| 9 | 9 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 49-g(c), Article III, Texas |
|---|
| 11 | 11 | | Constitution, is amended to read as follows: |
|---|
| 12 | 12 | | (c) Not later than the 90th day of each fiscal year, the |
|---|
| 13 | 13 | | comptroller of public accounts shall transfer from the general |
|---|
| 14 | 14 | | revenue fund to the economic stabilization fund and the state |
|---|
| 15 | 15 | | highway fund the sum of the amounts described by Subsections (d) and |
|---|
| 16 | 16 | | (e) of this section, to be allocated as provided by Subsections |
|---|
| 17 | 17 | | (c-1) and (c-2) of this section. However, if necessary and |
|---|
| 18 | 18 | | notwithstanding the allocations prescribed by Subsections (c-1) |
|---|
| 19 | 19 | | and (c-2) of this section, the comptroller shall reduce |
|---|
| 20 | 20 | | proportionately the amounts described by Subsections (d) and (e) of |
|---|
| 21 | 21 | | this section to be transferred and allocated to the economic |
|---|
| 22 | 22 | | stabilization fund to prevent the amount in that fund from |
|---|
| 23 | 23 | | exceeding the limit in effect for that biennium under Subsection |
|---|
| 24 | 24 | | (g) of this section. Revenue transferred to the state highway fund |
|---|
| 25 | 25 | | under this subsection may be used only for constructing, |
|---|
| 26 | 26 | | maintaining, and acquiring rights-of-way for: |
|---|
| 27 | 27 | | (1) public roadways other than toll roads; |
|---|
| 28 | 28 | | (2) public transportation; |
|---|
| 29 | 29 | | (3) public bicycle paths; and |
|---|
| 30 | 30 | | (4) public sidewalks. |
|---|
| 31 | 31 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 32 | 32 | | submitted to the voters at an election to be held November 7, 2017. |
|---|
| 33 | 33 | | The ballot shall be printed to permit voting for or against the |
|---|
| 34 | 34 | | proposition: "The constitutional amendment to permit additional |
|---|
| 35 | 35 | | uses of certain dedicated general revenue transferred each fiscal |
|---|
| 36 | 36 | | year to the state highway fund." |
