| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 815.003, Government Code, is amended by | |
| 11 | 11 | amending Subsection (b) and adding Subsection (b-1) to read as | |
| 12 | 12 | follows: | |
| 13 | 13 | (b) Two of the elected members [To be eligible to serve as an | |
| 14 | 14 | elected member] of the board[, a person] must be members [a member] | |
| 15 | 15 | of the retirement system and must hold positions [a position] that: | |
| 16 | 16 | (1) are [is] included in the employee class of | |
| 17 | 17 | membership; and | |
| 18 | 18 | (2) are [is] not with an agency or department with | |
| 19 | 19 | which another trustee holds a position. | |
| 20 | 20 | (b-1) The third elected member of the board must: | |
| 21 | 21 | (1) meet the requirements of Subsection (b); or | |
| 22 | 22 | (2) be a retiree. | |
| 23 | 23 | SECTION 2. The changes in law made by this Act apply only to | |
| 24 | 24 | an election of a member of the board of trustees of the Employees | |
| 25 | 25 | Retirement System of Texas that occurs on or after the effective | |
| 26 | 26 | date of this Act. | |
| 27 | 27 | SECTION 3. This Act takes effect September 1, 2017. |
