| 7 | 7 | | relating to a grant program to support the enforcement of |
|---|
| 8 | 8 | | immigration law by a municipality or county. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 772, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 772.0073 to read as follows: |
|---|
| 12 | 12 | | Sec. 772.0073. ENFORCEMENT OF IMMIGRATION LAW GRANT |
|---|
| 13 | 13 | | PROGRAM. (a) In this section: |
|---|
| 14 | 14 | | (1) "Criminal justice division" means the criminal |
|---|
| 15 | 15 | | justice division established under Section 772.006. |
|---|
| 16 | 16 | | (2) "Immigration detainer request" means a federal |
|---|
| 17 | 17 | | government request to a local entity to maintain temporary custody |
|---|
| 18 | 18 | | of an alien. The term includes verbal and written requests, |
|---|
| 19 | 19 | | including a United States Department of Homeland Security Form |
|---|
| 20 | 20 | | I-247 document or a similar or successor form. |
|---|
| 21 | 21 | | (3) "Immigration laws" means the laws of this state or |
|---|
| 22 | 22 | | federal law relating to aliens, immigrants, or immigration, |
|---|
| 23 | 23 | | including the federal Immigration and Nationality Act (8 U.S.C. |
|---|
| 24 | 24 | | Section 1101 et seq.). |
|---|
| 25 | 25 | | (4) "Local entity" means a municipality or county. |
|---|
| 26 | 26 | | (b) The criminal justice division shall establish and |
|---|
| 27 | 27 | | administer a competitive grant program to provide financial |
|---|
| 28 | 28 | | assistance to a local entity to offset costs related to: |
|---|
| 29 | 29 | | (1) enforcing immigration laws; or |
|---|
| 30 | 30 | | (2) complying with, honoring, or fulfilling any |
|---|
| 31 | 31 | | immigration detainer request. |
|---|
| 32 | 32 | | (c) The criminal justice division shall establish: |
|---|
| 33 | 33 | | (1) eligibility criteria for grant applicants; |
|---|
| 34 | 34 | | (2) grant application procedures; |
|---|
| 35 | 35 | | (3) criteria for evaluating grant applications and |
|---|
| 36 | 36 | | awarding grants; |
|---|
| 37 | 37 | | (4) guidelines related to grant amounts; and |
|---|
| 38 | 38 | | (5) procedures for monitoring the use of a grant |
|---|
| 39 | 39 | | awarded under this section and ensuring compliance with any |
|---|
| 40 | 40 | | conditions of the grant. |
|---|
| 41 | 41 | | (d) The criminal justice division may use any revenue |
|---|
| 42 | 42 | | available for purposes of this section. |
|---|
| 43 | 43 | | SECTION 2. This Act takes effect September 1, 2017. |
