| 9 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 8 | | SECTION 1. Section 59.044, Property Code, is amended by |
|---|
| 11 | 9 | | adding Subsection (a-1) to read as follows: |
|---|
| 12 | 10 | | (a-1) For the purposes of Subsection (a)(5), the place of a |
|---|
| 13 | 11 | | sale is: |
|---|
| 14 | 12 | | (1) the physical address of the location of the sale if |
|---|
| 15 | 13 | | the sale is conducted at the self-service storage facility or a |
|---|
| 16 | 14 | | reasonably near public place; or |
|---|
| 17 | 15 | | (2) the address of the Internet website if the sale is |
|---|
| 18 | 16 | | conducted through an Internet website. |
|---|
| 19 | 17 | | SECTION 2. Section 59.045, Property Code, is amended to |
|---|
| 20 | 18 | | read as follows: |
|---|
| 21 | 19 | | Sec. 59.045. CONDUCT OF SALE. (a) A sale under this |
|---|
| 22 | 20 | | subchapter must be a public sale: |
|---|
| 23 | 21 | | (1) conducted at the self-service storage facility or |
|---|
| 24 | 22 | | a reasonably near public place; or |
|---|
| 25 | 23 | | (2) conducted through an Internet website accessible |
|---|
| 26 | 24 | | to the public. |
|---|
| 27 | 25 | | (b) The lessor must conduct the sale according to the terms |
|---|
| 28 | 26 | | specified in the notice advertising the sale and sell the property |
|---|
| 29 | 27 | | to the highest bidder. |
|---|
| 30 | 28 | | SECTION 3. This Act takes effect September 1, 2017. |
