55 A JOINT RESOLUTION
66 proposing a constitutional amendment to permit additional uses of
77 certain dedicated general revenue transferred each fiscal year to

99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 49-g(c), Article III, Texas
1111 Constitution, is amended to read as follows:
1212 (c) Not later than the 90th day of each fiscal year, the
1313 comptroller of public accounts shall transfer from the general
1414 revenue fund to the economic stabilization fund and the state
1515 highway fund the sum of the amounts described by Subsections (d) and
1616 (e) of this section, to be allocated as provided by Subsections
1717 (c-1) and (c-2) of this section. However, if necessary and
1818 notwithstanding the allocations prescribed by Subsections (c-1)
1919 and (c-2) of this section, the comptroller shall reduce
2020 proportionately the amounts described by Subsections (d) and (e) of
2121 this section to be transferred and allocated to the economic
2222 stabilization fund to prevent the amount in that fund from
2323 exceeding the limit in effect for that biennium under Subsection
2424 (g) of this section. Revenue transferred to the state highway fund
2525 under this subsection may be used only for constructing,
2626 maintaining, and acquiring rights-of-way for:
2727 (1) public roadways other than toll roads;
2828 (2) public transportation;
2929 (3) public bicycle paths; and
3030 (4) public sidewalks.
3131 SECTION 2. This proposed constitutional amendment shall be
3232 submitted to the voters at an election to be held November 7, 2017.
3333 The ballot shall be printed to permit voting for or against the
3434 proposition: "The constitutional amendment to permit additional
3535 uses of certain dedicated general revenue transferred each fiscal
3636 year to the state highway fund."
