66 AN ACT
77 relating to a grant program to support the enforcement of
88 immigration law by a municipality or county.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 772, Government Code, is
1111 amended by adding Section 772.0073 to read as follows:
1212 Sec. 772.0073. ENFORCEMENT OF IMMIGRATION LAW GRANT
1313 PROGRAM. (a) In this section:
1414 (1) "Criminal justice division" means the criminal
1515 justice division established under Section 772.006.
1616 (2) "Immigration detainer request" means a federal
1717 government request to a local entity to maintain temporary custody
1818 of an alien. The term includes verbal and written requests,
1919 including a United States Department of Homeland Security Form
2020 I-247 document or a similar or successor form.
2121 (3) "Immigration laws" means the laws of this state or
2222 federal law relating to aliens, immigrants, or immigration,
2323 including the federal Immigration and Nationality Act (8 U.S.C.
2424 Section 1101 et seq.).
2525 (4) "Local entity" means a municipality or county.
2626 (b) The criminal justice division shall establish and
2727 administer a competitive grant program to provide financial
2828 assistance to a local entity to offset costs related to:
2929 (1) enforcing immigration laws; or
3030 (2) complying with, honoring, or fulfilling any
3131 immigration detainer request.
3232 (c) The criminal justice division shall establish:
3333 (1) eligibility criteria for grant applicants;
3434 (2) grant application procedures;
3535 (3) criteria for evaluating grant applications and
3636 awarding grants;
3737 (4) guidelines related to grant amounts; and
3838 (5) procedures for monitoring the use of a grant
3939 awarded under this section and ensuring compliance with any
4040 conditions of the grant.
4141 (d) The criminal justice division may use any revenue
4242 available for purposes of this section.
4343 SECTION 2. This Act takes effect September 1, 2017.
