5	5	WHEREAS, House Bill No. 1500 has been adopted by the house of
6	6	representatives and the senate and is being prepared for
7	7	enrollment; and
8	8	WHEREAS, The bill contains technical errors that should be
9	9	corrected; now, therefore, be it
10	10	RESOLVED by the 85th Legislature of the State of Texas, That
11	11	the enrolling clerk of the house of representatives be instructed
12	12	to correct the enrolled version of House Bill No. 1500 by striking
13	13	Section 39.054(a-1), Education Code, as amended in both places by
14	14	the bill (Senate Floor Amendment No. 3, pages 2 and 3) and
15	15	substituting the following in the first place that subsection is
16	16	amended by the bill:
17	17	(a-1) In [For purposes of] assigning [an overall]
18	18	performance ratings [rating] under Subsection (a), the
19	19	commissioner may adjust the overall performance rating of a
20	20	district or campus if the performance of the district or campus
21	21	under the indicators described by Section 39.053(c), based on
22	22	information disaggregated by race, ethnicity, socioeconomic
23	23	status, or other factors, does not meet standards established by
24	24	the commissioner. The commissioner shall [attribute]:
25	25	(1) attribute 55 percent of the performance evaluation
26	26	to the achievement indicators for the first, second, and third
27	27	domains under Sections 39.053(c)(1)-(3), provided that the
28	28	commissioner shall consider either the district's or campus's
29	29	performance rating under the first domain or the second domain,
30	30	whichever performance rating is higher, unless the district or
31	31	campus received a performance rating of F in either domain, in which
32	32	case the district or campus may not be assigned an overall
33	33	performance rating higher than B;
34	34	(2) for middle and junior high school and elementary
35	35	campuses and districts that include only those campuses, attribute
36	36	35 percent of the performance evaluation to the applicable
37	37	achievement indicators for the fourth domain under Section
38	38	39.053(c)(4);
39	39	(3) for high school campuses and districts that
40	40	include those campuses, attribute:
41	41	(A) 10 percent of the performance evaluation to
42	42	the high school graduation rate achievement indicator described by
43	43	Section 39.053(c)(4)(A)(ii); and
44	44	(B) 25 percent to the remaining applicable
45	45	achievement indicators for the fourth domain under Section
46	46	39.053(c)(4); and
47	47	(4) attribute 10 percent of the performance evaluation
48	48	to the locally selected and evaluated achievement indicators
49	49	provided for under the fifth domain under Section 39.053(c)(5).
