55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to peace officer enforcement of federal immigration law at
88 places of worship, hospitals, public schools, and courthouses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 2, Code of Criminal Procedure, is
1111 amended by adding Article 2.255 to read as follows:
1212 Art. 2.255. ENFORCEMENT OF FEDERAL IMMIGRATION LAW AT
1313 PLACES OF WORSHIP, HOSPITALS, PUBLIC SCHOOLS, AND COURTHOUSES. (a)
1414 A law enforcement agency or other governmental entity that employs
1515 a peace officer shall adopt and enforce a policy that prohibits the
1616 agency's or entity's peace officers from participating in the
1717 enforcement of federal laws relating to immigrants or immigration,
1818 including the federal Immigration and Nationality Act (8 U.S.C.
1919 Section 1101 et seq.), on the property of a place of worship,
2020 hospital, public school, including a public institution of higher
2121 education, or courthouse.
2222 (b) The attorney general, in consultation with agencies and
2323 entities described by Subsection (a), shall develop and publish a
2424 model policy on the attorney general's Internet website for the
2525 enforcement of federal immigration law at places of worship,
2626 hospitals, public schools, and courthouses to ensure that those
2727 facilities remain safe and accessible to all residents of this
2828 state regardless of immigration status.
2929 SECTION 2. This Act takes effect September 1, 2017.
