64 AN ACT
75 relating to criminal offenses regarding the consumption or
86 possession of alcoholic beverages by a minor.
97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Section 106.04, Alcoholic Beverage Code, is
119 amended by adding Subsections (f), (g), and (h) to read as follows:
1210 (f) Except as provided by Subsection (g), Subsection (a)
1311 does not apply to a minor who reports the sexual assault of the
1412 minor or another person, or is the victim of a sexual assault
1513 reported by another person, to:
1614 (1) a health care provider treating the victim of the
1715 sexual assault;
1816 (2) an employee of a law enforcement agency, including
1917 an employee of a campus police department of an institution of
2018 higher education; or
2119 (3) the Title IX coordinator of an institution of
2220 higher education or another employee of the institution responsible
2321 for responding to reports of sexual assault.
2422 (g) A minor is entitled to raise the defense provided by
2523 Subsection (f) in the prosecution of an offense under this section
2624 only if the minor is in violation of this section at the time of the
2725 commission of a sexual assault that is:
2826 (1) reported by the minor under Subsection (f); or
2927 (2) committed against the minor and reported by
3028 another person under Subsection (f).
3129 (h) A minor who commits a sexual assault that is reported
3230 under Subsection (f) is not entitled to raise the defense provided
3331 by Subsection (f) in the prosecution of the minor for an offense
3432 under this section.
3533 SECTION 2. Section 106.05, Alcoholic Beverage Code, is
3634 amended by adding Subsections (e), (f), and (g) to read as follows:
3735 (e) Except as provided by Subsection (f), Subsection (a)
3836 does not apply to a minor who reports the sexual assault of the
3937 minor or another person, or is the victim of a sexual assault
4038 reported by another person, to:
4139 (1) a health care provider treating the victim of the
4240 sexual assault;
4341 (2) an employee of a law enforcement agency, including
4442 an employee of a campus police department of an institution of
4543 higher education; or
4644 (3) the Title IX coordinator of an institution of
4745 higher education or another employee of the institution responsible
4846 for responding to reports of sexual assault.
4947 (f) A minor is entitled to raise the defense provided by
5048 Subsection (e) in the prosecution of an offense under this section
5149 only if the minor is in violation of this section at the time of the
5250 commission of a sexual assault that is:
5351 (1) reported by the minor under Subsection (e); or
5452 (2) committed against the minor and reported by
5553 another person under Subsection (e).
5654 (g) A minor who commits a sexual assault that is reported
5755 under Subsection (e) is not entitled to raise the defense provided
5856 by Subsection (e) in the prosecution of the minor for an offense
5957 under this section.
6058 SECTION 3. The change in law made by this Act applies only
6159 to an offense committed on or after the effective date of this Act.
6260 An offense committed before the effective date of this Act is
6361 governed by the law in effect on the date the offense was committed,
6462 and the former law is continued in effect for that purpose. For
6563 purposes of this section, an offense was committed before the
6664 effective date of this Act if any element of the offense occurred
6765 before that date.
6866 SECTION 4. This Act takes effect September 1, 2017.
