95 relating to the content and numbering of propositions on the
106 ballot.
117 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
128 SECTION 1. Section 52.095, Election Code, is amended to
139 read as follows:
1410 Sec. 52.095. PROPOSITIONS. (a) Except as otherwise
1511 provided by law, the authority ordering an election in which more
1612 than one measure is to be voted on shall determine the order in
1713 which the propositions are to appear on the ballot.
1814 (b) Each political subdivision's proposition on the ballot
1915 shall be assigned a unique number or letter on the ballot as
2016 follows:
2117 (1) except as provided by Subdivision (2), for each
2218 proposition on the ballot, the authority ordering the election
2319 shall assign a letter of the alphabet to the measure that
2420 corresponds to its order on the ballot; and
2521 (2) for each proposition on the ballot to be voted on
2622 statewide, the authority ordering the election shall assign a
2723 number to the measure that corresponds to its order on the ballot.
2824 (c) Each proposition on the ballot must identify the name of
2925 the authority ordering the election on the measure.
3026 (d) The secretary of state shall prescribe procedures
3127 necessary to implement this section.
3228 SECTION 2. Subchapter A, Chapter 274, Election Code, is
3329 amended by adding Section 274.004 to read as follows:
3430 Sec. 274.004. PROPOSITION BALLOT ORDER. A proposed
3531 constitutional amendment must be placed on the ballot before all
3632 other propositions.
3733 SECTION 3. This Act takes effect immediately if it receives
3834 a vote of two-thirds of all the members elected to each house, as
3935 provided by Section 39, Article III, Texas Constitution. If this
4036 Act does not receive the vote necessary for immediate effect, this
4137 Act takes effect September 1, 2017.
