64 AN ACT
75 relating to the establishment of the Tom Lea Trail.
86 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
97 SECTION 1. Subchapter A, Chapter 442, Government Code, is
108 amended by adding Section 442.019 to read as follows:
119 Sec. 442.019. TOM LEA TRAIL. (a) The commission shall
1210 develop a Tom Lea Trail program to commemorate the life and art of
1311 Tom Lea.
1412 (b) The program, at a minimum, shall include:
1513 (1) designation of locations that are historically
1614 significant to the life and art of Tom Lea;
1715 (2) adoption of an icon, symbol, or other identifying
1816 device to represent a designation under this section;
1917 (3) the use of the icon, symbol, or other identifying
2018 device in promoting tourism around this state by the commission and
2119 at locations designated under this section; and
2220 (4) the development of itineraries and maps to guide
2321 tourists to locations designated under this section.
2422 (c) The commission shall adopt:
2523 (1) eligibility criteria for a designation under this
2624 section; and
2725 (2) procedures to administer the program created under
2826 this section.
2927 (d) A historic marker or sign relating to the life and art of
3028 Tom Lea that is erected or maintained pursuant to the program
3129 adopted under this section must be located not more than five miles
3230 from a location designated under Subsection (b)(1).
3331 (e) The commission may, as necessary, enter into a
3432 memorandum of understanding with the Texas Economic Development and
3533 Tourism Office and the Texas Department of Transportation to
3634 implement this section.
3735 (f) The commission may solicit and accept gifts, grants, and
3836 other donations from any source to implement this section. The
3937 commission is not required to promote or market the Tom Lea Trail
4038 unless the commission receives funds raised from private entities
4139 for that purpose.
4240 (g) The following segments of highway shall constitute the
4341 Tom Lea Trail:
4442 (1) Interstate Highway 10 from its intersection with
4543 the northern municipal boundary of El Paso to its intersection with
4644 Interstate Highway 20;
4745 (2) Interstate Highway 20 from its intersection with
4846 Interstate Highway 10 to its intersection with the western
4947 municipal boundary of Sweetwater;
5048 (3) Interstate Highway 20 from its intersection with
5149 the eastern municipal boundary of Sweetwater to its intersection
5250 with U.S. Highway 277;
5351 (4) U.S. Highway 277 from its intersection with
5452 Interstate Highway 10 to its intersection with State Highway 114 in
5553 Seymour;
5654 (5) State Highway 114 from its intersection with U.S.
5755 Highway 277 in Seymour to its intersection with State Highway 199;
5856 (6) State Highway 199 from its intersection with U.S.
5957 Highway 281 to its intersection with Interstate Highway 30;
6058 (7) Interstate Highway 30 from its intersection with
6159 State Highway 199 to its intersection with Interstate Highway 35
6260 East in Dallas;
6361 (8) Interstate Highway 35 East from its intersection
6462 with Interstate Highway 30 in Dallas to its intersection with State
6563 Highway 6 outside of the southern municipal boundary of Waco;
6664 (9) State Highway 6 from its intersection with
6765 Interstate 35 East to its intersection with State Highway 30 in
6866 College Station;
6967 (10) State Highway 30 from its intersection with State
7068 Highway 6 in College Station to its intersection with Interstate
7169 Highway 45;
7270 (11) Interstate Highway 45 from its intersection with
7371 State Highway 30 to its terminus in Galveston;
7472 (12) State Highway 21 from its intersection with State
7573 Highway 6 to its intersection with U.S. Highway 290;
7674 (13) U.S. Highway 290 from its intersection with State
7775 Highway 21 to its intersection with the eastern municipal boundary
7876 of Austin;
7977 (14) U.S. Highway 290 from its intersection with the
8078 western municipal boundary of Austin to its intersection with the
8179 eastern municipal boundary of Fredericksburg;
8280 (15) U.S. Highway 290 from its intersection with the
8381 western municipal boundary of Fredericksburg to its intersection
8482 with Interstate Highway 10;
8583 (16) Interstate Highway 10 from its intersection with
8684 U.S. Highway 290:
8785 (A) west to its intersection with U.S. Highway
8886 385; and
8987 (B) east to its intersection with Interstate
9088 Highway 37;
9189 (17) U.S. Highway 385 from its intersection with
9290 Interstate Highway 10 to its intersection with the southern
9391 municipal boundary of Odessa;
9492 (18) Interstate Highway 37 from its intersection with
9593 Interstate Highway 10 to its intersection with U.S. Highway 77;
9694 (19) U.S. Highway 77 from its intersection with
9795 Interstate Highway 37 to its intersection with the northern
9896 municipal boundary of Kingsville;
9997 (20) U.S. Highway 77 from its intersection with the
10098 southern municipal boundary of Kingsville to its intersection with
10199 State Highway 285 in Riviera; and
102100 (21) State Highway 285 from its intersection with U.S.
103101 Highway 77 in Riviera to its intersection with the eastern
104102 municipal boundary of Hebbronville.
105103 (h) In this section, a reference to a municipal boundary
106104 means that boundary as it exists on September 1, 2017.
107105 (i) A designation of highway segments as the Tom Lea Trail
108106 may not be construed as a designation under the National Historic
109107 Preservation Act (54 U.S.C. Section 300101 et seq.).
110108 SECTION 2. This Act takes effect September 1, 2017.
