Section 2 of the Act enacting this
137135 chapter.
138136 (d) The board, on its own motion or on receipt of a petition
139137 signed by the owner or owners of a majority of the assessed value of
140138 the real property in the district, may adopt an order dividing the
141139 district.
142140 (e) The board may adopt an order dividing the district
143141 before or after the date the board holds an election under Section
144142 9072.003 to confirm the district's creation.
145143 (f) An order dividing the district shall:
146144 (1) name each new district;
147145 (2) include the metes and bounds description of the
148146 territory of each new district;
149147 (3) appoint temporary directors for each new district;
150148 and
151149 (4) provide for the division of assets and liabilities
152150 between or among the new districts.
153151 (g) On or before the 30th day after the date of adoption of
154152 an order dividing the district, the district shall file the order
155153 with the Texas Commission on Environmental Quality and record the
156154 order in the real property records of each county in which the
157155 district is located.
158156 (h) Any new district created by the division of the district
159157 shall hold a confirmation and directors' election as required by
160158 Section 9072.003.
161159 (i) Any new district created by the division of the district
162160 must hold an election as required by this chapter to obtain voter
163161 approval before the district may impose a maintenance tax or issue
164162 bonds payable wholly or partly from ad valorem taxes.
165163 Sec. 9072.107. LIMITATION ON USE OF EMINENT DOMAIN. The
166164 district may not exercise the power of eminent domain outside the
167165 district boundaries to acquire a site or easement for:
168166 (1) a recreational facility, as defined by Section
169167 49.462, Water Code; or
170168 (2) a road project authorized by Section 9072.103.
171169 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
172170 Sec. 9072.151. ELECTIONS REGARDING TAXES OR BONDS.
173171 (a) The district may issue, without an election, bonds and other
174172 obligations secured by:
175173 (1) revenue other than ad valorem taxes; or
176174 (2) contract payments described by Section 9072.153.
177175 (b) The district must hold an election in the manner
178176 provided by Chapters 49 and 51, Water Code, to obtain voter approval
179177 before the district may impose an ad valorem tax or issue bonds
180178 payable from ad valorem taxes.
181179 (c) The district may not issue bonds payable from ad valorem
182180 taxes to finance a road project unless the issuance is approved by a
183181 vote of a two-thirds majority of the district voters voting at an
184182 election held for that purpose.
185183 Sec. 9072.152. OPERATION AND MAINTENANCE TAX. (a) If
186184 authorized at an election held under Section 9072.151, the district
187185 may impose an operation and maintenance tax on taxable property in
188186 the district in accordance with Section 49.107, Water Code.
189187 (b) The board shall determine the tax rate. The rate may not
190188 exceed the rate approved at the election.
191189 Sec. 9072.153. CONTRACT TAXES. (a) In accordance with
192190 Section 49.108, Water Code, the district may impose a tax other than
193191 an operation and maintenance tax and use the revenue derived from
194192 the tax to make payments under a contract after the provisions of
195193 the contract have been approved by a majority of the district voters
196194 voting at an election held for that purpose.
197195 (b) A contract approved by the district voters may contain a
198196 provision stating that the contract may be modified or amended by
199197 the board without further voter approval.
200198 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
201199 Sec. 9072.201. AUTHORITY TO ISSUE BONDS AND OTHER
202200 OBLIGATIONS. The district may issue bonds or other obligations
203201 payable wholly or partly from ad valorem taxes, impact fees,
204202 revenue, contract payments, grants, or other district money, or any
205203 combination of those sources, to pay for any authorized district
206204 purpose.
207205 Sec. 9072.202. TAXES FOR BONDS. At the time the district
208206 issues bonds payable wholly or partly from ad valorem taxes, the
209207 board shall provide for the annual imposition of a continuing
210208 direct ad valorem tax, without limit as to rate or amount, while all
211209 or part of the bonds are outstanding as required and in the manner
212210 provided by Section 51.433, Water Code.
213211 Sec. 9072.203. BONDS FOR ROAD PROJECTS. At the time of
214212 issuance, the total principal amount of bonds or other obligations
215213 issued or incurred to finance road projects and payable from ad
216214 valorem taxes may not exceed one-fourth of the assessed value of the
217215 real property in the district.

219217 District No. 3 initially includes all the territory contained in

485483 under Section 59, Article XVI, Texas Constitution, and Chapter 313,

487485 (b) The governor, one of the required recipients, has
488486 submitted the notice and Act to the Texas Commission on
489487 Environmental Quality.
490488 (c) The Texas Commission on Environmental Quality has filed
491489 its recommendations relating to this Act with the governor, the
492490 lieutenant governor, and the speaker of the house of
493491 representatives within the required time.
494492 (d) All requirements of the constitution and laws of this
495493 state and the rules and procedures of the legislature with respect
496494 to the notice, introduction, and passage of this Act are fulfilled

498496 SECTION 4. (a) Section 9072.107, Special District Local
499497 Laws Code, as added by Section 1 of this Act, takes effect only if
500498 this Act receives a two-thirds vote of all the members elected to
501499 each house.
502500 (b) If this Act does not receive a two-thirds vote of all the
503501 members elected to each house, Subchapter C, Chapter 9072, Special
504502 District Local Laws Code, as added by Section 1 of this Act, is
505503 amended by adding Section 9072.107 to read as follows:
506504 Sec. 9072.107. NO EMINENT DOMAIN POWER. The district may
507505 not exercise the power of eminent domain.
508506 (c) This section is not intended to be an expression of a
509507 legislative interpretation of the requirements of Section 17(c),
510508 Article I, Texas Constitution.
511509 SECTION 5. This Act takes effect immediately if it receives
512510 a vote of two-thirds of all the members elected to each house, as
513511 provided by Section 39, Article III, Texas Constitution. If this
514512 Act does not receive the vote necessary for immediate effect, this
515513 Act takes effect September 1, 2017.
