66 AN ACT
77 relating to health care liability insurance for certain long-term
88 care facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 242, Health and Safety
1111 Code, is amended by adding Section 242.0337 to read as follows:
1212 Sec. 242.0337. LIABILITY INSURANCE COVERAGE. (a) In this
1313 section:
1414 (1) "Governmental unit" has the meaning assigned by
1515 Section 101.001, Civil Practice and Remedies Code.
1616 (2) "Health care liability claim" has the meaning
1717 assigned by Section 74.001, Civil Practice and Remedies Code.
1818 (b) To hold a license under this chapter, an institution
1919 must maintain professional liability insurance coverage against
2020 the liability of the institution or the institution's employees for
2121 a health care liability claim.
2222 (c) The insurance coverage maintained by an institution
2323 under this section:
2424 (1) must provide coverage annually in the minimum
2525 amount of $300,000 per occurrence and $1 million aggregate, except
2626 as provided by Subsection (d);
2727 (2) must be written on an occurrence basis;
2828 (3) must be issued by:
2929 (A) an insurer authorized to write professional
3030 liability insurance in this state;
3131 (B) the Texas Medical Liability Insurance
3232 Underwriting Association established under Chapter 2203, Insurance
3333 Code; or
3434 (C) an eligible surplus lines insurer in
3535 accordance with Chapter 981, Insurance Code;
3636 (4) may not include the cost of defense of a claim
3737 under the coverage in the coverage's liability limit; and
3838 (5) must be in a form acceptable to the department.
3939 (d) For an institution owned and operated by a governmental
4040 unit, the insurance coverage maintained by the institution must
4141 provide coverage only to the extent of the governmental unit's
4242 liability under Section 101.023, Civil Practice and Remedies Code.
4343 (e) A management company that manages an institution owned
4444 by a governmental unit shall maintain professional liability
4545 insurance coverage against the liability of the management company
4646 or the company's employees for a health care liability claim as
4747 described by Subsections (c)(1)-(5). The coverage required by this
4848 subsection is in addition to the insurance coverage maintained by
4949 the institution under Subsection (b).
5050 (f) To the extent permitted by federal law and applicable
5151 state and federal rules, the cost of insurance coverage required to
5252 be maintained under this section is an allowable cost for
5353 reimbursement under the state Medicaid program.
5454 SECTION 2. This Act takes effect September 1, 2017.
