| 11 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 8 | | SECTION 1. Section 52.095, Election Code, is amended to |
|---|
| 13 | 9 | | read as follows: |
|---|
| 14 | 10 | | Sec. 52.095. PROPOSITIONS. (a) Except as otherwise |
|---|
| 15 | 11 | | provided by law, the authority ordering an election in which more |
|---|
| 16 | 12 | | than one measure is to be voted on shall determine the order in |
|---|
| 17 | 13 | | which the propositions are to appear on the ballot. |
|---|
| 18 | 14 | | (b) Each political subdivision's proposition on the ballot |
|---|
| 19 | 15 | | shall be assigned a unique number or letter on the ballot as |
|---|
| 20 | 16 | | follows: |
|---|
| 21 | 17 | | (1) except as provided by Subdivision (2), for each |
|---|
| 22 | 18 | | proposition on the ballot, the authority ordering the election |
|---|
| 23 | 19 | | shall assign a letter of the alphabet to the measure that |
|---|
| 24 | 20 | | corresponds to its order on the ballot; and |
|---|
| 25 | 21 | | (2) for each proposition on the ballot to be voted on |
|---|
| 26 | 22 | | statewide, the authority ordering the election shall assign a |
|---|
| 27 | 23 | | number to the measure that corresponds to its order on the ballot. |
|---|
| 28 | 24 | | (c) Each proposition on the ballot must identify the name of |
|---|
| 29 | 25 | | the authority ordering the election on the measure. |
|---|
| 30 | 26 | | (d) The secretary of state shall prescribe procedures |
|---|
| 31 | 27 | | necessary to implement this section. |
|---|
| 32 | 28 | | SECTION 2. Subchapter A, Chapter 274, Election Code, is |
|---|
| 33 | 29 | | amended by adding Section 274.004 to read as follows: |
|---|
| 34 | 30 | | Sec. 274.004. PROPOSITION BALLOT ORDER. A proposed |
|---|
| 35 | 31 | | constitutional amendment must be placed on the ballot before all |
|---|
| 36 | 32 | | other propositions. |
|---|
| 37 | 33 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 38 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 37 | | Act takes effect September 1, 2017. |
