1010 AN ACT
1111 relating to providing road district powers to the Wood Trace
1212 Municipal Utility District No. 3 of Montgomery County, Texas;
1313 providing authority to issue bonds.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1616 Code, is amended by adding Chapter 7965 to read as follows:
1717 CHAPTER 7965. WOOD TRACE MUNICIPAL UTILITY DISTRICT NO. 3 OF
1818 MONTGOMERY COUNTY, TEXAS
1919 SUBCHAPTER A. GENERAL PROVISIONS
2020 Sec. 7965.001. DEFINITION. In this chapter, "district"
2121 means the Wood Trace Municipal Utility District No. 3 of Montgomery
2222 County, Texas.
2323 Sec. 7965.002. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
2424 (a) The district is created to serve a public purpose and benefit.
2525 (b) The district is created to accomplish the purposes of:
2626 (1) a municipal utility district as provided by
2727 general law and Section 59, Article XVI, Texas Constitution; and
2828 (2) Section 52, Article III, Texas Constitution, that
2929 relate to the construction, acquisition, improvement, operation,
3030 or maintenance of macadamized, graveled, or paved roads, or
3131 improvements, including storm drainage, in aid of those roads.
3232 SUBCHAPTER B. POWERS AND DUTIES
3333 Sec. 7965.101. AUTHORITY FOR ROAD PROJECTS. Under Section
3434 52, Article III, Texas Constitution, the district may design,
3535 acquire, construct, finance, issue bonds for, improve, operate,
3636 maintain, and convey to this state, a county, or a municipality for
3737 operation and maintenance macadamized, graveled, or paved roads, or
3838 improvements, including storm drainage, in aid of those roads.
3939 Sec. 7965.102. ROAD STANDARDS AND REQUIREMENTS. (a) A
4040 road project must meet all applicable construction standards,
4141 zoning and subdivision requirements, and regulations of each
4242 municipality in whose corporate limits or extraterritorial
4343 jurisdiction the road project is located.
4444 (b) If a road project is not located in the corporate limits
4545 or extraterritorial jurisdiction of a municipality, the road
4646 project must meet all applicable construction standards,
4747 subdivision requirements, and regulations of each county in which
4848 the road project is located.
4949 (c) If the state will maintain and operate the road, the
5050 Texas Transportation Commission must approve the plans and
5151 specifications of the road project.
5252 SUBCHAPTER C. BONDS
5353 Sec. 7965.201. BONDS FOR ROAD PROJECTS. At the time of
5454 issuance, the total principal amount of bonds or other obligations
5555 issued or incurred to finance road projects and payable from ad
5656 valorem taxes may not exceed one-fourth of the assessed value of the
5757 real property in the district.
5858 SECTION 2. (a) The legal notice of the intention to
5959 introduce this Act, setting forth the general substance of this
6060 Act, has been published as provided by law, and the notice and a
6161 copy of this Act have been furnished to all persons, agencies,
6262 officials, or entities to which they are required to be furnished
6363 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
6464 Government Code.
6565 (b) The governor, one of the required recipients, has
6666 submitted the notice and Act to the Texas Commission on
6767 Environmental Quality.
6868 (c) The Texas Commission on Environmental Quality has filed
6969 its recommendations relating to this Act with the governor, the
7070 lieutenant governor, and the speaker of the house of
7171 representatives within the required time.
7272 (d) All requirements of the constitution and laws of this
7373 state and the rules and procedures of the legislature with respect
7474 to the notice, introduction, and passage of this Act are fulfilled
7575 and accomplished.
7676 SECTION 3. This Act takes effect immediately if it receives
7777 a vote of two-thirds of all the members elected to each house, as
7878 provided by Section 39, Article III, Texas Constitution. If this
7979 Act does not receive the vote necessary for immediate effect, this
8080 Act takes effect September 1, 2017.
